Kv\u016fli tomu trp\u00ed t\u011b\u017ekou formou klaustrofobie a\u00a0\u00fazkostmi. Kdy\u017e p\u0159i\u0161el na ja\u0159e 2020\u00a0covid, zvl\u00e1dl rou\u0161ku a\u017e do zru\u0161en\u00ed opat\u0159en\u00ed v\u00a0l\u00e9t\u011b nosit, i\u00a0kdy\u017e se jeho zdravotn\u00ed stav v\u00fdrazn\u011b zhor\u0161il a\u00a0zhubl 20\u00a0kilo.<\/p>\n<p class=\"e_bK\">Jen\u017ee v\u00a0z\u00e1\u0159\u00ed se opat\u0159en\u00ed vr\u00e1tila. A. D. (cel\u00e9 jm\u00e9no kv\u016fli citlivosti p\u0159\u00edpadu nezve\u0159ej\u0148ujeme) ale v\u011bd\u011bl, \u017ee u\u017e rou\u0161ku ani cokoliv jin\u00e9ho na obli\u010deji nosit nezvl\u00e1dne. Jeho psychiatri\u010dka mu proto potvrdila v\u00fdjimku, kterou p\u0159ipou\u0161t\u011bla i\u00a0tehdej\u0161\u00ed <a data-dot=\"atm-link\" target=\"_blank\" rel=\"noopener nofollow\" href=\"https:\/\/mzd.gov.cz\/wp-content\/uploads\/2020\/09\/Mimoradne-opatreni-noseni-ochrannych-prostredku-dychacich-cest-s-vyjimkami-s-ucinnosti-od-10-9-2020-do-odvolani.pdf\" class=\"e_m\">opat\u0159en\u00ed<\/a> Ministerstva zdravotnictv\u00ed.<\/p>\n<p class=\"e_bK\">Jen\u017ee v\u00a0ku\u0159imsk\u00e9m z\u00e1vodu TE Connectivity Czech, kde tehdy pracoval, nepochodil. Firma mu na\u0159\u00eddila pracovat s\u00a0ochrann\u00fdm \u0161t\u00edtem, na\u010de\u017e se psychicky zhroutil a\u00a0nenastoupil do napl\u00e1novan\u00fdch sm\u011bn. Zam\u011bstnavatel mu na to konto s\u00a0okam\u017eitou platnost\u00ed zru\u0161il pracovn\u00ed pom\u011br, a\u010dkoliv tam \u010dty\u0159i roky pracoval bez jak\u00e9hokoliv d\u0159\u00edv\u011bj\u0161\u00edho probl\u00e9mu.<\/p>\n<p class=\"e_bK\">Okresn\u00ed soud Brno-venkov ale v\u00a0aktu\u00e1ln\u00edm rozsudku z\u00a0\u00fanora leto\u0161n\u00edho roku rozhodl, \u017ee \u0161lo o\u00a0diskriminaci.<\/p>\n<p class=\"e_bK\">\u201eNam\u00edsto toho, aby se \u017ealovan\u00e1 sna\u017eila p\u0159ijmout p\u0159im\u011b\u0159en\u00e1 opat\u0159en\u00ed k\u00a0tomu, aby \u017ealobce pracovat mohl, a\u00a0pokud by to nebylo mo\u017en\u00e9, aspo\u0148 rozhodnout o\u00a0p\u0159ek\u00e1\u017ek\u00e1ch v\u00a0pr\u00e1ci na stran\u011b zam\u011bstnavatele, \u017ealovan\u00e1 zvolila pro \u017ealobce s\u00a0ohledem k\u00a0jeho zdravotn\u00edmu stavu to nejhor\u0161\u00ed a\u00a0zkratkovit\u00e9 \u0159e\u0161en\u00ed, kdy\u017e dala \u017ealobci okam\u017eit\u00e9 zru\u0161en\u00ed pracovn\u00edho pom\u011bru z\u00a0d\u016fvodu neomluven\u00fdch absenc\u00ed,\u201c p\u00ed\u0161e se v\u00a0rozsudku, kter\u00fd maj\u00ed Seznam Zpr\u00e1vy k\u00a0dispozici.<\/p>\n<p><a data-dot=\"mol-article-card-media\" aria-hidden=\"true\" tabindex=\"-1\" href=\"https:\/\/www.seznamzpravy.cz\/clanek\/domaci-zivot-v-cesku-komora-shanela-inzeratem-pracovnici-dostala-pokutu-za-diskriminaci-muzu-266431\" class=\"e_m h_mi\" rel=\"nofollow noopener\" target=\"_blank\"><img fetchpriority=\"high\" height=\"2923\"   width=\"5197\" src=\"https:\/\/www.europesays.com\/cz\/wp-content\/uploads\/2026\/03\/oQ1Bc.jpeg\" loading=\"eager\" decoding=\"sync\" class=\"e_U e_S\"\/><\/a><\/p>\n<p class=\"e_bK\">Zat\u00edm jde o\u00a0nepravomocn\u00e9 rozhodnut\u00ed. Soud p\u0159iznal b\u00fdval\u00e9mu zam\u011bstnanci od\u0161kodn\u011bn\u00ed 400\u00a0tis\u00edc korun. P\u016fvodn\u011b \u017e\u00e1dal o\u00a0500\u00a0tis\u00edc, soud ale n\u00e1rok na nemajetkovou \u00fajmu o\u00a0100\u00a0tis\u00edc pon\u00ed\u017eil. Rovn\u011b\u017e A. D. cht\u011bl i\u00a0zve\u0159ejn\u011bn\u00ed omluvy, v\u00a0t\u00e9to \u010d\u00e1sti vzal ale \u017ealobu zp\u011bt. <\/p>\n<p class=\"e_bK\">A\u010dkoliv soud do\u0161el k\u00a0tomu, \u017ee jedn\u00e1n\u00ed zam\u011bstnavatele bylo diskrimina\u010dn\u00ed, jako \u00fapln\u00e9 zadostiu\u010din\u011bn\u00ed to A. D. nevn\u00edm\u00e1.<\/p>\n<p class=\"e_bK\">\u201eP\u016fvodn\u011b mi \u0161lo o\u00a0n\u00e1vrat do pr\u00e1ce, proto\u017ee jsem nic neporu\u0161il. Do pr\u00e1ce jsem se po pravomocn\u00e9m rozsudku vr\u00e1til, ale vytvo\u0159ili mi takov\u00e9 podm\u00ednky, abych byl nucen odej\u00edt s\u00e1m. J\u00e1 jsem s\u00e1m odej\u00edt necht\u011bl a\u00a0o pr\u00e1ci jsem nakonec stejn\u011b p\u0159i\u0161el pod z\u00e1minkou \u00fadajn\u00e9 nadbyte\u010dnosti,\u201c \u0159\u00edk\u00e1 A. D.<\/p>\n<p class=\"e_bK\">Spole\u010dnost TE Connectivity Czech se proti rozsudku odvolala. Seznam Zpr\u00e1vy se po jeho vynesen\u00ed firmy mimo jin\u00e9 ptaly, jestli uzn\u00e1v\u00e1, \u017ee se dopustila diskrimina\u010dn\u00edho a\u00a0nez\u00e1konn\u00e9ho jedn\u00e1n\u00ed.<\/p>\n<p class=\"e_bK\">\u201eNed\u00e1vn\u00e9 soudn\u00ed rozhodnut\u00ed jsme vzali na v\u011bdom\u00ed a\u00a0jeho p\u00edsemn\u00e9 od\u016fvodn\u011bn\u00ed v\u00a0sou\u010dasn\u00e9 dob\u011b pe\u010dliv\u011b posuzujeme. Jeliko\u017e tato z\u00e1le\u017eitost podl\u00e9h\u00e1 pr\u00e1vn\u00edm a\u00a0procesn\u00edm aspekt\u016fm, nen\u00ed v\u00a0tuto chv\u00edli vhodn\u00e9 vyjad\u0159ovat se ke konkr\u00e9tn\u00edm okolnostem p\u0159\u00edpadu,\u201c uvedl mluv\u010d\u00ed spole\u010dnosti TE Connectivity Czech.<\/p>\n<p>Zdravotn\u00ed posti\u017een\u00ed nelze ignorovat<\/p>\n<p class=\"e_bK\">V tomto sporu jde p\u0159itom u\u017e o\u00a0druh\u00fd rozsudek. Na konci roku 2023\u00a0Krajsk\u00fd soud v\u00a0Brn\u011b potvrdil, \u017ee u\u017e samotn\u00e9 okam\u017eit\u00e9 zru\u0161en\u00ed pracovn\u00edho pom\u011bru bylo neplatn\u00e9. Seznam Zpr\u00e1vy to popsaly v\u00a0\u010dl\u00e1nku n\u00ed\u017ee.<\/p>\n<p><a data-dot=\"mol-article-card-media\" aria-hidden=\"true\" tabindex=\"-1\" href=\"https:\/\/www.seznamzpravy.cz\/clanek\/koronavirus-kvuli-rousce-dostal-vyhazov-soud-potvrdil-ze-ji-kvuli-psychice-nosit-nesmel-242112\" class=\"e_m h_mi\" rel=\"nofollow noopener\" target=\"_blank\"><img height=\"2304\"   width=\"4096\" src=\"https:\/\/www.europesays.com\/cz\/wp-content\/uploads\/2026\/03\/covid-rouska-soud.jpeg\" loading=\"eager\" decoding=\"sync\" class=\"e_U e_S\"\/><\/a><\/p>\n<p class=\"e_bK\">Zam\u011bstnance se zastal ve sv\u00e9m stanovisku tak\u00e9 ombudsman.<\/p>\n<p class=\"e_bK\">\u201eZam\u011bstnavatel musel respektovat pr\u00e1vo st\u011b\u017eovatele pob\u00fdvat na pracovi\u0161ti bez zakryt\u00e9ho obli\u010deje a\u00a0sou\u010dasn\u011b chr\u00e1nit zdrav\u00ed ostatn\u00edch zam\u011bstnanc\u016f. Podle n\u00e1zoru ombudsmana m\u011bl mo\u017enost \u0159e\u0161it tuto situaci jin\u00fdm vhodn\u011bj\u0161\u00edm zp\u016fsobem (ne propu\u0161t\u011bn\u00edm st\u011b\u017eovatele z\u00a0pr\u00e1ce). Proto ombudsman jeho jedn\u00e1n\u00ed shledal diskrimina\u010dn\u00edm,\u201c uv\u00e1d\u00ed pro Seznam Zpr\u00e1vy Eva Ko\u010d\u00ed Svobodov\u00e1, pr\u00e1vni\u010dka odboru rovn\u00e9ho zach\u00e1zen\u00ed v\u00a0Kancel\u00e1\u0159i ombudsmana a\u00a0d\u011btsk\u00e9ho ombudsmana.<\/p>\n<p class=\"e_bK\">P\u0159\u00edpad A. D. je o\u00a0to z\u00e1va\u017en\u011bj\u0161\u00ed hned ze dvou d\u016fvod\u016f. Zaprv\u00e9 z\u00a0individu\u00e1ln\u00edho pohledu\u00a0\u2013 v\u00fdpov\u011b\u010f z\u00a0pr\u00e1ce m\u011bla vzhledem k\u00a0jeho du\u0161evn\u00edm obt\u00ed\u017e\u00edm z\u00e1va\u017en\u00e9 d\u016fsledky pro jeho dal\u0161\u00ed \u017eivot. Jeho psychick\u00fd stav se v\u00fdrazn\u011b zhor\u0161il a\u017e do t\u00e9 m\u00edry, \u017ee mu byl p\u0159izn\u00e1n \u010d\u00e1ste\u010dn\u00fd invalidn\u00ed d\u016fchod a\u00a0n\u011bkolik rok\u016f nebyl schopn\u00fd pr\u00e1ce. Do nov\u00e9ho zam\u011bstn\u00e1n\u00ed zvl\u00e1dl nastoupit a\u017e v\u00a0lednu tohoto roku.<\/p>\n<p class=\"e_bK\">\u201eLze konstatovat, \u017ee v\u0161echny tyto n\u00e1sledky vznikly v\u00a0p\u0159\u00ed\u010dinn\u00e9 souvislosti s\u00a0okam\u017eit\u00fdm zru\u0161en\u00edm pracovn\u00edho pom\u011bru \u017ealobce, kter\u00e9 bylo dle pravomocn\u00fdch rozsudk\u016f nez\u00e1konn\u00e9,\u201c konstatoval soud.<\/p>\n<p class=\"e_bK\">Zadruh\u00e9 je to ale d\u016fle\u017eit\u00e1 zpr\u00e1va pro pracovn\u00ed trh v\u00a0\u010cesku.<\/p>\n<p class=\"e_bK\">\u201eZam\u011bstnavatel\u00e9 maj\u00ed z\u00e1konnou povinnost p\u0159ij\u00edmat p\u0159im\u011b\u0159en\u00e1 opat\u0159en\u00ed ve prosp\u011bch lid\u00ed se zdravotn\u00edm posti\u017een\u00edm. Nemohou bez dal\u0161\u00edho uzav\u0159\u00edt, \u017ee zam\u011bstnanec je zdravotn\u011b nezp\u016fsobil\u00fd k\u00a0v\u00fdkonu pr\u00e1ce, ani\u017e by p\u0159edt\u00edm zv\u00e1\u017eili \u00fapravu pracovn\u00edch podm\u00ednek tak, aby mohl pr\u00e1ci vykon\u00e1vat,\u201c dod\u00e1v\u00e1 Ko\u010d\u00ed Svobodov\u00e1 z\u00a0Kancel\u00e1\u0159e ombudsmana a\u00a0d\u011btsk\u00e9ho ombudsmana.<\/p>\n<p class=\"e_bK\">Zam\u011bstnavatel\u00e9 mus\u00ed vych\u00e1zet z\u00a0konkr\u00e9tn\u00ed situace ka\u017ed\u00e9ho zam\u011bstnance a\u00a0hledat vhodn\u00e1 \u0159e\u0161en\u00ed. Pokud takov\u00fd postup ignoruj\u00ed a\u00a0rozhodnou o\u00a0nezp\u016fsobilosti zam\u011bstnance k\u00a0pr\u00e1ci, mohou se dopustit diskriminace. Aby se tomu vyhnuli, mohou vyu\u017e\u00edt praktick\u00e9 <a data-dot=\"atm-link\" target=\"_blank\" rel=\"noopener nofollow\" href=\"https:\/\/www.ochrance.cz\/dokument\/doporuceni_pro_zamestnavatele\/\" class=\"e_m\">doporu\u010den\u00ed<\/a>, kter\u00e9 k\u00a0diskriminaci na pracovi\u0161ti vydal ombudsman.<\/p>\n","protected":false},"excerpt":{"rendered":"V d\u011btstv\u00ed ho otec krut\u011b mu\u010dil.
