\"\"\/Mumbai: Swiss biotech giant Roche<\/a> has filed an appeal in the Supreme Court<\/a> against the decision of the Delhi High Court<\/a> allowing Hyderabad-based drug maker Natco Pharma<\/a> to launch the generic versions of its rare disease drug Risdiplam<\/a> branded as Evrysdi.<\/p>\n

Evrysdi is used in the treatment of Spinal Muscular Atrophy<\/a> (SMA), a rare condition that mostly affects infants and children. It progressively weakens the muscles and affects breathing and normal mobility. <\/p>\n

Last week the Delhi High Court<\/a> had ruled in favor of Natco Pharma<\/a> and held Roche<\/a>‘s patent on Risdiplam<\/a> as invalid. Natco had said the court had laid special emphasis on the public interest, considering the Swiss drug maker’s pricing had rendered the drug inaccessible and unaffordable to the bulk of the patients. <\/p>\n

Roche’s drug is priced at roughly Rs. 6 lakh per bottle, and annual treatment could be over Rs. 70 lakh, while Natco has said that it will launch the product soon at a cost of Rs. 15900 per bottle. <\/p>\n

In its statement following the decision, Roche had said, “We are extremely disappointed with this development and are considering our options within the scope of the Indian law. Roche is committed to protecting its innovation.”<\/p>\n

It added, “IP protection is a cornerstone for any pharmaceutical innovation. We believe that strong IP protection, including patents, is essential for innovation to thrive in India, drive access to innovative treatments that address the healthcare challenges we face today, and is a critical lever for Viksit Bharat.”<\/p>\n

On Tuesday, on NSE Natco<\/a> shares fell over three percent at Rs. 808 on the news that the Supreme Court<\/a> had admitted the case for hearing, expected later this week. <\/p>\n
