Obh\u00e1jci tohoto p\u0159\u00edstupu se odkazuj\u00ed na rozhodnut\u00ed soud\u016f, v\u010detn\u011b \u00dastavn\u00edho soudu. Faktem je, \u017ee dan\u00e1 stanoviska soud\u016f tento n\u00e1zor opravdu podporuj\u00ed. Nicm\u00e9n\u011b nejde o\u00a0jednoduch\u00fd probl\u00e9m, nav\u00edc jeho \u0159e\u0161en\u00ed, a\u0165 u\u017e jak\u00e9koli, m\u00e1 velk\u00e9 dopady na cel\u00fd sektor n\u00e1jemn\u00edho bydlen\u00ed. Poj\u010fme tedy postupn\u011b.<\/p>\n<p class=\"e_bV\">Paradoxn\u011b za\u010dn\u011bme od konce, tedy od rozhodnut\u00ed \u00dastavn\u00edho soudu z\u00a0roku 2022\u00a0(Usnesen\u00ed sp. zn. \u00daS 2257\/22\u00a0ze dne 6.\u00a09.\u00a02022). Pro p\u0159esnost je pot\u0159eba \u0159\u00edci, \u017ee \u00daS meritorn\u011b nijak nerozhodl, ale odm\u00edtl se danou z\u00e1le\u017eitost\u00ed zab\u00fdvat, nebo\u0165 ji shledal neopodstatn\u011bnou. P\u0159edm\u011btem sporu byla toti\u017e velmi n\u00edzk\u00e1 \u010d\u00e1stka, z\u00a0pohledu \u00faro\u010den\u00ed kauce se jednalo o\u00a0jednotky tis\u00edc korun. S\u00a0odvol\u00e1n\u00edm na ust\u00e1lenou judikaturu \u00daS soudci konstatovali, \u017ee jde o\u00a0\u010d\u00e1stku bagateln\u00ed a\u00a0\u00daS tud\u00ed\u017e nep\u0159\u00edslu\u0161nou. <\/p>\n<p class=\"e_bV\">V\u00a0rozhodnut\u00ed \u00daS nicm\u00e9n\u011b p\u0159ipustil, \u017ee \u201eopodstatn\u011bnost \u00fastavn\u00ed st\u00ed\u017enosti v\u00a0takov\u00e9 v\u011bci p\u0159ich\u00e1z\u00ed v\u00a0\u00favahu jen v\u00a0p\u0159\u00edpadech zcela extr\u00e9mn\u00edho vybo\u010den\u00ed ze standard\u016f, je\u017e jsou pro postupy zji\u0161\u0165ov\u00e1n\u00ed skutkov\u00e9ho z\u00e1kladu sporu a\u00a0pro jeho pr\u00e1vn\u00ed posouzen\u00ed esenci\u00e1ln\u00ed\u201c. Domn\u00edv\u00e1me se, \u017ee rozhodnut\u00ed v\u00a0t\u00e9to v\u011bci p\u0159edstavuje pr\u00e1v\u011b takov\u00e9 extr\u00e9mn\u00ed vybo\u010den\u00ed. Rozhodnut\u00ed m\u00e1 z\u00e1rove\u0148 v\u00fdznamn\u00fd dopad na cel\u00fd sektor n\u00e1jemn\u00edho bydlen\u00ed a\u00a0dle na\u0161eho n\u00e1zoru ho m\u016f\u017ee v\u00fdznamn\u011b po\u0161kodit.<\/p>\n<p class=\"e_bV\">Nyn\u00ed k\u00a0d\u016fvod\u016fm, pro\u010d oba stupn\u011b soudn\u00ed soustavy vybo\u010dili ze standard\u016f, je\u017e jsou pro pr\u00e1vn\u00ed posouzen\u00ed esenci\u00e1ln\u00ed. \u00daS konstatuje, \u017ee \u201ez napaden\u00fdch rozhodnut\u00ed je z\u0159ejm\u00e9, \u017ee obecn\u00e9 soudy postupovaly v\u00a0souladu se z\u00e1konem a\u00a0\u0159\u00e1dn\u011b od\u016fvodnily\u201c, pro\u010d zvolily danou \u00farokovou sazbu. Jak uvid\u00edme d\u00e1le, \u201e\u0159\u00e1dn\u00e9 zd\u016fvodn\u011bn\u00ed\u201c byl pohled na webov\u00e9 str\u00e1nky \u010cNB a\u00a0konstatov\u00e1n\u00ed, \u017ee si pronaj\u00edmatel m\u016f\u017ee s\u00a0kauc\u00ed d\u011blat, co uzn\u00e1 za vhodn\u00e9, a\u00a0proto je \u00farokov\u00e1 sazba \u201eu bez\u00fa\u010delov\u00fdch, spot\u0159ebitelsk\u00fdch \u00fav\u011br\u016f s\u00a0del\u0161\u00ed dobou splatnosti\u201c adekv\u00e1tn\u00ed. \u00daS se tak\u00e9 odvol\u00e1v\u00e1 na to, \u017ee \u201edot\u010den\u00e1 ot\u00e1zka je odbornou literaturou pova\u017eov\u00e1na za problematickou\u201c, tak\u017ee je v\u00a0po\u0159\u00e1dku, \u017ee se \u201eobecn\u00e9 soudy p\u0159iklonily k\u00a0jednomu z\u00a0mo\u017en\u00fdch z\u00e1v\u011br\u016f\u201c. <\/p>\n<p class=\"e_bV\">V\u00a0rozsudc\u00edch jsme nikde nena\u0161li zm\u00ednku o\u00a0tom, \u017ee by se soudy dot\u00e1zaly na n\u00e1zor n\u011bkoho z\u00a0ekonomick\u00e9 obce \u010di z\u00a0bankovnictv\u00ed. Pokud by tak u\u010dinily, st\u011b\u017e\u00ed by mohly rozsudky vypadat tak, jak vypadaj\u00ed. A\u00a0co se t\u00fd\u010de odkazu na odbornou literaturu, tak ta se zab\u00fdv\u00e1 sp\u00ed\u0161e problematikou \u201ez\u00e1konn\u00e9 sazby\u201c obecn\u011b, nikoli ve specifick\u00e9m p\u0159\u00edpadu kauc\u00ed.<\/p>\n<p><a data-dot=\"mol-article-card-media\" aria-hidden=\"true\" tabindex=\"-1\" href=\"https:\/\/www.seznamzpravy.cz\/clanek\/audio-podcast-ve-vate-znicili-byt-zmizeli-bez-placeni-a-klic-hodili-do-schranky-lici-investorka-301898\" class=\"e_n f_lY\" rel=\"nofollow noopener\" target=\"_blank\"><img fetchpriority=\"high\" height=\"1017\"   width=\"1808\" src=\"https:\/\/www.europesays.com\/cz\/wp-content\/uploads\/2026\/03\/byty-byt-bydleni.jpeg\" loading=\"eager\" decoding=\"sync\" class=\"e_aa e_Z\"\/><\/a><\/p>\n<p class=\"e_bV\">Poj\u010fme se tedy pod\u00edvat na to, jak vypadalo zmi\u0148ovan\u00e9 \u201e\u0159\u00e1dn\u00e9 zd\u016fvodn\u011bn\u00ed\u201c na \u00farovni Okresn\u00edho soudu (rozhodnut\u00ed sp. zn. 12\u00a0C 307\/2019-141) a\u00a0Krajsk\u00e9ho soudu (rozhodnut\u00ed sp. zn. 26\u00a0Co 50\/2022-173). Okresn\u00ed soud zcela spr\u00e1vn\u011b odkazuje na ust. \u00a7 2254\u00a0odst. 2\u00a0OZ, kde se jasn\u011b konstatuje, \u017ee \u201en\u00e1jemce m\u00e1 pr\u00e1vo na \u00faroky z\u00a0jistoty od jej\u00edho poskytnut\u00ed alespo\u0148 ve v\u00fd\u0161i z\u00e1konn\u00e9 sazby\u201c. Okresn\u00ed soud se proto \u0159\u00eddil ust. \u00a7 1802\u00a0OZ, kde je z\u00e1konn\u00e1 sazba upravena. Tam se konstatuje, \u017ee \u201emaj\u00ed-li b\u00fdt pln\u011bny \u00faroky a\u00a0nen\u00ed-li jejich v\u00fd\u0161e ujedn\u00e1na, plat\u00ed dlu\u017en\u00edk \u00faroky ve v\u00fd\u0161i stanoven\u00e9 pr\u00e1vn\u00edm p\u0159edpisem. Nejsou-li \u00faroky takto stanoveny, plat\u00ed dlu\u017en\u00edk obvykl\u00e9 \u00faroky po\u017eadovan\u00e9 za \u00fav\u011bry, kter\u00e9 poskytuj\u00ed banky v\u00a0m\u00edst\u011b bydli\u0161t\u011b nebo s\u00eddla dlu\u017en\u00edka v\u00a0dob\u011b uzav\u0159en\u00ed smlouvy\u201c.<\/p>\n<p class=\"e_bV\">Z hlediska litery z\u00e1kona to d\u00e1v\u00e1 smysl, z\u00a0hlediska meritu v\u011bci nikoli. Ne\u017e se pust\u00edme do vysv\u011btlen\u00ed podstaty probl\u00e9mu \u00faro\u010den\u00ed, uve\u010fme zde je\u0161t\u011b \u201evylep\u0161en\u00ed\u201c argumentace ze strany Krajsk\u00e9ho soudu, kam se \u017ealovan\u00fd odvolal. KS konstatuje, \u017ee \u201evzhledem k\u00a0nijak omezen\u00e9 mo\u017enosti \u017ealovan\u00e9ho jako pronaj\u00edmatele nakl\u00e1dat s\u00a0touto \u010d\u00e1stkou po dobu trv\u00e1n\u00ed n\u00e1jemn\u00edho vztahu, je t\u0159eba vztahovat tento \u00fasudek k\u00a0\u00fav\u011br\u016fm bez\u00fa\u010delov\u00fdm, spot\u0159ebitelsk\u00fdm a\u00a0s del\u0161\u00ed dobou splatnosti \u2026\u201c.<\/p>\n<p class=\"e_bV\">Za\u010dn\u011bme se z\u00e1kladn\u00edm pravidlem pro chov\u00e1n\u00ed na finan\u010dn\u00edch trz\u00edch: dnes se d\u011bti u\u017e na z\u00e1kladn\u00ed \u0161kole p\u0159i v\u00fduce finan\u010dn\u00ed gramotnosti u\u010d\u00ed, \u017ee v\u00fd\u0161e v\u00fdnosu je p\u0159\u00edmo \u00fam\u011brn\u00e1 riziku: po\u017eaduji-li jako investor vy\u0161\u0161\u00ed v\u00fdnos, mus\u00edm po\u010d\u00edtat s\u00a0vy\u0161\u0161\u00edm rizikem. Pokud nech\u00e1me stranou rizikov\u00e9 spekulace na finan\u010dn\u00edch trz\u00edch, tak v\u00a0segmentu bankovnictv\u00ed pat\u0159\u00ed spot\u0159ebitelsk\u00fd \u00fav\u011br do t\u00e9 nejrizikov\u011bj\u0161\u00ed kategorie a\u00a0tomu tak\u00e9 odpov\u00edd\u00e1 v\u00fd\u0161e v\u00fdnosu. Na posouzen\u00ed rizik p\u0159i \u00fav\u011brov\u00e1n\u00ed p\u0159itom banky maj\u00ed rozs\u00e1hl\u00fd a\u00a0kompetentn\u00ed apar\u00e1t, na jeho\u017e fungov\u00e1n\u00ed a\u00a0spr\u00e1vn\u00e9 \u0159\u00edzen\u00ed rizik dohl\u00ed\u017e\u00ed tak\u00e9 \u010cesk\u00e1 n\u00e1rodn\u00ed banka. O\u010dek\u00e1vat od pronaj\u00edmatele bytu, \u017ee bude schopen posoudit riziko p\u0159i snaze dos\u00e1hnout \u00farokov\u00e9 sazby na spot\u0159ebitelsk\u00e9m \u00fav\u011bru, je prost\u011b nesmysl. Pokud tedy soudy o\u010dek\u00e1vaj\u00ed, \u017ee pronaj\u00edmatel\u00e9 ve snaze \u201evyd\u011blat\u201c na splacen\u00ed \u00faroku z\u00a0kauce budou o\u00a0n\u011bco takov\u00e9ho usilovat, tla\u010d\u00ed je do nep\u0159im\u011b\u0159en\u011b vysok\u00e9ho rizika.<\/p>\n<p class=\"e_bV\">D\u00e1le je pot\u0159eba si uv\u011bdomit, \u017ee\u00a0\u2013 na rozd\u00edl od argumentace Krajsk\u00e9ho soudu\u00a0\u2013 pronaj\u00edmatel m\u00e1 pouze zd\u00e1nliv\u011b neomezen\u00e9 mo\u017enosti nakl\u00e1dat s\u00a0kauc\u00ed: danou kauci mus\u00ed toti\u017e v\u00a0budoucnu vr\u00e1tit a\u00a0logicky by tud\u00ed\u017e m\u011bl usilovat o\u00a0bezrizikovou investici, aby minimalizoval mo\u017enost finan\u010dn\u00ed ztr\u00e1ty.<\/p>\n<p><a data-dot=\"mol-article-card-media\" aria-hidden=\"true\" tabindex=\"-1\" href=\"https:\/\/www.seznamzpravy.cz\/clanek\/audio-podcast-ve-vate-oznamit-vyssi-najem-je-neprijemne-ale-hypoteky-tlaci-rika-majitel-150-bytu-302043\" class=\"e_n f_lY\" rel=\"nofollow noopener\" target=\"_blank\"><img fetchpriority=\"high\" height=\"1017\"   width=\"1808\" src=\"https:\/\/www.europesays.com\/cz\/wp-content\/uploads\/2026\/03\/byty-byt-bydleni.jpeg\" loading=\"eager\" decoding=\"sync\" class=\"e_aa e_Z\"\/><\/a><\/p>\n<p class=\"e_bV\">Z pr\u00e1vn\u00edho hlediska chybnost aplikace \u00farokov\u00e9 sazby typick\u00e9 pro spot\u0159ebitelsk\u00e9 \u00fav\u011bry vypl\u00fdv\u00e1 i\u00a0z v\u00fdkladu \u00a7 2254\u00a0OZ, nebo\u0165 pr\u00e1vn\u00ed normu je pot\u0159eba vykl\u00e1dat dle jej\u00edho smyslu a\u00a0\u00fa\u010delu. M\u00e1me za to, \u017ee smyslem je kompenzovat v\u00fdnos, kter\u00e9ho by n\u00e1jemce mohl na \u010d\u00e1stce ekvivalentn\u00ed kauci s\u00a0minim\u00e1ln\u00edm rizikem dos\u00e1hnout. K\u00a0ur\u010den\u00ed smyslu t\u00e9to pr\u00e1vn\u00ed normy ve vztahu ke kauc\u00edm je tedy p\u0159edev\u0161\u00edm ekonomick\u00fd aspekt.<\/p>\n<p class=\"e_bV\">A z\u00a0ekonomick\u00e9ho hlediska m\u00e1 kauce bl\u00ed\u017ee k\u00a0vkladu, nikoli k\u00a0\u00fav\u011bru, p\u0159\u00edpadn\u011b by se hodilo srovn\u00e1n\u00ed s\u00a0not\u00e1\u0159skou \u010di advok\u00e1tn\u00ed \u00faschovou a\u00a0tam uplat\u0148ovanou sazbou. Z\u00a0tohoto pohledu je zn\u011bn\u00ed \u00a7 1802\u00a0OZ dosti ne\u0161\u0165astn\u00e9. P\u0159i dan\u00e9m zn\u011bn\u00ed Ob\u010dansk\u00e9ho z\u00e1kon\u00edku bychom se alespo\u0148 m\u011bli sna\u017eit o\u00a0stanoven\u00ed \u00faroku tak, \u017ee bude odpov\u00eddat co nejni\u017e\u0161\u00edmu riziku. Tomu nejl\u00e9pe odpov\u00eddaj\u00ed \u00farokov\u00e9 sazby u\u00a0hypote\u010dn\u00edch \u00fav\u011br\u016f, kter\u00e9 maj\u00ed nav\u00edc tu v\u00fdhodu, \u017ee\u00a0\u2013 podobn\u011b jako kauce u\u00a0n\u00e1jmu\u00a0\u2013 souvis\u00ed s\u00a0bydlen\u00edm, a\u00a0tud\u00ed\u017e i\u00a0z t\u00e9to perspektivy hypote\u010dn\u00ed \u00fav\u011br d\u00e1v\u00e1 smysl. \u00darokov\u00e9 sazby u\u00a0hypot\u00e9k se li\u0161\u00ed samoz\u0159ejm\u011b i\u00a0podle d\u00e9lky fixace; jako vhodn\u00e9 se nab\u00edzej\u00ed hypot\u00e9ka s\u00a0plovouc\u00ed sazbou nebo t\u0159\u00edlet\u00e1 fixace, ale to u\u017e je detail, kter\u00fd m\u016f\u017ee b\u00fdt p\u0159edm\u011btem odborn\u00e9 diskuze. Sice i\u00a0tyto \u00farovn\u011b \u00farokov\u00e9 sazby mohou b\u00fdt pro n\u011bkter\u00e9 pronaj\u00edmatele obt\u00ed\u017en\u011b dosa\u017eiteln\u00e9, ale p\u0159i dan\u00e9m zn\u011bn\u00ed OZ to je z\u0159ejm\u011b nejlep\u0161\u00ed v\u00fdchodisko.<\/p>\n<p class=\"e_bV\">Z pohledu n\u00e1jemn\u00edho trhu bychom tak\u00e9 m\u011bli vz\u00edt v\u00a0potaz, \u017ee tu m\u00e1me n\u011bkolik segment\u016f pronaj\u00edmatel\u016f, pro jednoduchost a\u00a0pot\u0159eby tohoto textu je rozli\u0161me na jednotlivce, st\u0159edn\u011b velk\u00e9 pronaj\u00edmatele a\u00a0velk\u00e9 \u201ehr\u00e1\u010de\u201c. Ka\u017ed\u00e1 skupina m\u00e1 jin\u00e9 mo\u017enosti dos\u00e1hnout ur\u010dit\u00e9ho v\u00fdnosu, pokud mo\u017eno v\u00fdnosu s\u00a0co nejni\u017e\u0161\u00edm rizikem. Na \u00fav\u011br a\u0165 rovnou zapomenou, toto riziko si nem\u016f\u017ee dovolit \u017e\u00e1dn\u00fd z\u00a0nich, \u017e\u00e1dn\u00fd si rozhodn\u011b nebude budovat apar\u00e1t na \u0159\u00edzen\u00ed rizika p\u0159i investov\u00e1n\u00ed \u010di poskytov\u00e1n\u00ed \u00fav\u011br\u016f. To opravdu mus\u00ed p\u0159enechat bank\u00e1m a\u00a0specializovan\u00fdm spole\u010dnostem.<\/p>\n<p><a data-dot=\"mol-article-card-media\" aria-hidden=\"true\" tabindex=\"-1\" href=\"https:\/\/www.seznamzpravy.cz\/clanek\/radce-z-kauce-na-byt-musi-majitel-najemci-vyplatit-uroky-jsou-to-az-desetitisice-298183\" class=\"e_n f_lY\" rel=\"nofollow noopener\" target=\"_blank\"><img height=\"562\"   width=\"1000\" src=\"https:\/\/www.europesays.com\/cz\/wp-content\/uploads\/2026\/03\/byt-kauce-pronajem.jpeg\" loading=\"eager\" decoding=\"sync\" class=\"e_aa e_Z\"\/><\/a><\/p>\n<p class=\"e_bV\">V p\u0159\u00edpad\u011b jednotlivc\u016f, kte\u0159\u00ed pronaj\u00edmaj\u00ed jeden \u010di n\u011bkolik m\u00e1lo byt\u016f, p\u0159ipad\u00e1 v\u00a0\u00favahu jako vhodn\u00fd finan\u010dn\u00ed produkt pouze spo\u0159ic\u00ed \u00fa\u010det nebo term\u00ednovan\u00fd vklad. U\u00a0spr\u00e1vc\u016f velk\u00fdch portfoli\u00ed n\u00e1jemn\u00edch byt\u016f si lze p\u0159edstavit, \u017ee budou investovat do vl\u00e1dn\u00edch dluhopis\u016f, ale p\u0159edpokl\u00e1d\u00e1 to, \u017ee budou m\u00edt schopn\u00e9ho finan\u010dn\u00edho \u0159editele, kter\u00fd m\u00e1 zku\u0161enost s\u00a0investov\u00e1n\u00edm a\u00a0zejm\u00e9na bude schopen \u0159\u00eddit likviditu spole\u010dnosti. Obt\u00ed\u017en\u00e1 situace je pro st\u0159edn\u011b velk\u00e9 pronaj\u00edmatele, proto\u017ee jim banka \u017e\u00e1dn\u00fd spo\u0159ic\u00ed \u00fa\u010det nenab\u00eddne a\u00a0z\u00e1rove\u0148 nemaj\u00ed dostate\u010dnou kapacitu na operace s\u00a0dluhopisy. Domn\u00edv\u00e1me se proto, \u017ee dost dob\u0159e nejde \u00farokovou sazbu u\u00a0kauc\u00ed pau\u0161alizovat, bude se li\u0161it podle mo\u017enost\u00ed jednotliv\u00fdch pronaj\u00edmatel\u016f.<\/p>\n<p class=\"e_bV\">Ob\u010dansk\u00fd z\u00e1kon\u00edk je ve v\u011bci \u00faro\u010den\u00ed kauc\u00ed opravdu nejednozna\u010dn\u00fd a\u00a0v sou\u010dasn\u00e9 situaci, kdy existuj\u00ed rozsudky obecn\u00fdch soud\u016f posv\u011bcen\u00e9 \u00dastavn\u00edm soudem, jsou pronaj\u00edmatel\u00e9 ve slo\u017eit\u00e9 situace. P\u0159irozenou cestou, jak situaci vy\u0159e\u0161it, by byla \u00faprava Ob\u010dansk\u00e9ho z\u00e1kon\u00edku a\u00a0p\u0159esn\u011bj\u0161\u00ed specifikace term\u00ednu \u201ez\u00e1konn\u00e1 sazba\u201c \u010di p\u0159\u00edmo \u00faprava \u00faro\u010den\u00ed kauc\u00ed. Dal\u0161\u00ed mo\u017enost\u00ed je, \u017ee se obdobn\u00fd spor dostane znovu k\u00a0soudu a\u00a0soudce se nebude d\u00edvat jen na literu z\u00e1kona, ale bude tak\u00e9 p\u0159em\u00fd\u0161let o\u00a0podstat\u011b v\u011bci. A\u00a0nejrealisti\u010dt\u011bj\u0161\u00ed pochopiteln\u011b je, \u017ee si pronaj\u00edmatel\u00e9 p\u0159i uzav\u00edr\u00e1n\u00ed nov\u00fdch smluv daj\u00ed pozor a\u00a0\u00farokovou sazbu ve smlouv\u011b explicitn\u011b uprav\u00ed a\u00a0navrhnou ji ve v\u00fd\u0161i, kter\u00e1 je pro n\u011b dosa\u017eiteln\u00e1 bez nep\u0159im\u011b\u0159en\u00e9ho rizika.
