Jde o\u00a0reakci na kritiku p\u016fvodn\u00ed verze i\u00a0snahu upravit syst\u00e9m, kter\u00fd podle investor\u016f, obc\u00ed i\u00a0st\u00e1tu nefunguje a\u00a0v d\u016fsledku zpomaluje, jak v\u00a0\u010cesku p\u0159ib\u00fdvaj\u00ed mo\u017enosti bydlen\u00ed.<\/p>\n<p>Jedno \u0159\u00edzen\u00ed m\u00edsto s\u00e9rie krok\u016f<\/p>\n<p class=\"e_bW\">Z\u00e1sadn\u00ed zm\u011bna se t\u00fdk\u00e1 samotn\u00e9ho pr\u016fb\u011bhu povolov\u00e1n\u00ed. Dnes se v\u011bt\u0161ina projekt\u016f skl\u00e1d\u00e1 z\u00a0n\u011bkolika \u0159\u00edzen\u00ed, kter\u00e1 b\u011b\u017e\u00ed soub\u011b\u017en\u011b nebo na sebe navazuj\u00ed a\u00a0stavebn\u00edk mus\u00ed postupn\u011b z\u00edskat stanoviska od r\u016fzn\u00fdch \u00fa\u0159ad\u016f a\u00a0instituc\u00ed, kter\u00e9 mezi sebou ale nejsou koordinovan\u00e9.<\/p>\n<p class=\"e_bW\">Novela se sna\u017e\u00ed tento model zjednodu\u0161it a\u00a0slou\u010dit do jednoho procesu.<\/p>\n<p class=\"e_bW\">\u201eN\u00e1vrh posiluje rozvojov\u00e9 pojet\u00ed stavebn\u00edho pr\u00e1va, p\u0159esouv\u00e1 ochranu ve\u0159ejn\u00fdch z\u00e1jm\u016f v\u00edce p\u0159\u00edmo do \u00fazemn\u00edho pl\u00e1nov\u00e1n\u00ed a\u00a0do integrovan\u00e9ho rozhodov\u00e1n\u00ed stavebn\u00edho \u00fa\u0159adu, omezuje duplicity,\u201c popisuje vl\u00e1dn\u00ed zmocn\u011bnkyn\u011b Hana Landov\u00e1.<\/p>\n<p class=\"e_bW\">Z pohledu b\u011b\u017en\u00e9ho projektu to znamen\u00e1 v\u00fdraznou zm\u011bnu. Nap\u0159\u00edklad u\u00a0stavby rodinn\u00e9ho domu v\u00a0komplikovan\u011bj\u0161\u00ed lokalit\u011b dnes investor \u0159e\u0161\u00ed zvl\u00e1\u0161\u0165 pam\u00e1tkovou ochranu, vodn\u00ed re\u017eim, k\u00e1cen\u00ed strom\u016f nebo dopravn\u00ed napojen\u00ed. Ka\u017ed\u00e9 z\u00a0t\u011bchto stanovisek m\u00e1 vlastn\u00ed proces, vlastn\u00ed lh\u016fty i\u00a0raz\u00edtka a\u00a0m\u016f\u017ee cel\u00fd projekt z\u00e1sadn\u011b zdr\u017eet.<\/p>\n<p class=\"e_bW\">Nov\u011b by m\u011bl v\u011bt\u0161inu t\u011bchto po\u017eadavk\u016f \u0159e\u0161it jedin\u00fd stavebn\u00ed \u00fa\u0159ad v\u00a0r\u00e1mci jednoho \u0159\u00edzen\u00ed. \u201eNov\u011b to bude jeden proces p\u0159ed stavebn\u00edm \u00fa\u0159adem, kter\u00fd v\u00a0tomto \u0159\u00edzen\u00ed vy\u0159e\u0161\u00ed tak\u00e9 nap\u0159\u00edklad po\u017eadavek na k\u00e1cen\u00ed strom\u016f,\u201c uv\u00e1d\u00ed Landov\u00e1.<\/p>\n<p class=\"e_bW\">Pr\u00e1v\u011b odstran\u011bn\u00ed duplicit je podle ministerstva jedn\u00edm z\u00a0hlavn\u00edch n\u00e1stroj\u016f, jak cel\u00fd syst\u00e9m zrychlit.<\/p>\n<p><a data-dot=\"mol-article-card-media\" aria-hidden=\"true\" tabindex=\"-1\" href=\"https:\/\/www.seznamzpravy.cz\/clanek\/ekonomika-b2b-budeme-akcni-slibuje-ministerstvo-i-tak-zaberou-zmeny-u-staveb-roky-279531\" class=\"e_n f_l0\" rel=\"nofollow noopener\" target=\"_blank\"><img fetchpriority=\"high\" height=\"2304\"   width=\"4096\" src=\"https:\/\/www.europesays.com\/cz\/wp-content\/uploads\/2026\/03\/byt-byty.jpeg\" loading=\"eager\" decoding=\"sync\" class=\"e_aa e_Z\"\/><\/a>M\u00edsto z\u00e1kazu d\u016fvod a\u00a0pl\u00e1n<\/p>\n<p class=\"e_bW\">Novela se sna\u017e\u00ed p\u0159\u00edstup zm\u011bnit nejen organiza\u010dn\u011b, ale i\u00a0obsahov\u011b. \u201eDot\u010den\u00e9 org\u00e1ny maj\u00ed jednat jen v\u00a0mez\u00edch sv\u00e9 p\u016fsobnosti a\u00a0co nejd\u0159\u00edve, maj\u00ed tak\u00e9 usilovat o\u00a0\u0159e\u0161en\u00ed nam\u00edsto zakazov\u00e1n\u00ed,\u201c \u0159\u00edk\u00e1 Hana Landov\u00e1.<\/p>\n<p class=\"e_bW\">V praxi to znamen\u00e1 posun od situace, kdy \u00fa\u0159ad vyd\u00e1 nesouhlas, a\u00a0t\u00edm proces de facto zastav\u00ed, k\u00a0modelu, kdy mus\u00ed aktivn\u011b hledat, za jak\u00fdch podm\u00ednek by projekt mohl proj\u00edt. Typicky nap\u0159\u00edklad s\u00e1m navrhne \u00fapravu projektu, technick\u00e9 \u0159e\u0161en\u00ed nebo kompenza\u010dn\u00ed opat\u0159en\u00ed, kter\u00e9 by vyhovovalo p\u0159edpis\u016fm.<\/p>\n<p class=\"e_bW\">Tento princip se prom\u00edt\u00e1 i\u00a0do samotn\u00e9ho rozhodov\u00e1n\u00ed. Nov\u011b m\u00e1 platit, \u017ee pokud je pozemek ur\u010den\u00fd k\u00a0v\u00fdstavb\u011b, nem\u011bla by b\u00fdt stavba automaticky blokov\u00e1na jednotliv\u00fdmi stanovisky. Zam\u00edtnut\u00ed bude mo\u017en\u00e9 jen v\u00a0p\u0159\u00edpad\u011b, \u017ee projekt nelze realizovat ani po \u00faprav\u00e1ch nebo za stanoven\u00fdch podm\u00ednek.<\/p>\n<p>Stabiln\u011bj\u0161\u00ed pravidla pro developery<\/p>\n<p class=\"e_bW\">V\u00fdznamnou zm\u011bnou je i\u00a0to, jak se bude projekt posuzovat v\u00a0\u010dase. Dnes se \u010dasto st\u00e1v\u00e1, \u017ee se b\u011bhem \u0159\u00edzen\u00ed m\u011bn\u00ed podm\u00ednky nebo po\u017eadavky a\u00a0investor mus\u00ed projekt opakovan\u011b upravovat a\u00a0znovu p\u0159edkl\u00e1dat, v\u017edy podle nov\u011b zaveden\u00fdch na\u0159\u00edzen\u00ed. To cel\u00fd proces prodlu\u017euje a\u00a0zvy\u0161uje nejistotu, jak v\u0161e ve v\u00fdsledku dopadne.<\/p>\n<p class=\"e_bW\">Novela zav\u00e1d\u00ed princip, \u017ee projekt se posuzuje ke dni pod\u00e1n\u00ed \u017e\u00e1dosti. \u201eZ\u00e1m\u011bry budou posuzovat ke dni pod\u00e1n\u00ed \u017e\u00e1dosti. V\u00a0sou\u010dasn\u00e9 praxi je nezbytn\u00e9 opakovan\u011b upravovat projekty a\u00a0znovu je posuzovat,\u201c vysv\u011btluje vl\u00e1dn\u00ed zmocn\u011bnkyn\u011b Hana Landov\u00e1. Jednodu\u0161e \u0159e\u010deno, projekt mus\u00ed spl\u0148ovat pravidla platn\u00e1 v\u00a0den pod\u00e1n\u00ed a\u00a0nemus\u00ed se m\u011bnit podle novinek, kter\u00e9 vstoupily v\u00a0platnost a\u017e po tomto datu.<\/p>\n<p>Byty jako ve\u0159ejn\u00fd z\u00e1jem<\/p>\n<p class=\"e_bW\">Jedn\u00edm z\u00a0nejcitliv\u011bj\u0161\u00edch a\u00a0z\u00e1rove\u0148 nejd\u016fle\u017eit\u011bj\u0161\u00edch bod\u016f cel\u00e9 novely je nov\u00e9 postaven\u00ed bytov\u00e9 v\u00fdstavby. Ta se, konkr\u00e9tn\u011b u\u00a0projekt\u016f nad deset tis\u00edc metr\u016f \u010dtvere\u010dn\u00edch, dost\u00e1v\u00e1 mezi takzvan\u00e9 \u201evyhrazen\u00e9 stavby\u201c a\u00a0sou\u010dasn\u011b je jej\u00ed realizace v\u00fdslovn\u011b ozna\u010dena jako \u201eve\u0159ejn\u00fd z\u00e1jem\u201c.<\/p>\n<p class=\"e_bW\">Na prvn\u00ed pohled jde o\u00a0relativn\u011b stru\u010dnou zm\u011bnu v\u00a0z\u00e1kon\u011b. V\u00a0praxi ale m\u016f\u017ee z\u00e1sadn\u011b prom\u011bnit rozhodov\u00e1n\u00ed \u00fa\u0159ad\u016f. Dosud toti\u017e p\u0159i povolov\u00e1n\u00ed staveb neexistovala jasn\u011b definovan\u00e1 d\u016fle\u017eitost jednotliv\u00fdch ve\u0159ejn\u00fdch z\u00e1jm\u016f. Ochrana \u017eivotn\u00edho prost\u0159ed\u00ed nebo zem\u011bd\u011blsk\u00e9ho p\u016fdn\u00edho fondu tak \u010dasto dok\u00e1zala bytov\u00e9 projekty zastavit nebo v\u00fdrazn\u011b zpomalit. Z\u00e1jem na v\u00fdstavb\u011b bydlen\u00ed se nov\u011b dost\u00e1v\u00e1 na rove\u0148 ostatn\u00edm ve\u0159ejn\u00fdm z\u00e1jm\u016fm, kter\u00e9 \u00fa\u0159ady p\u0159i rozhodov\u00e1n\u00ed pom\u011b\u0159uj\u00ed.<\/p>\n<p class=\"e_bW\">\u201ePraktick\u00fd dopad t\u00e9to novely se pak projev\u00ed v\u00a0r\u00e1mci povolovac\u00edch \u0159\u00edzen\u00ed. Zat\u00edmco dosud mohla ochrana \u017eivotn\u00edho prost\u0159ed\u00ed \u010di ochrana zem\u011bd\u011blsk\u00e9ho p\u016fdn\u00edho fondu relativn\u011b snadno p\u0159ev\u00e1\u017eit nad z\u00e1jmem na realizaci bytov\u00e9 v\u00fdstavby, nov\u011b bude nutn\u00e9 tyto z\u00e1jmy posuzovat jako rovnocenn\u00e9. Pak u\u017e bude v\u00a0ka\u017ed\u00e9m konkr\u00e9tn\u00edm p\u0159\u00edpad\u011b rozhoduj\u00edc\u00ed, kter\u00fd z\u00a0koliduj\u00edc\u00edch ve\u0159ejn\u00fdch z\u00e1jm\u016f p\u0159i jejich pom\u011b\u0159ov\u00e1n\u00ed p\u0159ev\u00e1\u017e\u00ed,\u201c \u0159\u00edk\u00e1 advok\u00e1t a\u00a0specialista na stavebn\u00ed pr\u00e1vo Kamil Jel\u00ednek.<\/p>\n<p class=\"e_bW\">Podle n\u011bj tak zm\u011bna neznamen\u00e1 automatick\u00e9 povolen\u00ed v\u0161ech projekt\u016f, ale v\u011bt\u0161\u00ed \u0161anci proj\u00edt. \u201eObecn\u011b tak lze konstatovat, \u017ee navr\u017een\u00e1 z\u00e1konn\u00e1 \u00faprava v\u00fdznamn\u011b zvy\u0161uje d\u016fle\u017eitost bytov\u00e9 v\u00fdstavby, a\u00a0t\u00edm i\u00a0pravd\u011bpodobnost \u00fasp\u011b\u0161n\u00e9ho povolov\u00e1n\u00ed z\u00e1m\u011br\u016f v\u00a0oblasti bydlen\u00ed,\u201c dod\u00e1v\u00e1.<\/p>\n<p class=\"e_bW\">Z pohledu developer\u016f jde o\u00a0zm\u011bnu, kter\u00e1 ale na druhou stranu otev\u00edr\u00e1 dve\u0159e nap\u011bt\u00ed v\u00a0syst\u00e9mu a\u00a0zv\u00fdhodn\u011bn\u00ed bydlen\u00ed m\u016f\u017ee m\u00edt dopad na jin\u00e9 projekty. \u201eZ pohledu pr\u016fmyslov\u00e9ho developmentu vn\u00edm\u00e1me jako potenci\u00e1ln\u00ed komplikaci to, \u017ee hromadn\u00e9 bydlen\u00ed bude m\u00edt jako ve\u0159ejn\u00fd z\u00e1jem p\u0159ednost p\u0159i schvalov\u00e1n\u00ed,\u201c \u0159\u00edk\u00e1 David Kucha\u0159\u00edk, \u0159editel v\u00fdstavby skupiny CTP.<\/p>\n<p>Chyb\u00ed jistota<\/p>\n<p class=\"e_bW\">Odborn\u00edci nap\u0159\u00ed\u010d trhem se ale shoduj\u00ed, \u017ee zm\u011bna je nutn\u00e1. Z\u00e1rove\u0148 ale nejsou jednotn\u00ed v\u00a0tom, jak velk\u00fd dopad novela skute\u010dn\u011b p\u0159inese. \u201eV podob\u011b, kterou jsme m\u011bli mo\u017enost prostudovat, m\u00e1 n\u00e1vrh re\u00e1ln\u00fd potenci\u00e1l ke zrychlen\u00ed a\u00a0zjednodu\u0161en\u00ed. Sou\u010dasn\u011b ale plat\u00ed, \u017ee rozhoduj\u00edc\u00ed bude implementace v\u00a0praxi,\u201c \u0159\u00edk\u00e1 Emil Holub, \u010dlen spr\u00e1vn\u00ed rady Asociace pro rozvoj trhu nemovitost\u00ed a\u00a0partner advok\u00e1tn\u00ed kancel\u00e1\u0159e Clifford Chance.<\/p>\n<p class=\"e_bW\">Podobn\u011b mluv\u00ed i\u00a0stavebn\u00edci. Bez velmi pe\u010dliv\u00e9 organizace, stabiln\u00edch person\u00e1ln\u00edch kapacit a\u00a0funk\u010dn\u00edho digit\u00e1ln\u00edho z\u00e1zem\u00ed m\u016f\u017ee nar\u00e1\u017eet na praktick\u00e9 probl\u00e9my,\u201c dod\u00e1v\u00e1.<\/p>\n<p>Digitalizace jako podm\u00ednka<\/p>\n<p class=\"e_bW\">Jedn\u00edm z\u00a0kl\u00ed\u010dov\u00fdch faktor\u016f bude podle Davida Kucha\u0159\u00edka tak\u00e9 digitalizace. \u201eKl\u00ed\u010dovou podm\u00ednkou jak\u00e9hokoli zrychlen\u00ed je stabiln\u00ed a\u00a0pln\u011b funk\u010dn\u00ed Port\u00e1l stavebn\u00edka,\u201c \u0159\u00edk\u00e1 \u0161\u00e9f v\u00fdstavby v\u00a0CTP.<\/p>\n<p class=\"e_bW\">Podle n\u011bj ale samotn\u00e9 spu\u0161t\u011bn\u00ed syst\u00e9mu nesta\u010d\u00ed. \u201eDokud nebudou digit\u00e1ln\u00ed syst\u00e9my technicky spolehliv\u00e9 a\u00a0dokud se v\u0161ichni \u00fa\u010dastn\u00edci procesu nenau\u010d\u00ed s\u00a0port\u00e1lem efektivn\u011b pracovat, k\u00a0re\u00e1ln\u00e9mu zrychlen\u00ed nedojde.
