Novartis AG failed to convince a federal appeals court that it should block a Missouri law requiring pharmaceutical manufacturers to discount drugs to an unlimited number of pharmacies under a federal program.

The drugmaker is unlikely to succeed on its claims that it would be harmed by Missouri’s S.B. 751 without a preliminary injunction, the US Court of Appeals for Eighth Circuit upheld Wednesday. The state law, which went into effect in 2024, prohibits drug manufacturers from imposing restrictions on pharmacies that can access their steep drug discounts through the federal 340B Drug Pricing Program.
