P\u011btibodov\u00fd test m\u00e1 vyjasnit rozhodov\u00e1n\u00ed o tom, kdo p\u0159ekro\u010dil z\u00e1kon. M\u00edsto toho ale m\u016f\u017ee rozpoutat roky pr\u00e1vn\u00ed nejistoty, varuje partner a specialista na pracovn\u00ed pr\u00e1vo Aegis Law Ji\u0159\u00ed Proch\u00e1zka. M\u016f\u017eete shrnout z\u00e1kladn\u00ed charakteristiky, podle kter\u00fdch inspekce pr\u00e1ce a soudy dosud posuzovaly, co je \u0161varcsyst\u00e9m?<\/p>\n<p>Vych\u00e1zelo se z pravidel obsa\u017een\u00fdch v z\u00e1kon\u00edku pr\u00e1ce. Nicm\u00e9n\u011b inspektor\u00e1ty pr\u00e1ce a n\u00e1sledn\u011b i spr\u00e1vn\u00ed soudy postupn\u011b dosp\u011bly k tomu, \u017ee si tato pravidla za\u010daly pom\u011brn\u011b voln\u011b interpretovat. Sn\u00e1ze identifikovaly \u0161varcsyst\u00e9m na z\u00e1klad\u011b trochu jin\u00fdch krit\u00e9ri\u00ed, ne\u017e obsahoval z\u00e1kon. Velkou roli za\u010dala hr\u00e1t ekonomick\u00e1 z\u00e1vislost. Zjednodu\u0161en\u011b \u0159e\u010deno: pokud je \u010dlov\u011bk fakticky ekonomicky z\u00e1visl\u00fd na jedn\u00e9 spole\u010dnosti, kter\u00e1 mu d\u00e1v\u00e1 pr\u00e1ci, je to siln\u00e1 indicie, \u017ee jde o \u0161varcsyst\u00e9m.<\/p>\n<p>Na stran\u011b firem se samoz\u0159ejm\u011b objevovaly pokusy toto pravidlo obch\u00e1zet, nap\u0159\u00edklad t\u00edm, \u017ee podnikatel m\u011bl je\u0161t\u011b drobn\u00fd p\u0159\u00edjem odjinud. Soudy ale uzav\u00edraly, \u017ee to nen\u00ed podstatn\u00e9. \u010casto se to p\u0159irovn\u00e1v\u00e1 k takzvan\u00e9mu \u201eparadoxu slona\u201c. Jak definujeme slona? M\u016f\u017eeme \u0159\u00edct: m\u00e1 \u010dty\u0159i nohy, chobot, je velk\u00fd a \u0161ed\u00fd. Ale kdy\u017e pak naraz\u00edte na zv\u00ed\u0159e, kter\u00e9 m\u00e1 chobot, je\u0161t\u011b to neznamen\u00e1, \u017ee je to slon. Vytvo\u0159it \u00fapln\u011b p\u0159esn\u00fd checklist, podle kter\u00e9ho n\u011bkdo, kdo nikdy slona nevid\u011bl, bezpe\u010dn\u011b pozn\u00e1, co slon je a co nen\u00ed, je velmi obt\u00ed\u017en\u00e9.<\/p>\n<p>Tak\u00e9 v p\u0159\u00edpad\u011b \u0161varcsyst\u00e9mu soudy necht\u011bly jet striktn\u011b podle seznamu krit\u00e9ri\u00ed, proto\u017ee v praxi doch\u00e1zelo k r\u016fzn\u00fdm \u201ekuli\u0161\u00e1rn\u00e1m\u201c. Typicky se do smluv za\u010dalo nap\u0159\u00edklad ps\u00e1t, \u017ee pracovn\u00edk m\u016f\u017ee vyu\u017e\u00edt subdodavatele nebo zam\u011bstnance, aby se obe\u0161lo krit\u00e9rium osobn\u00edho v\u00fdkonu pr\u00e1ce. Ve skute\u010dnosti se ale mo\u017enost subdod\u00e1vek \u010dasto nevyu\u017e\u00edvala. Kdyby soudy postupovaly \u010dist\u011b form\u00e1ln\u011b a jen si od\u0161krt\u00e1valy krit\u00e9ria, vedlo by to k nespr\u00e1vn\u00fdm z\u00e1v\u011br\u016fm. Musely by nap\u0159\u00edklad \u0159\u00edct, \u017ee kdokoliv m\u00e1 ve smlouv\u011b mo\u017enost subdodavatele, nen\u00ed ve \u0161varcsyst\u00e9mu, co\u017e zjevn\u011b neodpov\u00edd\u00e1 realit\u011b.<\/p>\n<p>Proto soudy za\u010daly p\u0159istupovat k v\u011bci jako ke komplexu \u2013 \u201ed\u00edvat se na slona jako celek\u201c. A pr\u00e1v\u011b v tomto r\u00e1mci za\u010daly v\u00edce zd\u016fraz\u0148ovat zm\u00edn\u011bnou ekonomickou z\u00e1vislost. \u0158\u00edkaly: u\u017e jen to, \u017ee n\u011bkdo poskytuje druh\u00e9mu fakticky \u017eivobyt\u00ed a ten na n\u011bm z\u00e1vis\u00ed existenc\u00ed svou i sv\u00e9 rodiny, je siln\u00e1 indikace, \u017ee by m\u011bl b\u00fdt zam\u011bstnancem. Jin\u00e9 krit\u00e9rium, kter\u00e9 v z\u00e1kon\u011b nenajdeme, je z\u00e1v\u011br Nejvy\u0161\u0161\u00edho spr\u00e1vn\u00edho soudu, \u017ee znakem \u0161varcsyst\u00e9mu je i to, \u017ee firma d\u011bl\u00e1 s kontraktory pohovory.\u00a0<\/p>\n<p>Jak na tento voln\u00fd v\u00fdklad reaguje nov\u00fd platformov\u00fd z\u00e1kon, kter\u00fd pr\u00e1v\u011b \u0161varcsyst\u00e9m \u0159e\u0161\u00ed?<\/p>\n<p>V d\u016fvodov\u00e9 zpr\u00e1v\u011b se pom\u011brn\u011b otev\u0159en\u011b \u0159\u00edk\u00e1, \u017ee st\u00e1t nen\u00ed spokojen s t\u00edm, jak soudy \u0161varcsyst\u00e9m vykl\u00e1daj\u00ed. Pova\u017euje jejich p\u0159\u00edstup za p\u0159\u00edli\u0161 \u0161irok\u00fd. Proto se nov\u011b vymezen\u00ed zu\u017euje na dv\u011b hlavn\u00ed oblasti: vztah nad\u0159\u00edzenosti a pod\u0159\u00edzenosti a v\u00fdkon pr\u00e1ce jm\u00e9nem zam\u011bstnavatele, tedy \u017ee navenek vystupujete pod jeho zna\u010dkou.<\/p>\n<p>Ch\u00e1pu to spr\u00e1vn\u011b, \u017ee nov\u011b sta\u010d\u00ed od\u0161krtnout tato dv\u011b krit\u00e9ria a je jasno, zda jde o \u0161varcsyst\u00e9m, nebo ne?<\/p>\n<p>Mus\u00edm zd\u016fraznit, \u017ee jde zat\u00edm o n\u00e1vrh z\u00e1kona, tak\u017ee se to je\u0161t\u011b m\u016f\u017ee zm\u011bnit. D\u00e1le tak\u00e9 plat\u00ed, \u017ee vztah nad\u0159\u00edzenosti a pod\u0159\u00edzenosti ministerstvo pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed v n\u00e1vrhu definovalo tak, \u017ee mus\u00ed b\u00fdt sou\u010dasn\u011b spln\u011bna \u010dty\u0159i d\u00edl\u010d\u00ed krit\u00e9ria: zam\u011bstnavatel organizuje pr\u00e1ci, dohl\u00ed\u017e\u00ed na ni, d\u00e1v\u00e1 pokyny, jak ji vykon\u00e1vat, a z\u00e1rove\u0148 ur\u010duje pracovn\u00ed dobu.<\/p>\n<p>Kdy\u017e to zjednodu\u0161\u00edm, vznik\u00e1 z toho p\u011btibodov\u00fd test. Pokud pracovn\u00ed vztah spln\u00ed v\u0161echna krit\u00e9ria, jde o \u0161varcsyst\u00e9m. Pokud jedno chyb\u00ed, \u0161varcsyst\u00e9m by to b\u00fdt nem\u011bl. To pova\u017euji za pom\u011brn\u011b z\u00e1sadn\u00ed odklon od dosavadn\u00ed praxe, kdy soudy pracovaly s \u0161ir\u0161\u00edm souborem indici\u00ed, v\u010detn\u011b t\u0159eba ekonomick\u00e9 z\u00e1vislosti. Ostatn\u011b i d\u016fvodov\u00e1 zpr\u00e1va k n\u00e1vrhu to \u0159\u00edk\u00e1 pom\u011brn\u011b otev\u0159en\u011b: c\u00edlem je omezit prostor pro \u201ekreativn\u00ed\u201c v\u00fdklad soud\u016f a p\u0159im\u011bt je dr\u017eet se dan\u00e9ho testu.<\/p>\n<p>    Mohlo by v\u00e1s zaj\u00edmat<\/p>\n<p>        <a href=\"https:\/\/www.ceska-justice.cz\/2026\/04\/babisova-vlada-narazila-senatori-nafta\/\" class=\"relative block overflow-hidden rounded-lg group aspect-[3\/2] md:aspect-video min-w-[88px] sm:min-w-[175px] lg:min-w-[225px]\" aria-label=\"\u010d\u00edst v\u00edce\" rel=\"nofollow noopener\" target=\"_blank\"><br \/>\n                        <img loading=\"lazy\" decoding=\"async\" width=\"384\" height=\"256\" src=\"https:\/\/www.europesays.com\/cz\/wp-content\/uploads\/2026\/04\/44848-de2c5cb206e33a0565939a0bc14c3463-big-384x256.jpg\" class=\"absolute object-cover w-full h-full group-hover:scale-105 transition-all\" alt=\"\"  \/><br \/>\n                        <\/a><\/p>\n<p>Znamen\u00e1 to tedy, \u017ee pokud firma neur\u010d\u00ed pracovn\u00ed dobu, ale jinak vztah vypad\u00e1 jako zam\u011bstnaneck\u00fd, nep\u016fjde o \u0161varcsyst\u00e9m?<\/p>\n<p>To je ot\u00e1zka, na kterou zat\u00edm nezn\u00e1me odpov\u011b\u010f. Pojem pracovn\u00ed doby je problematick\u00fd. Z\u00e1kon\u00edk pr\u00e1ce dnes umo\u017e\u0148uje pru\u017enou pracovn\u00ed dobu i samorozvrhov\u00e1n\u00ed, kdy zam\u011bstnanec pracuje prakticky, kdy chce. Tak\u017ee argument \u201enem\u00e1 pevn\u011b stanovenou pracovn\u00ed dobu\u201c nemus\u00ed b\u00fdt rozhoduj\u00edc\u00ed. Je ot\u00e1zka, jak z\u00e1kon budou vykl\u00e1dat inspektor\u00e1ty pr\u00e1ce a n\u00e1sledn\u011b soudy.<\/p>\n<p>Osobn\u011b si nemysl\u00edm, \u017ee by inspektor\u00e1t automaticky \u0159ekl: \u201eNen\u00ed ur\u010dena pracovn\u00ed doba, tak\u017ee je to v po\u0159\u00e1dku.\u201c Sp\u00ed\u0161e o\u010dek\u00e1v\u00e1m n\u011bkolik let nejistoty. Inspektor\u00e1ty budou d\u00e1l n\u011bkter\u00e9 hrani\u010dn\u00ed p\u0159\u00edpady pokutovat, ty se postupn\u011b dostanou k soud\u016fm, a teprve ty vymez\u00ed, co jednotliv\u00e1 krit\u00e9ria znamenaj\u00ed.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"701\" src=\"https:\/\/www.europesays.com\/cz\/wp-content\/uploads\/2026\/04\/helpsg-business-1219868-1920-1024x701.jpg\" alt=\"\" class=\"wp-image-95193\"  \/>Ekonomick\u00e1 z\u00e1vislost kontraktora na jedn\u00e9 firm\u011b u\u017e nebude znakem \u0161varcsyst\u00e9mu. St\u00e1t sni\u017euje tak\u00e9 pokuty za poru\u0161en\u00ed pravidel z\u00e1visl\u00e9 pr\u00e1ce. Razantn\u00ed zm\u011bna na trhu pr\u00e1ce je na spadnut\u00ed. Ilustra\u010dn\u00ed foto: Pixabay<\/p>\n<p>Krom\u011b pracovn\u00ed doby obsahuje n\u00e1vrh z\u00e1kona je\u0161t\u011b n\u011bco, co podle v\u00e1s m\u016f\u017ee v\u00e9st ke spor\u016fm?<\/p>\n<p>Pracovn\u00ed doba bude nejproblemati\u010dt\u011bj\u0161\u00ed. S ostatn\u00edmi prvky, jako je organizace pr\u00e1ce, dohled, pokyny, jsme u\u017e pracovali, a u jejich v\u00fdkladu tedy m\u016f\u017eeme o\u010dek\u00e1vat kontinuitu.<\/p>\n<p>Ale i tak mohou vznikat spory. V\u00fdvoj\u00e1\u0159i, a\u0165 u\u017e zam\u011bstnanci nebo kontrakto\u0159i, nap\u0159\u00edklad pracuj\u00ed v syst\u00e9mech typu Jira, kde jsou \u00fakoly detailn\u011b rozd\u011blen\u00e9, p\u0159i\u0159azen\u00e9, kontrolovan\u00e9. Firmy maj\u00ed standardy, jak m\u00e1 vypadat k\u00f3d, jak se m\u00e1 pr\u00e1ce dokumentovat. Pokyny jsou tedy velmi konkr\u00e9tn\u00ed. Firmy se logicky br\u00e1n\u00ed t\u00edm, \u017ee jinak to d\u011blat nejde, aby zajistily kvalitu. Proto soudy d\u0159\u00edve pou\u017e\u00edvaly ekonomickou z\u00e1vislost jako \u201evyva\u017euj\u00edc\u00ed\u201c krit\u00e9rium. \u0158\u00edkaly: ano, jsou zde pokyny a organizace pr\u00e1ce, ale pokud dodavatel nen\u00ed ekonomicky z\u00e1visl\u00fd, nejde o vztah nad\u0159\u00edzenosti a pod\u0159\u00edzenosti. Toto krit\u00e9rium ale nyn\u00ed vypad\u00e1v\u00e1. Soudy si tak mo\u017en\u00e1 najdou jin\u00e9 zp\u016fsoby, jak tyto situace f\u00e9rov\u011b posuzovat.<\/p>\n<p>P\u0159es velkou m\u00edru nejistoty, kterou zmi\u0148ujete, jak podle v\u00e1s zm\u011bny v definici \u0161varcsyst\u00e9mu ovlivn\u00ed trh pr\u00e1ce?<\/p>\n<p>Podle m\u011b to p\u0159inese o\u017eiven\u00ed \u0161varcsyst\u00e9mu. U\u017e samotn\u00e1 d\u016fvodov\u00e1 zpr\u00e1va otev\u0159en\u011b \u0159\u00edk\u00e1, \u017ee st\u00e1t chce omezit jeho postihov\u00e1n\u00ed. Pokud takovou zpr\u00e1vu vy\u0161lete na trh, je logick\u00e9, \u017ee na ni tak\u00e9 zareaguje. Firmy i jednotlivci mohou b\u00fdt odv\u00e1\u017en\u011bj\u0161\u00ed. Nav\u00edc se v d\u016fvodov\u00e9 zpr\u00e1v\u011b \u0159\u00edk\u00e1, \u017ee nap\u0159\u00edklad poskytov\u00e1n\u00ed benefit\u016f kontraktor\u016fm by nem\u011blo b\u00fdt automaticky pova\u017eov\u00e1no za d\u016fvod ozna\u010dit vztah za \u0161varcsyst\u00e9m. P\u0159itom dosud byl pr\u00e1v\u011b to pom\u011brn\u011b siln\u00fd indik\u00e1tor \u0161varcsyst\u00e9mu.<\/p>\n<p>Z\u00e1rove\u0148 se sni\u017euj\u00ed sankce \u2013 pokuta pro firmu kles\u00e1 z deseti milion\u016f na t\u0159i miliony korun, ru\u0161\u00ed se pokuty pro samotn\u00e9 pracovn\u00edky a terminologie se m\u011bn\u00ed z \u201eneleg\u00e1ln\u00ed pr\u00e1ce\u201c na \u201enehl\u00e1\u0161enou pr\u00e1ci\u201c. To v\u0161echno vys\u00edl\u00e1 sign\u00e1l, \u017ee jde o men\u0161\u00ed probl\u00e9m ne\u017e d\u0159\u00edve.<\/p>\n<p>Platformov\u00fd z\u00e1kon p\u0159edev\u0161\u00edm p\u0159ev\u00e1d\u00ed do \u010desk\u00e9ho pr\u00e1va evropskou sm\u011brnici, kter\u00e1 m\u00e1 chr\u00e1nit kur\u00fdry a pracovn\u00edky platforem, jako je nap\u0159\u00edklad Uber nebo Foodora. Vypl\u00fdv\u00e1 ze sm\u011brnice tak\u00e9 po\u017eadavek na zm\u00edrn\u011bn\u00ed podm\u00ednek \u0161varcsyst\u00e9mu, nebo jde \u010dist\u011b o \u010desk\u00e9 politick\u00e9 rozhodnut\u00ed?<\/p>\n<p>\u00dapravu \u0161varcsyst\u00e9mu evropsk\u00e1 sm\u011brnice p\u0159\u00edmo nevy\u017eaduje. Za sebe to vn\u00edm\u00e1m tak, \u017ee se vl\u00e1da rozhodla \u201eumravnit\u201c spr\u00e1vn\u00ed soudy a inspektor\u00e1ty pr\u00e1ce, kter\u00e9 podle jej\u00edho n\u00e1zoru vid\u00ed \u0161varcsyst\u00e9m v \u010cesk\u00e9 republice a\u017e p\u0159\u00edli\u0161 \u010dasto. Vl\u00e1da t\u00edm v z\u00e1sad\u011b \u0159\u00edk\u00e1: \u201eMy to takto nechceme. Chceme ulevit podnikatelsk\u00e9mu sektoru a nechceme, aby kontroln\u00ed org\u00e1ny nach\u00e1zely \u0161varcsyst\u00e9m v situac\u00edch, o kter\u00fdch si mysl\u00edme, \u017ee jsou v po\u0159\u00e1dku.\u201c Osobn\u011b to tedy pova\u017euji za snahu uleh\u010dit firm\u00e1m.<\/p>\n<p>Kam by se podle v\u00e1s m\u011bla regulace pracovn\u00edho pr\u00e1va do budoucna ub\u00edrat, a\u0165 u\u017e jde o \u0161varcsyst\u00e9m, nebo \u0161ir\u0161\u00ed ot\u00e1zku zp\u016fsobu zam\u011bstn\u00e1v\u00e1n\u00ed?<\/p>\n<p>V oblasti \u0161varcsyst\u00e9mu by mi d\u00e1valo smysl, aby se na n\u011bj n\u011bkdo opravdu koncep\u010dn\u011b pod\u00edval a zvolil \u0159e\u0161en\u00ed, kter\u00e9 bude dlouhodob\u011b fungovat. Dnes m\u00e1me v \u010cesku velmi vysok\u00e9 zdan\u011bn\u00ed pr\u00e1ce v pracovn\u00edm pom\u011bru a naopak relativn\u011b n\u00edzk\u00e9 zdan\u011bn\u00ed pr\u00e1ce na I\u010cO. To vytv\u00e1\u0159\u00ed silnou finan\u010dn\u00ed motivaci pracovat jako kontraktor. Uk\u00e1\u017eu to na p\u0159\u00edkladu: U IT specialisty s hrubou mzdou kolem 85 tis\u00edc korun d\u011bl\u00e1 rozd\u00edl v \u010dist\u00e9m p\u0159\u00edjmu mezi zam\u011bstnancem a kontraktorem kolem 50 %. To je obrovsk\u00fd rozd\u00edl. Logick\u00fdm \u0159e\u0161en\u00edm by bylo tuto motivaci n\u011bjak \u201eobrousit\u201c, tedy ten rozd\u00edl sn\u00ed\u017eit. To m\u016f\u017ee znamenat bu\u010f sn\u00ed\u017een\u00ed zdan\u011bn\u00ed zam\u011bstnanc\u016f, nebo zv\u00fd\u0161en\u00ed odvod\u016f u kontraktor\u016f. P\u0159\u00edpadn\u011b oboj\u00ed.<\/p>\n<p>Z\u00e1rove\u0148 m\u00e1me probl\u00e9m v tom, \u017ee do jedn\u00e9 kategorie OSV\u010c \u0159ad\u00edme velmi odli\u0161n\u00e9 profese. Na jedn\u00e9 stran\u011b jsou \u0159emesln\u00edci, nap\u0159\u00edklad instalat\u00e9\u0159i, elektrik\u00e1\u0159i, zem\u011bd\u011blci, kte\u0159\u00ed maj\u00ed pom\u011brn\u011b vysok\u00e9 re\u00e1ln\u00e9 n\u00e1klady.
