{"id":128191,"date":"2026-09-09T11:30:12","date_gmt":"2026-09-09T11:30:12","guid":{"rendered":"https:\/\/www.europesays.com\/ch\/128191\/"},"modified":"2026-09-09T11:30:12","modified_gmt":"2026-09-09T11:30:12","slug":"sc-acquits-imelda-marcos-in-graft-case-over-swiss-foundations","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ch\/128191\/","title":{"rendered":"SC acquits Imelda Marcos in graft case over Swiss foundations"},"content":{"rendered":"\n<p>  Published  September 9, 2026 6:43pm  <\/p>\n<p>     <a href=\"https:\/\/www.google.com\/preferences\/source?q=gmanetwork.com\" target=\"_blank\" class=\"gma-preferred-source-link\" rel=\"nofollow noopener\">  Add GMA on Google <\/a> <\/p>\n<p> Make this your preferred source to get more updates from this publisher on Google. <\/p>\n<p>The Supreme Court has overturned former First Lady Imelda Marcos\u2019 graft conviction over her alleged financial interests in seven Swiss foundations. <\/p>\n<p>In a decision dated June 10, 2026, but made public on Wednesday, September 9, the SC First Division reversed the <a href=\"https:\/\/www.gmanetwork.com\/news\/topstories\/nation\/674197\/sandiganbayan-imelda-marcos-used-swiss-foundations-for-personal-benefit\/story\/\" target=\"_blank\" rel=\"nofollow noopener\">Sandiganbayan\u2019s November 2018 ruling<\/a> that found her guilty of seven counts of graft.<\/p>\n<p>Marcos allegedly had pecuniary interests and participation in the management of several non-government organizations in Switzerland from 1978 to 1984 during her time as Minister of Human Settlements, Metro Manila Governor, and interim member of the Batasan Pambansa.<\/p>\n<p>The Sandiganbayan said the seven foundations-Maler Establishment, Trinidad Foundation, Rayby Foundation, Palmy Foundation, Vibur Foundation, Aguamina Foundation, and Avertina Foundation &#8211; were established primarily to benefit the Marcos family.<\/p>\n<p>It said that the foundations were &#8220;put up primarily for the entrepreneurial activity of opening bank accounts and deposits, transferring funds, earning interests and even profit from investment, for the private benefit of the Marcos family as beneficiaries.&#8221;<\/p>\n<p>Acting on Marcos&#8217; appeal, the SC found the prosecution\u2019s testimonial and documentary evidence inadmissible and lacking in probative value.<\/p>\n<p>&#8220;In sum, the relevant Swiss documents were not properly authenticated. The prosecution was not able to present any credible witness who could have attested to the genuineness and due execution of the documents,&#8221; the SC said through Associate Justice Rodil Zalameda. <\/p>\n<p>&#8220;All told, the prosecution failed to establish that the subject foundations are businesses as the term is ordinarily understood. Any financial or pecuniary interest in the subject foundations is not covered by Section 3(h) of Republic Act No. 3019 and Article IX, Section 7 (then Section 8) of the 1973 Constitution.
