sectors such as agriculture, care, construction,\u00a0and hospitality may face renewed\u00a0labour\u00a0shortages.\u00a0<\/p>\n<p paraeid=\"{acc5d263-a2d4-44b2-afb1-0a70320b58e2}{32}\" paraid=\"1373617224\">By contrast, Michelle Dulmadge,\u00a0Executive\u00a0Vice\u2011President\u00a0of\u00a0HR, at\u00a0pipeline and infrastructure firm\u00a0Surerus Murphy, underscores potential benefits from stronger guardrails for vulnerable workers\u00a0that the\u00a0newly-minted\u00a0Carney majority could bring\u00a0related to restrictions\u00a0it\u2019s\u00a0already\u00a0implementd.\u00a0\u201cWe\u2019ve\u00a0utilized temporary foreign workers in the past, especially if they have unique and specialized skill sets,\u201d says Dulmadge. \u201cBut I think that\u00a0the government putting restrictions or requirements around those workers, potentially has a benefit.\u201d\u00a0<\/p>\n<p paraeid=\"{acc5d263-a2d4-44b2-afb1-0a70320b58e2}{34}\" paraid=\"45249481\">For Dulmadge, ethical recruitment and employment remain central regardless of which party governs. \u201cAt\u00a0the end of the day,\u00a0we\u00a0want to see that there are not just regulations around it, but that we&#8217;re ensuring that we&#8217;re bringing in people who are being paid fairly, that they&#8217;re entering the country legally,\u201d she says. \u201cWe&#8217;ve seen that with some of the modern slavery requirements of companies to make sure that\u00a0we\u2019re\u00a0ensuring that our workforce isn\u2019t being taken advantage of, especially because they may be marginalized.\u201d\u00a0\u00a0<\/p>\n<p>Legislation\u00a0only\u00a0part of the\u00a0labour\u00a0law landscape\u00a0<\/p>\n<p paraeid=\"{acc5d263-a2d4-44b2-afb1-0a70320b58e2}{38}\" paraid=\"513773975\">A\u00a0majority government has limited room to change the overall\u00a0legal\u2011risk\u00a0landscape, because much of Canadian employment law is\u00a0judge\u2011made, says Whitten. \u201cThere\u2019s\u00a0only so much that\u00a0[Carney]\u00a0can do to make us competitive on a\u00a0labour\u00a0market factor,\u00a0bcause\u00a0a lot of the rights and obligations in the employment world are driven by the common law of Canada, the judge-made law,\u201d\u00a0he says.\u00a0\u201cOur legislation sets the minimum standards, but the rest of it is by virtue of court decisions.\u201d\u00a0He\u00a0points to\u00a0recent\u00a0court\u00a0decisions\u00a0that\u00a0have repeatedly undermined contractual severance limits\u00a0and\u00a0<a href=\"https:\/\/www.hcamag.com\/ca\/specialization\/employment-law\/the-battle-for-enforceability-of-termination-clauses\/516876\" rel=\"noreferrer noopener nofollow\" target=\"_blank\">termination clauses<\/a>,\u00a0increasing the cost and uncertainty of terminations\u00a0for employers\u00a0and\u00a0making\u00a0Canada\u00a0\u201can extremely expensive jurisdiction to operate in\u201d compared with US\u00a0employment\u2011at\u2011will\u00a0norms, he says.\u00a0<\/p>\n<p paraeid=\"{acc5d263-a2d4-44b2-afb1-0a70320b58e2}{40}\" paraid=\"1788938297\">From\u00a0Dulmadge\u2019s\u00a0vantage point, the new majority\u00a0hasn\u2019t\u00a0yet produced a visible federal\u00a0labour\u2011law\u00a0agenda, as Carney\u2019s focus has been on the economy and trade. \u201cIt&#8217;ll be interesting to see how it plays out, as\u00a0I haven&#8217;t really seen that they&#8217;ve been forecasting\u00a0anything\u00a0related to federal employment or\u00a0labour\u00a0laws,\u201d she says.\u00a0\u201cRight now,\u00a0the focus has absolutely been on our international relations, the cost of fuel,\u00a0and\u00a0those kind of
