Sheldon Robb, who were working in K Division’s traffic services unit when they were charged last summer.

A spokesperson for the Crown said important evidence in the case had changed.

“Crown prosecutors have an obligation to assess their cases on a continual basis to ensure all aspects of the evidence are carefully considered and meet the standard for prosecution,” Michelle Davio said in an email. “For a matter to proceed, there must be a reasonable likelihood of a conviction and the matter must be in the public interest.”

“In each of these files, key evidence changed. Crown prosecutors conducted a reassessment of these files and determined the available evidence was not sufficient to proceed.”

The charge against Mayowski, now a civilian, was stayed June 26, while prosecutors withdrew the charge against Robb April 23.

An RCMP spokesperson said Robb remains suspended with pay pending a code of conduct investigation.

The Alberta Serious Incident Response Team (ASIRT) opened an investigation into the officers Feb. 16, 2024, and laid charges last August. The agency did not provide specifics about the the charges, but according to court records the officers were accused of committing breaches of trust “in connection with the duties of (their) office by engaging in a personal sexual relationship” with a woman.

The woman named was the same in both sets of charges.

At the time charges were laid, Mayowski and Robb were sergeants based in Westlock and Morinville, respectively. The charges against Mayowski claimed the alleged breaches happened in October 2022, while the charge against Robb covers Jan. 1, 2020 to Jan. 31, 2024.

While rare, charges that are stayed can be revived by the Crown within one year if new evidence emerges. Charges that are withdrawn ends the prosecution permanently.

jwakefield@postmedia.com

x.com/jonnywakefield

jonnywakefield.bsky.social

Related

Bookmark our website and support our journalism: Don’t miss the news you need to know — add EdmontonJournal.com and EdmontonSun.com to your bookmarks and sign up for our newsletters.

You can also support our journalism by becoming a digital subscriber.
