Photo: TVP<\/p>\n<p>The 59-year-old, of Grove Court, off Newtown Road, Newbury, had been trusted with legal power of attorney over Patricia Chubb\u2019s affairs because of his banking experience.<\/p>\n<p>But he was siphoning off the cash intended to pay for her dementia care in order to fund a lavish lifestyle for himself and his new bride, Reading Crown Court heard on Thursday, June 11.<\/p>\n<p>Chubb\u2019s deception came to light when a care agency sent a bill, only to be told by him: \u201cThere\u2019s no money.\u201d<\/p>\n<p>He admitted committing fraud between May 20, 2024, and January 1 this year.<\/p>\n<p>Sarita Basra, prosecuting, said the family suspected Chubb may also have been involved in fraud concerning the sale of a property but that there was no charge concerning that before the court.<\/p>\n<p>His siblings said in a victim impact statement: \u201cWe can\u2019t understand how someone could do this to their mother at her age, with her health issues.<\/p>\n<p>\u201cHow can we look after her financially while protecting her from what happened?<\/p>\n<p>\u201cWe can\u2019t believe the lack of remorse; he didn\u2019t seem to care\u2026 the lack of accountability was unreal.<\/p>\n<p>\u201cIt keeps us awake at night; none of us can rest; this was deliberate targeting of a mother suffering from dementia.\u201d<\/p>\n<p>Ms Basra said the family remained cynical about Chubb\u2019s belated expressions of apparent remorse.<\/p>\n<p>Alex McHugh, defending, said a trust fund had been discovered to which his client had no access, so that would help to pay for the victim\u2019s care.<\/p>\n<p>He said Chubb had repaid some of the stolen cash.<\/p>\n<p>Mr McHugh conceded that Chubb \u201cdidn\u2019t express himself in a way befitting his guilt when caught red-handed\u201d, but suggested he had since displayed \u201cgenuine remorse and realised the gravity of his actions\u201d.<\/p>\n<p>Chubb had initially tried to delay sentencing in a bid to secure a suspended sentence.<\/p>\n<p>Despite apparently failing to attend two probation appointments in custody, he launched a last minute bid to persuade the court to adjourn to give him another chance at co-operating with a pre-sentence report.<\/p>\n<p>Mr McHugh acknowledged that his client hoped that the subsequent report would recommend suspending any prison sentence.<\/p>\n<p>But the judge, Recorder John Ryder KC, ruled that the sentencing exercise should proceed.<\/p>\n<p>After hearing all the evidence he told Chubb: \u201cThe facts of this case are both distressing and sordid.<\/p>\n<p>\u201cYou violated the trust your mother and siblings placed in you by stealing from your mother as her faculties declined.<\/p>\n<p>\u201cYou spent the money on luxuries and self indulgence; on holidays, drink and drugs.<\/p>\n<p>\u201cDementia is a cruel condition and one that occasions particular distress and sorrow in the families of individuals affected.<\/p>\n<p>\u201cYour offending had a devastating effect\u2026 it wouldn\u2019t, in my judgement, be appropriate to suspend the sentence.\u201d<\/p>\n<p>Judge Ryder sentenced Chubb to two years and four months imprisonment.<\/p>\n<p>He will serve half of that in custody and the remainder on licence in the community.<\/p>\n<p>He did so by abusing his power of attorney, specifically, by acting against, or not safeguarding, the financial interests of Patricia Chubb in order to make a financial gain for himself.<\/p>\n","protected":false},"excerpt":{"rendered":"A former bank employee cheated his dementia-stricken mother out of \u00a343,000, squandering cash on drink, drugs and fast&hellip;\n","protected":false},"author":2,"featured_media":84334,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":"","_share_on_mastodon":"0"},"categories":[131],"tags":[240,9693,9694,2938],"class_list":["post-84333","post","type-post","status-publish","format-standard","has-post-thumbnail","category-chubb","tag-chubb","tag-courts","tag-newbury","tag-update-me"],"share_on_mastodon":{"url":"https:\/\/pubeurope.com\/@ch\/116752507623383092","error":""},"_links":{"self":[{"href":"https:\/\/www.europesays.com\/ch\/wp-json\/wp\/v2\/posts\/84333","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/ch\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/ch\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ch\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ch\/wp-json\/wp\/v2\/comments?post=84333"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/ch\/wp-json\/wp\/v2\/posts\/84333\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ch\/wp-json\/wp\/v2\/media\/84334"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/ch\/wp-json\/wp\/v2\/media?parent=84333"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/ch\/wp-json\/wp\/v2\/categories?post=84333"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/ch\/wp-json\/wp\/v2\/tags?post=84333"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
