{"id":83928,"date":"2026-07-16T04:49:15","date_gmt":"2026-07-16T04:49:15","guid":{"rendered":"https:\/\/www.europesays.com\/britain\/83928\/"},"modified":"2026-07-16T04:49:15","modified_gmt":"2026-07-16T04:49:15","slug":"judge-orders-uk-pro-palestinian-group-to-pay-british-israeli-idf-soldier","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/britain\/83928\/","title":{"rendered":"Judge orders UK pro-Palestinian group to pay British-Israeli IDF soldier"},"content":{"rendered":"<p><a href=\"https:\/\/www.jpost.com\/international\/article-902369\" target=\"_blank\" rel=\"nofollow noopener\">UK<\/a> judge orders ICJ Palestine to pay full legal costs of \u00a382,130 to a British-Israeli dual national it tried to prosecute for serving in the IDF.<\/p>\n<p>The story, as covered by The Jerusalem Post at the <a href=\"https:\/\/www.jpost.com\/international\/article-900165\" target=\"_blank\" rel=\"nofollow noopener\">end of June<\/a>, is that the ICJP formally applied for a court summons to prosecute Soldier A for allegedly breaching Britain\u2019s Foreign Enlistment Act (FEA) of 1870 by voluntarily serving in the Israeli military.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">The ICJP\u2019s attempt failed dramatically in court, with Senior District Judge Paul Goldspring of Westminster Magistrates\u2019 Court unleashing a damning polemic against the ICJP\u2019s legal team. Goldspring called the attempt \u201cegregious\u201d and legally \u201cinadmissible.\u201d<\/p>\n<p>He also called it \u201cfundamentally misconceived in law,\u201d as the FEA does not apply to dual nationals.<br \/>Then, on June 19, Goldspring ruled that the ICJP must pay legal costs to Soldier A, the exact amount of which was just revealed on Friday.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">In the new ruling, Goldspring ruled that, where a private prosecution is commenced on the \u201cbasis of culpable, profound breaches of the fundamental duty of candor, costs should be assessed on an indemnity basis to properly restore the Defendant\u2019s position.\u201d<\/p>\n<p><img alt=\"\" loading=\"lazy\" width=\"822\" height=\"829\" decoding=\"async\" data-nimg=\"1\" style=\"color:transparent\" src=\"https:\/\/www.europesays.com\/britain\/wp-content\/uploads\/2026\/07\/727186.jpeg\"\/><\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">In simple terms, the judge found that because the prosecution seriously failed in its duty to be honest and open with the court, it should pay Soldier A\u2019s legal costs on a more generous basis than usual.<\/p>\n<p>Goldspring ordered the <a href=\"https:\/\/www.jpost.com\/diaspora\/article-900568\" target=\"_blank\" rel=\"nofollow noopener\">ICJP<\/a> to pay the total sum of \u00a382,130, which he said was \u201centirely reasonable and proportionate given the complexity of the response forced upon Soldier A.\u201d<\/p>\n<p>Judge demands ICJP apologize for lack of candor<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">Goldspring noted that the ICJP did \u201crecognize the systemic failures of candor\u201d following his prior ruling.
