{"id":26797,"date":"2026-03-06T17:35:15","date_gmt":"2026-03-06T17:35:15","guid":{"rendered":"https:\/\/www.europesays.com\/ch\/26797\/"},"modified":"2026-03-06T17:35:15","modified_gmt":"2026-03-06T17:35:15","slug":"rival-websites-fuel-ny-archdiocese-chubb-feud-over-abuse-payouts","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ch\/26797\/","title":{"rendered":"Rival Websites Fuel NY Archdiocese-Chubb Feud Over Abuse Payouts"},"content":{"rendered":"<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2 Paragraph_dropCap_1B2M2\">A few paragraphs deep in a <a href=\"https:\/\/aboutblaw.com\/bk5z\" rel=\"nofollow noopener\" target=\"_blank\">sworn statement<\/a> filed in court last month was a curious admission by the former chief financial officer for the Archdiocese of New York:<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">The church had been briefed in late 2023 and early 2024 on communications and fundraising by an abuse victims\u2019 advocacy group, the Coalition for Just and Compassionate Compensation, ex-CFO William Whiston acknowledged, without elaborating.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Since <a data-terminal-id=\"S42TXODWX2PS\" href=\"https:\/\/news.bloomberglaw.com\/bankruptcy-law\/catholic-abuse-survivors-form-nonprofit-seeking-insurer-payouts\" rel=\"nofollow noopener\" target=\"_blank\">launching in 2023<\/a>, the group had been publicly savaging the archdiocese\u2019s insurer, Chubb Ltd., attempting to shame it into paying out sex abuse claims filed against the church.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">It slammed Chubb in a <a href=\"https:\/\/justice4survivors.com\/2023\/11\/15\/cjcc-in-the-new-york-times\/\" rel=\"nofollow noopener\" target=\"_blank\">full-page ad<\/a> in the New York Times, <a href=\"https:\/\/justice4survivors.com\/2024\/08\/26\/child-sex-abuse-survivors-advocates-state-lawmakers-protest-at-u-s-open-call-on-usta-to-drop-sponsor-that-profits-by-refusing-to-pay-claims-in-child-sex-abuse-cases-chubb-insurance\/\" rel=\"nofollow noopener\" target=\"_blank\">sent protesters<\/a> to the Chubb-sponsored US Open, flew a banner over another Chubb event in Florida, launched an anti-Chubb <a href=\"https:\/\/justice4survivors.com\/\" rel=\"nofollow noopener\" target=\"_blank\">website<\/a>, and enlisted TikTok influencers to assail the company.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Church leaders had previously denied any ties, and Whiston\u2019s statement repeated they had no role in funding or directing the group. Still, Chubb asserted his affidavit was \u201cfurther proof that the CJCC is just an arm\u201d of the archdiocese.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">The allegations had a familiar ring. Chubb weeks earlier acknowledged it had been the anonymous operator of a different attack website \u2014 one made to look as if it represented abuse victims and advocates outraged by the church\u2019s pace in resolving the claims.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">In court filings, the archdiocese contends that website is part of Chubb\u2019s shadow campaign against it. It has <a href=\"https:\/\/www.archny.org\/posts\/archdiocese-of-new-york-statement-regarding-chubb-insurance\" rel=\"nofollow noopener\" target=\"_blank\">publicly accused<\/a> the insurer of trying to push the church toward bankruptcy.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">The back-and-forth and dueling websites reflect what longtime court observers say has become an unusually vicious and protracted fight between the powerhouse insurer and its client, one of the country\u2019s largest Catholic institutions.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">For nearly three years, the two sides have battered each other in <a href=\"https:\/\/www.bloomberglaw.com\/document\/X1Q6OJLCREO2\" rel=\"nofollow noopener\" target=\"_blank\">relentless legal filings<\/a> in a New York court, and their war over who should pay shows few signs of abating.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Stuck in limbo are more than 1,500 claims from alleged abuse victims that together could cost the church \u2014 or its insurer \u2014 at least hundreds of millions of dollars.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">\u201cI would say that both houses, the house of Chubb and the house of the Archdiocese of New York, have had more than enough ugly behavior and despicable behavior,\u201d said Michael G. Dowd, a lawyer representing about 30 claimants.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">The underlying claims in New York aren\u2019t vastly different from the tens of thousands of abuse-related lawsuits filed against many Catholic dioceses over the past two decades.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">By 2023, six of the eight Catholic dioceses in New York had filed for Chapter 11. Together, those dioceses were named in at least 2,800 abuse claims. Half have secured court approval of their bankruptcy plans, agreeing so far to pay at least $1 billion to victims.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">The Archdiocese of New York dwarfs them all. It says it\u2019s home to more than 2.5 million Catholics, and owns or operates hundreds of parishes, schools and other sites across Manhattan, Staten Island, the Bronx, and seven suburban counties.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">In 2017, the archdiocese cited the looming abuse-victim settlements as the reason it took out a $100 million mortgage on midtown Manhattan property it owned; the next year it announced it had already paid $60 million to settle some cases.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">A flood of new claims followed when New York\u2019s 2019 Child Victims Act temporarily opened a statute of limitations window that let accusers sue over decades-old abuse.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Most of the lawsuits rely on negligence-based theories, accusing the archdiocese of failing to properly vet or supervise abusers it hired \u2014 not just priests but also teachers, coaches, and other employees or volunteers at parishes and schools.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Chubb sued <a href=\"https:\/\/aboutblaw.com\/bk5C\" rel=\"nofollow noopener\" target=\"_blank\">in 2023<\/a>, arguing it had no obligation to cover such claims because its policies with the archdiocese only covered accidental \u201coccurrences.\u201d<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">The archdiocese, Chubb asserted, knew about and fostered widespread sexual abuse for nearly a century, prioritizing its reputation and financial survival over child safety, and making the resulting injuries both expected and uninsurable. Chubb has also said church leaders resisted providing information necessary to investigate individual claims.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">In turn, the archdiocese <a href=\"https:\/\/aboutblaw.com\/bk5D\" rel=\"nofollow noopener\" target=\"_blank\">accused<\/a> Chubb of pursuing a nationwide corporate strategy of \u201creneging on and avoiding its obligations\u201d to cover abuse claims, despite collecting tens of millions of dollars in premiums.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">There\u2019s no dispute the abuse claims had hurt the bottom line for Chubb, one of the world\u2019s biggest publicly traded property and casualty insurance companies. Its costs between 2022 and 2024 came in $262 million above projections, largely because of so-called \u201creviver\u201d statutes like the one passed in New York, its financial reports show.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Catholic dioceses and Chubb have fought similar battles across the country, including disputes with dioceses in San Francisco, Camden, NJ, and other New York-based dioceses. <\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">The church-insurer rifts aren\u2019t unusual, particularly with the wave of abuse lawsuits. Some bankrupt dioceses have been forced <a href=\"https:\/\/news.bloomberglaw.com\/bankruptcy-law\/bankrupt-catholic-dioceses-victim-payout-deals-spurn-insurers\" rel=\"nofollow noopener\" target=\"_blank\">to strike deals<\/a> with insurers and claimants \u2014 but not always both, opening the door for victims to sue insurers directly. <\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">And the share that all insurers are paying to resolve sex abuse cases has been shrinking, according to the US Conference of Catholic Bishops.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Between 2004 and 2013, when the clergy sex abuse scandal exploded worldwide, insurers on average paid 22% of the costs related to claims, the conference said in a report. That share dropped to 10% from 2014 through 2023.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Nationally, Catholic dioceses and other religious communities paid out $5 billion between 2004 and 2023.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Lawyers for the New York archdiocese, led by Blank Rome LLP\u2019s Jim Murray, succeeded in getting Chubb\u2019s initial lawsuit <a data-terminal-id=\"S5VFVPDWRGG0\" href=\"https:\/\/news.bloomberglaw.com\/bankruptcy-law\/ny-archdiocese-beats-chubb-in-insurance-dispute-over-sex-abuse\" rel=\"nofollow noopener\" target=\"_blank\">dismissed in 2023.<\/a> The archdiocese argued that litigating insurance coverage while trying to resolve the underlying abuse claims would unfairly force them to simultaneously defend the church on \u201ctwo fronts.\u201d<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">But Chubb, whose lawyers have included John Baughman and the O\u2019Melveny &amp; Myers firm, <a data-terminal-id=\"SBC4GLDWX2PS\" href=\"https:\/\/news.bloomberglaw.com\/litigation\/chubb-holds-out-on-paying-new-york-archdiocese-in-abuse-suits\" rel=\"nofollow noopener\" target=\"_blank\">appealed<\/a> and the suit was <a data-terminal-id=\"SCEXCYT0AFB4\" href=\"https:\/\/news.bloomberglaw.com\/litigation\/archdiocese-fails-to-shed-insurance-suit-over-sex-abuse-claims\" rel=\"nofollow noopener\" target=\"_blank\">reinstated<\/a> in April 2024.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Soon after, a new website went live. Its name: The Church Accountability Project.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">The website was simple but stark. At the top were rotating newspaper headlines about the clergy abuse scandal. Below, with white and yellow text on a black background, was a bullet point-like list of accusations.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">\u201cUnder the leadership of Cardinal Timothy Dolan, the Archdiocese is deploying all of its VAST resources to deny its victims the compensation they rightfully deserve,\u201d <a href=\"https:\/\/web.archive.org\/web\/20240522103541\/https:\/\/www.churchaccountability.com\/\" rel=\"nofollow noopener\" target=\"_blank\">read one.<\/a><\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">The page also linked to a handful of news stories highlighting the scale of sex abuse by New York clergy, the archdiocese\u2019s expansive real estate holdings, and the cardinal\u2019s 15,000-square foot residence. In two spots, the webpage encouraged visitors to \u201chold the Archdiocese of New York accountable\u201d and register their email address to receive updates.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">The site also pointed to forms for reporting abuse to church or state authorities, as well as links to prominent organizations on the topic, such as the Survivors Network for those Abused by Priests, and <a href=\"http:\/\/bishopaccountabilty.org\" rel=\"nofollow noopener\" target=\"_blank\">BishopAccountability.org<\/a>, the similarly named independent watchdog that has catalogued thousands of claims and cases.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Within a year, ChurchAccountability.com expanded to add <a href=\"https:\/\/web.archive.org\/web\/20250407004959\/https:\/\/www.churchaccountability.com\/cardinal-dolans-true-legacy\" rel=\"nofollow noopener\" target=\"_blank\">another page<\/a> touting a \u201cDolan dossier\u201d specifically attacking the archbishop. Near the top was a doctored image of Dolan cackling with $100 bills swirling around him.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.europesays.com\/ch\/wp-content\/uploads\/2026\/03\/resize-image.webp\"  class=\"Image_image_1B2M2\"\/>Court Filings<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">\u201cIt\u2019s time for ADNY to drop the lawsuits and fairly compensate the hundreds of victims of sexual abuse and assault NOW,\u201d read a line toward the bottom.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Nowhere did the website explain who was behind it.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Late last year, Chubb\u2019s secret role as its creator began to unravel, after church lawyers asked the court to compel the insurer to turn over evidence of what they called its \u201cshadow\u201d campaign to undermine the archdiocese.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">In December, the Church Accountability Project website was suddenly rebranded with Chubb\u2019s corporate logo in large letters at the top, above the phrase \u201cInsurance stops where complicity begins.\u201d The site also introduced a table seeking to compare \u201cmyths\u201d about its role in the case against \u201cfacts\u201d about the archdiocese\u2019s complicity in the abuse scandal.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Archdiocesan lawyers <a data-terminal-id=\"T9QYF9KGCTFK\" href=\"https:\/\/news.bloomberglaw.com\/insurance\/chubb-ran-secret-campaign-against-ny-archdiocese-church-says\" rel=\"nofollow noopener\" target=\"_blank\">seized on the changes<\/a> as proof of the insurer\u2019s bad faith, and in January <a href=\"https:\/\/aboutblaw.com\/bk5B\" rel=\"nofollow noopener\" target=\"_blank\">asked<\/a> the presiding New York judge, Lori Sattler, for permission to amend their suit to claim fraud and seek punitive damages from their insurer.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">\u201cChubb has used the guise of defending as a smoke screen to delay, obstruct, and stonewall resolution of the Underlying Claims, while Chubb secretly undermines and seeks to weaken\u201d the archdiocese, they wrote.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">In <a href=\"https:\/\/aboutblaw.com\/bk5H\" rel=\"nofollow noopener\" target=\"_blank\">filings<\/a> since, Chubb hasn\u2019t disputed its role creating the website but says its public relations efforts were \u201conly in response to the ADNY\u2019s systematic, years-long undertaking to hide its complicity in sexual abuse and distort the public record.\u201d<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">The insurer said it wasn\u2019t the only one waging a behind-the-scenes public relations campaign.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Whiston\u2019s Feb. 19 affidavit was part of a <a href=\"https:\/\/aboutblaw.com\/bk5I\" rel=\"nofollow noopener\" target=\"_blank\">filing<\/a> intended to build the archdiocese\u2019s case that it had no ties to the Coalition for Just and Compassionate Compensation, the group whose <a data-terminal-id=\"S4MWL6T0G1KX\" href=\"https:\/\/news.bloomberglaw.com\/bankruptcy-law\/catholic-abuse-survivors-seek-probe-of-chubb-coverage-policies\" rel=\"nofollow noopener\" target=\"_blank\">self-proclaimed mission<\/a> is \u201cholding insurers and regulators accountable.\u201d<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">The former CFO\u2019s sworn statement described the group as a separate and independent entity. It did not, however, explain why he would have received briefings on the fundraising and communications plans of the purportedly independent party.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Chubb contends the CJCC is really an astroturf group \u2014 designed to appear like an independent, grassroots advocate \u2014 guided and funded by the archdiocese as part of a guerrilla war of public smears.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.europesays.com\/ch\/wp-content\/uploads\/2026\/03\/1772818514_901_resize-image.webp\"  class=\"Image_image_1B2M2\"\/>Photo Illustration: Jonathan Hurtarte\/Bloomberg Law<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">It\u2019s noted a phrase in the group\u2019s New York Times ad \u2014 that Chubb was \u201cwelching on its promises\u201d \u2014 echoed language that had been in the church\u2019s legal filings.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">It also pointed out that CJCC\u2019s leadership includes David Catalfamo, a longtime New York political operative with deep ties to John Cahill, the archdiocese\u2019s chancellor and Dolan\u2019s former chief of staff. Both worked together under former New York Gov. George Pataki; Catalfamo was also the spokesperson for Cahill\u2019s 2014 unsuccessful campaign for state attorney general.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Last week Chubb said in a <a href=\"https:\/\/aboutblaw.com\/bk5L\" rel=\"nofollow noopener\" target=\"_blank\">filing<\/a> that Cahill and Catalfamo together worked \u201chand-in-glove to use the CJCC\u201d to advance the archdiocese\u2019s interests, including fundraising for the effort.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">The group spent nearly $1 million in its first 15 months, with about $500,000 going to a public relations consultant, its tax records show.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">But as an exempt 501(c)(4) \u201csocial welfare\u201d organization, it isn\u2019t required to disclose its donors\u2019 identities. Catalfamo has said they include survivors, their lawyers, and others who \u201ccare about\u201d the archdiocese, but he hasn\u2019t released names or details.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">The archdiocese has declined comment on the allegations, but denied in legal filings that it\u2019s bankrolling or controlling the CJCC. Catalfamo told Bloomberg Law the organization had received no funding from the archdiocese.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">There\u2019s no support for \u201cany claim that CJCC is a Church directed or funded front organization\u201d acting on behalf of the archbishop, James Marsh, a plaintiffs\u2019 attorney who represents dozens of claimants against the church and a trustee of the CJCC, said in a signed affirmation.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Stephen Jimenez, another CJCC trustee and clergy abuse survivor, called Chubb\u2019s accusations \u201ca smack in the face.\u201d<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">The nonstop mudslinging and aggressive stances have surprised even seasoned court watchers.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Chubb\u2019s bid to rally public support for its hard-line position through the Church Accountability website seems unprecedented, according to Marci Hamilton, a University of Pennsylvania professor who focuses on child sex abuse issues.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">\u201cThere\u2019s been no insurer across the United States that has taken an \u2018I pay nothing\u2019 tactic and then tries to reinforce its intentional argument by putting the archdiocese in a bad light,\u201d said Hamilton, a longtime legal consultant on cases involving the church. \u201cIt\u2019s a pretty extreme tactic to combine those two elements.\u201d<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">Jeffrey Stempel, a professor at University of Nevada, Las Vegas, William S. Boyd School of Law, pointed out that insurers have an inherent good-faith duty to not throw their policyholders under the bus.<\/p>\n<p data-test=\"long-form-paragraph\" next=\"[object Object]\" class=\"Paragraph_paragraph_1B2M2\">In the past decade, the New York archdiocese sold off real estate assets, cut staff, and reduced its operating budget to free up funds, purportedly for the sake of resolving sex abuse claims.
