Truth behind ‘Lupoca’ graffiti seen everywhere in Birmingham – who puts it there and why<\/a><\/p>\nBoth have already admitted manslaughter, a jury was told as the case was opened yesterday (Tuesday, April 21).<\/p>\n
Prosecutor Michael Brady KC stated paramedics attended the club after a call to emergency services from the venue manager shortly before midday on September 26.<\/p>\n
Mr Tsegay was taken to hospital but was pronounced dead at 6.20pm on September 29.<\/p>\n
The victim and the defendants all hail from Eritrea in north-east Africa and were ‘known to each other’, the court heard.<\/p>\n
The prosecutor said: “Following increasing tensions and exchanges between Mr Tsegay and the defendants over a number of hours, during the course of which all three were drinking, violence erupted.<\/p>\n
“I must acknowledge, certainly initially, Mr Tsegay may not have been entirely blameless in the buildup to the infliction of the fatal injury.”<\/p>\n
He continued: “What you do see at the time his injuries were inflicted as a consequence of being thrown by Mr Gilzgi and pushed by Mr Gebrengus down a flight of stairs, Mr Tsegay was not being aggressive, he posed no threat and given his highly intoxicated state was not in a position to defend himself against the two defendants who we say intended to cause really serious harm to Mr Tsegay.<\/p>\n
“As a result of being thrown and pushed down the stairs, Mr Tsegay suffered catastrophic injuries from which he never recovered.”<\/p>\n
CCTV captured the interactions between all three men inside the club on Lower Tower Street.<\/p>\n
The jury was told Mr Tsegay arrived at the venue with a group which included Grebengus at 5.30am that morning.<\/p>\n
Gilzgi was said to arrive around an hour and a half later.<\/p>\n
Mr Brady described various flashpoints between the men, occurring from 9.20am when Grebengus allegedly ‘took exception’ to Mr Tsegay moving shisha coals.<\/p>\n
He stated that the defendants moved to another booth next to the one where Mr Tsegay remained.<\/p>\n
Mr Brady explained that there were numerous interactions between them during the morning hours.<\/p>\n
At around 11.15am the club manager intervened as they clashed again, the court was told.<\/p>\n
The prosecutor said that around 15 minutes later, Mr Tsegay pushed Gilzgi, which led to the two grappling and swinging punches at each other.<\/p>\n
A similar confrontation took place shortly afterwards, and Gilzgi was alleged to have struck Mr Tsegay over the head with a shisha pipe and then inadvertently hit Grebengus with it when he swung it again.<\/p>\n
The prosecutor told the court that Grebengus left the room, but when he returned, he ran towards Mr Tsegay and hit him to the face, knocking him and Gilzgi, whom he was grappling with, to the floor.<\/p>\n
It was alleged that Grebengus then stamped on Mr Tsegay’s head several times while he was on the floor.<\/p>\n
Mr Brady said at 11.46am the defendants encouraged the victim towards the stairs leading out of the nightclub.<\/p>\n
He told the court that when at the top Gilzgi ‘launched’ Mr Tsegay down the stairs while Grebengus ‘extended his right hand, moved forward and pushed’.<\/p>\n
The prosecutor said Grebengus was ‘adding support’ to Gilzgi who ‘provided the majority of force’.<\/p>\n
Mr Brady added: “The combined forceful efforts of both defendants working together is evidenced by the distance Mr Tsegay travelled through the air before landing on the bottom of the stairs.<\/p>\n
“This was no mere trip or stumble at the top of the stairs following an insignificant push.<\/p>\n
“We say in using combined force the clear inference is both intended to cause Mr Tsegay really serious harm.<\/p>\n
