{"id":75782,"date":"2026-06-05T10:59:09","date_gmt":"2026-06-05T10:59:09","guid":{"rendered":"https:\/\/www.europesays.com\/canada\/75782\/"},"modified":"2026-06-05T10:59:09","modified_gmt":"2026-06-05T10:59:09","slug":"editorial-canadas-extraordinary-new-citizenship-rules","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/canada\/75782\/","title":{"rendered":"Editorial: Canada&#8217;s extraordinary new citizenship rules"},"content":{"rendered":"<p>\t\tRead:   3 min<\/p>\n<p class=\"wp-block-paragraph\">There has been a flurry of <a href=\"https:\/\/www.cbc.ca\/news\/politics\/canadian-citizenship-ancestry-american-9.7216737\" rel=\"nofollow noopener\" target=\"_blank\">stories<\/a> recently about Americans seeking Canadian citizenship under new rules that quietly took effect in December.<\/p>\n<p class=\"wp-block-paragraph\">The narrative is a familiar \u2014 and popular \u2014 one in Canada: Americans are disgruntled with President Trump\u2019s policies and are keen to move northward.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">These <a href=\"https:\/\/www.canadianaffairs.news\/2026\/06\/01\/new-citizenship-rules-leave-canadian-archivists-overwhelmed\/\" rel=\"nofollow noopener\" target=\"_blank\">stories<\/a>, while important, do not do justice to the enormity of the change that has occurred, or analyze whether it was the right one.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">The new rules retroactively affirm that untold thousands of people born outside of Canada are Canadian citizens, regardless of their modern-day connection to the country.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">The origins of the change stem from a single lower-court ruling in 2023 that deemed Canada\u2019s existing citizenship rules unconstitutional. Those rules, known as the \u201cfirst generation limit,\u201d prevented a parent born outside of Canada from automatically passing on Canadian citizenship to a child also born abroad.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">In a highly unusual move, the Trudeau government chose not to appeal that decision \u2014 as governments almost always do when they lose a case.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe government did not appeal the ruling because the first generation limit has had unacceptable consequences for some Canadians whose children were born outside the country,\u201d a 2024 Government of Canada statement <a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/corporate\/transparency\/committees\/soci-dec-5-2024\/first-gen-limit.html\" rel=\"nofollow noopener\" target=\"_blank\">says<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">Instead, the government established an expansive new framework to govern citizenship by descent that will have sweeping consequences.<\/p>\n<p class=\"wp-block-paragraph\">The new framework has two parts:<\/p>\n<p class=\"wp-block-paragraph\">One part applies to people born or adopted abroad before December 2025 who can show an ancestral connection to a Canadian citizen. These people do not need to be granted citizenship; if they demonstrate eligibility, they are simply affirmed as having it.<\/p>\n<p class=\"wp-block-paragraph\">\u201cPeople born outside Canada before December 15, 2025, must show they have a Canadian parent \u2014 or a parental ancestor, such as a grandparent or great-grandparent \u2014 who became a Canadian citizen on or after January 1, 1947 (or April 1, 1949, in Newfoundland and Labrador),\u201d a government spokesperson told Canadian Affairs this week.\u00a0<\/p>\n<p class=\"has-text-align-center wp-block-paragraph\" style=\"font-size:29px\">Thank you for being a paid subscriber. Receive our free Saturday newsletter featuring our best stories from the week.<\/p>\n<p class=\"wp-block-paragraph\">(The dates 1949 and 1947 are the dates when Canadian citizenship as a legal status came into existence in Newfoundland and the rest of Canada, respectively.)<\/p>\n<p class=\"wp-block-paragraph\">As one immigration law firm <a href=\"https:\/\/atimmigrationlaw.com\/bill-c-3-changes-canadian-citizenship-by-descent-rules-opening-doors-for-americans-and-others\/\" rel=\"nofollow noopener\" target=\"_blank\">wrote<\/a>, \u201cIn practical terms, this means citizenship can reach back to the earliest days of Canada \u2014 including pre-Confederation ancestors \u2014 so long as: There is a qualifying Canadian \u2018anchor\u2019 ancestor; [and] each generational link is properly documented \u2026\u00a0<\/p>\n<p class=\"wp-block-paragraph\">\u201cGenerational distance alone does not defeat a claim. Documentation determines outcome.\u201d<\/p>\n<p class=\"wp-block-paragraph\">So for example, imagine a woman born in Canada in the 1930s who emigrated to the United States and had children, grandchildren and great-grandchildren there \u2014 none of whom lived in Canada.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">Under the new rules, her descendants could claim Canadian citizenship, because the woman would have become a Canadian citizen in 1947 by virtue of being born in Canada.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">The second part of the new framework applies to people born abroad to Canadian parents after December 2025.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">These individuals are \u201cable to access citizenship provided the Canadian parent can demonstrate a substantial connection to Canada in the form of at least 1,095 cumulative days of physical presence in Canada before the child\u2019s birth or adoption,\u201d the government spokesperson said.<\/p>\n<p class=\"wp-block-paragraph\">These new rules only narrowly <a href=\"https:\/\/www.ourcommons.ca\/Members\/en\/votes\/45\/1\/47\" rel=\"nofollow noopener\" target=\"_blank\">passed<\/a> in Parliament, by a 177-163 vote. The Liberals and NDP voted in favour; the Bloc Quebecois and Conservatives were opposed.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">The Bloc had proposed stricter screening criteria, including language proficiency, a citizenship knowledge test, a security assessment, and a requirement that the 1,095 days of residence fall within a five-year period.<\/p>\n<p class=\"wp-block-paragraph\">The Conservatives argued Ottawa should have to conduct police checks before people gain citizenship, and also said applicants should be required to show a substantial connection to Canada.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">We think the opposition parties\u2019 demands were reasonable.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">After all, Canadian citizenship is an extraordinary privilege. It confers enormous benefits on citizens, including access to health care, education and old age security.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">It should not be too much to ask that people show a meaningful connection to Canada to gain this privilege \u2014 or for the federal government to first scrutinize applicants\u2019 records to ensure they do not pose a security threat.<\/p>\n<p class=\"wp-block-paragraph\">Perhaps some parts of these criteria might have failed a future court challenge. But constitutional rights are not absolute. In their assessment of the validity of a law, courts consider governments\u2019 objectives in imposing limits on rights. Objectives such as security or substantial connection to Canada could well pass muster with the courts.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">It is also concerning that this truly major change took place with so little public debate or awareness of it.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">As one immigration law firm <a href=\"https:\/\/canadianimmigrationexperts.ca\/bill-c3-canadian-citizenship-by-descent\/\" rel=\"nofollow noopener\" target=\"_blank\">wrote<\/a>, \u201cThere are people alive today who became Canadian citizens on December 15, 2025, and have no idea. No application. No ceremony. No announcement. Just a law that came into force quietly, and changed everything.\u201d\u00a0<\/p>\n<p class=\"wp-block-paragraph\">This is extraordinary \u2014 and not in a good way.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">Immigration is one of the most sensitive political files. Support for immigration must be carefully nurtured, and can quickly vanish.<\/p>\n<p class=\"wp-block-paragraph\">The fact that this change came about so quietly is disquieting.
