{"id":31492,"date":"2026-05-04T17:48:20","date_gmt":"2026-05-04T17:48:20","guid":{"rendered":"https:\/\/www.europesays.com\/canada\/31492\/"},"modified":"2026-05-04T17:48:20","modified_gmt":"2026-05-04T17:48:20","slug":"government-prepares-to-ratify-canada-trade-deal-before-summer-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/canada\/31492\/","title":{"rendered":"Government prepares to ratify Canada trade deal before summer \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">The <a href=\"https:\/\/www.irishtimes.com\/tags\/canada\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/canada\">Canada<\/a>&#8211;<a href=\"https:\/\/www.irishtimes.com\/tags\/european-union\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/european-union\/\">EU<\/a> trade deal, blocked by the Supreme Court four years ago, could be ratified before the summer.<\/p>\n<p class=\"c-paragraph paywall \">The Government is keen the agreement, known as Ceta, will be ratified in time for a possible visit here by the Canadian prime minister <a href=\"https:\/\/www.irishtimes.com\/tags\/mark-carney\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/mark-carney\/\">Mark Carney<\/a> in the early summer. <\/p>\n<p class=\"c-paragraph paywall \">On Wednesday, the Government will bring legislation, already passed by the D\u00e1il, to the Seanad which when passed will pave the way for the trade deal to be ratified. It will overrule Opposition concerns about a controversial system of investor courts, which are designed to settle disputes between States and investors. <\/p>\n<p class=\"c-paragraph paywall \">The deal was blocked by the <a href=\"https:\/\/www.irishtimes.com\/tags\/supreme-court\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/supreme-court\/\">Supreme Court<\/a> in 2022 when then Green Party TD Patrick Costello took a court challenge \u2013 essentially against the policy of his own government \u2013 to the ratification of the agreement.<\/p>\n<p class=\"c-paragraph paywall \">The court <a href=\"https:\/\/www.irishtimes.com\/ireland\/2022\/11\/13\/taoiseach-welcomes-supreme-court-ruling-on-ceta-trade-deal\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/ireland\/2022\/11\/13\/taoiseach-welcomes-supreme-court-ruling-on-ceta-trade-deal\/\">ruled that parts of the way the deal would work infringed the Constitution<\/a>, stopping ratification in its tracks. Unusually, however, Judge Gerard Hogan suggested in his judgment a constitutional fix involving legislation to change the Arbitration Act, effectively giving the High Court powers to approve decisions made under the trade agreement. <\/p>\n<p class=\"c-paragraph paywall \">This bill, the Arbitration Amendment Bill, has already been passed by the D\u00e1il and is expected to be approved by the Seanad in the coming weeks.<\/p>\n<p class=\"c-paragraph paywall \">This would clear the way for the Ceta agreement to be then ratified quickly, understood to be the Government\u2019s intention. That would require a separate vote in the D\u00e1il.<\/p>\n<p class=\"c-paragraph paywall \">The free trade elements of the Ceta agreement, which included an abolition of almost all tariffs previously in place between Canada and the EU, have been provisionally in place since 2017.<\/p>\n<p class=\"c-paragraph paywall \">In that time, there has been more than a tripling of trade between Ireland and Canada, from \u20ac3 billion to \u20ac10 billion annually, and a quadrupling of the value of Irish exports.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/world\/europe\/2026\/05\/04\/canada-contribution-and-iran-backdrop-give-armenia-summit-feeling-of-a-trump-therapy-session\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Canada contribution and Iran backdrop give Armenia summit feeling of Trump-therapy sessionOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">However, Opposition politicians and some non-governmental organisations (NGOs) have criticised aspects of the deal which they say would allow corporations to challenge social and environmental regulations in special tribunals.<\/p>\n<p class=\"c-paragraph paywall \">\u201cWe have nothing to gain and much to lose,\u201d said Independent Senator Alice Mary Higgins. \u201cAll the trade aspects of Ceta are already happening. The Arbitration Bill is entirely about the unnecessary and dangerous introduction of investor courts. This is a deeply reckless move from Government which creates massive avoidable financial risk and sabotages the ability of future governments and even future generations to deliver public policies that best serve the public interest.\u201d<\/p>\n<p><img decoding=\"async\" data-chromatic=\"ignore\" alt=\"Minister of State for Europe Thomas Byrne. Photograph: Grainne Ni Aodha\/PA Wire <\/p>\n<p class=\"c-paragraph paywall \">Costello, who is no longer a TD, said it would be \u201ca disaster\u201d if the deal was ratified.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThis is not about trade,\u201d he said. \u201cTo say \u2018those opposed to Ceta are opposed to trade\u2019 is a lie. This is about the investor courts inside Ceta.\u201d<\/p>\n<p class=\"c-paragraph paywall \">He said he expected someone will \u201cdefinitely\u201d launch another constitutional challenge to the deal, though he added it would not be him on this occasion.<\/p>\n<p class=\"c-paragraph paywall \">But Minister of State for Europe Thomas Byrne, who is bringing the bill through the legislative process, disputed many of the claims made about the bill and the investor courts under the deal, suggesting they were \u201cnot realistic\u201d.<\/p>\n<p class=\"c-paragraph paywall \">\u201cCeta will have no impact on the State\u2019s ability to provide social services, or housing, or implement environmental regulations.
