Objekt byl v\u00a0souladu s\u00a0\u00fazemn\u00edm pl\u00e1nem zkolaudovan\u00fd s\u00a0p\u0159eva\u017euj\u00edc\u00ed funkc\u00ed domova pro seniory se slu\u017ebami pro osoby v\u00a0nep\u0159\u00edzniv\u00e9 soci\u00e1ln\u00ed situaci. M\u00edsto toho ale developer postavil luxusn\u00ed byty.<\/p>\n<p class=\"e_bX\">O nesouladu mezi \u00fa\u010delem projektu a\u00a0jeho skute\u010dnou podobou se dosud nev\u011bd\u011blo. Redakce Seznam Zpr\u00e1v Byznys to zjistila p\u0159i zji\u0161\u0165ov\u00e1n\u00ed <a data-dot=\"atm-link\" target=\"_blank\" href=\"https:\/\/www.seznamzpravy.cz\/clanek\/ekonomika-byznys-reality-majitele-bytu-v-dome-na-smichove-plati-miliony-na-poplatcich-nevedi-za-co-294568\" class=\"e_n\" rel=\"nofollow noopener\">okolnost\u00ed konfliktu<\/a> mezi spole\u010denstv\u00edm vlastn\u00edk\u016f jednotek a\u00a0poskytovatelem nadstandardn\u00edch komer\u010dn\u00edch slu\u017eeb, za n\u011b\u017e mus\u00ed majitel\u00e9 i\u00a0cel\u00e9 SVJ platit bez ohledu na to, zda je vyu\u017e\u00edvaj\u00ed nebo ne.<\/p>\n<p class=\"e_bX\">\u201ePodle platn\u00e9ho kolauda\u010dn\u00edho rozhodnut\u00ed je stavba ur\u010dena k\u00a0u\u017e\u00edv\u00e1n\u00ed jako jin\u00e1 (polyfunk\u010dn\u00ed) stavba sdru\u017euj\u00edc\u00ed funkci domova pro seniory jako p\u0159eva\u017euj\u00edc\u00ed funkci,\u201c sd\u011blil letos v\u00a0\u00fanoru stavebn\u00ed \u00fa\u0159ad Prahy 5\u00a0na \u017e\u00e1dost spole\u010denstv\u00ed vlastn\u00edk\u016f.<\/p>\n<p class=\"e_bX\">\u201eP\u0159eva\u017euj\u00edc\u00ed rozsah a\u00a0\u00fa\u010del stavby tvo\u0159\u00ed slu\u017eby a\u00a0za\u0159\u00edzen\u00ed z\u00a0oblasti zdravotn\u00ed a\u00a0soci\u00e1ln\u00ed p\u00e9\u010de ve smyslu z\u00e1kona o\u00a0soci\u00e1ln\u00edch slu\u017eb\u00e1ch,\u201c uvedl d\u00e1le \u00fa\u0159ad.<\/p>\n<p class=\"e_bX\">Z\u00e1kon o\u00a0soci\u00e1ln\u00edch slu\u017eb\u00e1ch\u00a0upravuje podm\u00ednky poskytov\u00e1n\u00ed pomoci a\u00a0podpory fyzick\u00fdm osob\u00e1m v\u00a0nep\u0159\u00edzniv\u00e9 soci\u00e1ln\u00ed situaci. Pro vylou\u010den\u00ed pochybnost\u00ed stavebn\u00ed \u00fa\u0159ad rovn\u011b\u017e uvedl, \u017ee \u00fa\u010delem u\u017e\u00edv\u00e1n\u00ed stavby nen\u00ed domov pro seniory ur\u010den\u00fd pro p\u00e9\u010di o\u00a0osoby se sn\u00ed\u017eenou sob\u011bsta\u010dnost\u00ed.<\/p>\n<p><a data-dot=\"mol-article-card-media\" aria-hidden=\"true\" tabindex=\"-1\" href=\"https:\/\/www.seznamzpravy.cz\/clanek\/ekonomika-byznys-reality-majitele-bytu-v-dome-na-smichove-plati-miliony-na-poplatcich-nevedi-za-co-294568\" class=\"e_n f_l1\" rel=\"nofollow noopener\" target=\"_blank\"><img fetchpriority=\"high\" height=\"2250\"   width=\"4000\" src=\"https:\/\/www.europesays.com\/cz\/wp-content\/uploads\/2026\/05\/satpo-byty-reality-vitality-rezidence.jpeg\" loading=\"eager\" decoding=\"sync\" class=\"e_aa e_Z\"\/><\/a><\/p>\n<p class=\"e_bX\">\u201eDeveloper postupoval promy\u0161len\u011b ji\u017e od sam\u00e9ho za\u010d\u00e1tku a\u00a0postupoval rozd\u00edln\u011b v\u016f\u010di stavebn\u00edmu \u00fa\u0159adu a\u00a0v\u016f\u010di z\u00e1jemc\u016fm o\u00a0koupi byt\u016f. V\u016f\u010di stavebn\u00edmu \u00fa\u0159adu jej vedl jako d\u016fm ur\u010den\u00fd pro poskytov\u00e1n\u00ed soci\u00e1ln\u00edch slu\u017eeb, co\u017e mu umo\u017enilo z\u00edskat \u00fazemn\u00ed rozhodnut\u00ed a\u00a0stavebn\u00ed povolen\u00ed na pozemku, kter\u00fd byl v\u00a0\u00fazemn\u00edm pl\u00e1nu ozna\u010den jako ve\u0159ejn\u00e9 vybaven\u00ed a\u00a0zcela tak vylu\u010doval bytovou v\u00fdstavbu. Kupuj\u00edc\u00edm ale projekt prezentoval jako luxusn\u00ed reziden\u010dn\u00ed bydlen\u00ed s\u00a0nadstandardn\u00edmi, komer\u010dn\u00edmi a\u00a0placen\u00fdmi slu\u017ebami,\u201c uvedl advok\u00e1t SVJ Petr Novotn\u00fd.<\/p>\n<p class=\"e_bX\">\u201eT\u00edmto postupem z\u00e1m\u011brn\u011b uvedl ob\u011b strany v\u00a0omyl. Z\u00e1sadn\u00ed skute\u010dnost, \u017ee d\u016fm byl zkolaudov\u00e1n v\u00a0re\u017eimu z\u00e1kona o\u00a0soci\u00e1ln\u00edch slu\u017eb\u00e1ch, kupuj\u00edc\u00edm zatajil. Developer Satpo si p\u0159itom zakl\u00e1d\u00e1 na sv\u00e9 pov\u011bsti,\u201c dodal pr\u00e1vn\u00edk majitel\u016f byt\u016f.<\/p>\n<p>Po\u010dty senior\u016f<\/p>\n<p class=\"e_bX\">Redakce Seznam Zpr\u00e1v Byznys se obr\u00e1tila i\u00a0na developerskou spole\u010dnost Satpo, ptala se mimo jin\u00e9 na to, kolik senior\u016f v\u00a0Rezidenci Vitality \u017eije a\u00a0zda poskytovan\u00e9 slu\u017eby jsou v\u00a0souladu se z\u00e1konem o\u00a0soci\u00e1ln\u00edch slu\u017eb\u00e1ch a\u00a0kolauda\u010dn\u00edm \u00fa\u010delem objektu. Developer na ot\u00e1zky neodpov\u011bd\u011bl a\u00a0odk\u00e1zal pouze na sv\u00e9 d\u0159\u00edv\u011bj\u0161\u00ed vyj\u00e1d\u0159en\u00ed ke spor\u016fm se spole\u010denstv\u00edm vlastn\u00edk\u016f.<\/p>\n<p class=\"e_bX\">Redakce proto analyzovala informace v\u00a0katastru nemovitost\u00ed a\u00a0dal\u0161\u00edch otev\u0159en\u00fdch zdroj\u00edch typu obchodn\u00edho rejst\u0159\u00edku. Na z\u00e1klad\u011b toho se poda\u0159ilo ur\u010dit v\u011bk poloviny ze zhruba stovky majitel\u016f a\u00a0spolumajitel\u016f v\u00a0Rezidenci Vitality.<\/p>\n<p class=\"e_bX\">Pr\u016fm\u011brn\u00fd v\u011bk v\u00a0tomto vzorku je 52\u00a0let. Nejpo\u010detn\u011bj\u0161\u00ed je kategorie \u010dty\u0159ic\u00e1tn\u00edk\u016f, o\u00a0n\u011bco m\u00e9n\u011b je ve skupin\u011b pades\u00e1tn\u00edk\u016f, t\u0159et\u00ed nejpo\u010detn\u011bj\u0161\u00ed skupinou jsou \u0161edes\u00e1tn\u00edci. T\u011bch bylo ve vzorku t\u00e9m\u011b\u0159 stejn\u011b jako t\u0159ic\u00e1tn\u00edk\u016f. Senio\u0159i nad 70\u00a0let byli v\u00a0\u201edomov\u011b pro seniory\u201c v\u00a0uveden\u00e9m vzorku t\u0159i.<\/p>\n<p><a data-dot=\"mol-article-card-media\" aria-hidden=\"true\" tabindex=\"-1\" href=\"https:\/\/www.seznamzpravy.cz\/clanek\/audio-podcast-ve-vate-mene-prostoru-za-vic-penez-lidem-stale-casteji-staci-ke-stesti-i-16-metru-301337\" class=\"e_n f_l1\" rel=\"nofollow noopener\" target=\"_blank\"><img height=\"2250\"   width=\"4000\" src=\"https:\/\/www.europesays.com\/cz\/wp-content\/uploads\/2026\/03\/architektura-praha.jpeg\" loading=\"eager\" decoding=\"sync\" class=\"e_aa e_Z\"\/><\/a><\/p>\n<p class=\"e_bX\">Redakce oslovila tak\u00e9 stavebn\u00ed \u00fa\u0159ad Prahy 5\u00a0mimo jin\u00e9 s\u00a0dotazem, zda kontroloval vyu\u017eit\u00ed domu v\u00a0souladu s\u00a0kolaudac\u00ed, a\u00a0zda n\u011bjak kontroloval, jestli v\u00a0objektu skute\u010dn\u011b \u017eij\u00ed senio\u0159i \u010derpaj\u00edc\u00ed soci\u00e1ln\u00ed slu\u017eby, jak je vymezuje z\u00e1kon. \u00da\u0159ad nechal ot\u00e1zky bez odpov\u011bdi.<\/p>\n<p class=\"e_bX\">Komer\u010dn\u00ed slu\u017eby pro obyvatele domu poskytuje spole\u010dnost LCC dom\u00e1c\u00ed p\u00e9\u010de. Ta je sice veden\u00e1 v\u00a0registru poskytovatel\u016f soci\u00e1ln\u00edch slu\u017eeb Ministerstva pr\u00e1ce a\u00a0soci\u00e1ln\u00edch v\u011bc\u00ed, nen\u00ed v\u0161ak z\u0159ejm\u00e9, jak\u00e9 soci\u00e1ln\u00ed slu\u017eby ve smyslu z\u00e1kona v\u00a0Rezidenci Vitality poskytuje. Na ot\u00e1zky redakce firma neodpov\u011bd\u011bla.<\/p>\n<p class=\"e_bX\">\u201eDeveloper n\u00e1m rezidenci od za\u010d\u00e1tku prezentoval a\u00a0prod\u00e1val jako d\u016fm s\u00a0poskytov\u00e1n\u00edm speci\u00e1ln\u00edch slu\u017eeb a\u00a0p\u00e9\u010de pro vlastn\u00edky v\u00a0oblasti p\u00e9\u010de o\u00a0zdrav\u00ed a\u00a0osobn\u00ed pot\u0159ebu, zaji\u0161t\u011bn\u00ed pohodl\u00ed domova a\u00a0volno\u010dasov\u00fdch aktivit, v\u010detn\u011b zdravotn\u00ed p\u00e9\u010de a\u00a0stravov\u00e1n\u00ed. Nikdy p\u0159i prezentaci, prodeji ani v\u00a0kupn\u00edch smlouv\u00e1ch nezazn\u011blo, \u017ee by m\u011blo j\u00edt o\u00a0domov pro seniory jako\u017eto za\u0159\u00edzen\u00ed soci\u00e1ln\u00edch slu\u017eeb \u010di m\u011bly b\u00fdt poskytov\u00e1ny soci\u00e1ln\u00ed slu\u017eby dle z\u00e1kona o\u00a0soci\u00e1ln\u00edch slu\u017eb\u00e1ch. Naopak, byly n\u00e1m nab\u00edzeny \u010dist\u011b komer\u010dn\u00ed, nadstandardn\u00ed a\u00a0placen\u00e9 slu\u017eby,\u201c popsal jeden z\u00a0obyvatel a\u00a0\u010dlen v\u00fdboru spole\u010denstv\u00ed vlastn\u00edk\u016f Lum\u00edr Al-Dabagh.<\/p>\n<p class=\"e_bX\">Rozpor mezi \u00fa\u0159edn\u011b stanoven\u00fdm \u00fa\u010delem domu a\u00a0jeho skute\u010dn\u00fdm stavem hodl\u00e1 SVJ vyu\u017e\u00edt v\u00a0pr\u00e1vn\u00edch sporech o\u00a0miliony korun se spole\u010dnost\u00ed LCC dom\u00e1c\u00ed p\u00e9\u010de, kter\u00e1 m\u00e1 bl\u00edzko k\u00a0developerovi Satpo.<\/p>\n<p class=\"e_bX\">\u201eR\u00e1mcov\u00e1 smlouva a\u00a0na ni nav\u00e1zan\u00e9 individu\u00e1ln\u00ed smlouvy spole\u010dnosti LCC s\u00a0vlastn\u00edky m\u011bly ve skute\u010dnosti zakr\u00fdt podstatu cel\u00e9ho projektu. Jejich c\u00edlem bylo vytvo\u0159it dojem, \u017ee v\u00a0dom\u011b prob\u00edh\u00e1 poskytov\u00e1n\u00ed soci\u00e1ln\u00edch slu\u017eeb. Proto developer do projektu zapojil spole\u010dnost LCC a\u00a0do smluv zakotvil povinnost vlastn\u00edk\u016f tyto speci\u00e1ln\u00ed nadstandardn\u00ed slu\u017eby odeb\u00edrat po dobu deseti let,\u201c poznamenal advok\u00e1t spole\u010denstv\u00ed vlastn\u00edk\u016f Petr Novotn\u00fd.<\/p>\n<p class=\"e_bX\">Firma LCC dom\u00e1c\u00ed p\u00e9\u010de ale v\u011b\u0159\u00ed, \u017ee v\u00a0pr\u00e1vn\u00edch sporech usp\u011bje.<\/p>\n<p class=\"e_bX\">\u201eM\u00e1me plnou d\u016fv\u011bru v\u00a0justi\u010dn\u00ed syst\u00e9m a\u00a0p\u0159edpokl\u00e1d\u00e1me, \u017ee klient bude ve v\u0161ech\u00a0\u0159\u00edzen\u00edch \u00fasp\u011b\u0161n\u00fd. Dosavadn\u00ed pr\u016fb\u011bh tomu ostatn\u011b nasv\u011bd\u010duje, nebo\u0165 \u017ealoba SVJ na ur\u010den\u00ed neplatnosti smlouvy o\u00a0u\u017e\u00edv\u00e1n\u00ed prostor, poskytov\u00e1n\u00ed management slu\u017eeb a\u00a0slu\u017eeb recepce ze dne 28.\u00a0kv\u011btna 2025\u00a0byla Obvodn\u00edm soudem pro Prahu 5\u00a0v\u00a0cel\u00e9m rozsahu zam\u00edtnuta,\u201c sd\u011blil advok\u00e1t LCC Robert N\u011bmec z\u00a0kancel\u00e1\u0159e PRK Partners.<\/p>\n<p>Poplatky v\u00a0projektu Rezidence VitalityBal\u00ed\u010dek nadstandardn\u00edch slu\u017eeb typu \u00faklidu a\u00a0\u017eehlen\u00ed stoj\u00ed majitele byt\u016f m\u011bs\u00ed\u010dn\u011b 2505\u00a0korun. A\u00a0to bez ohledu na to, jestli slu\u017eby v\u00a0dan\u00e9m m\u011bs\u00edci vyu\u017eij\u00ed, nebo ne.Spole\u010dnost LCC dom\u00e1c\u00ed p\u00e9\u010de n\u00e1sledn\u011b zpoplatn\u00ed slu\u017eby je\u0161t\u011b \u010d\u00e1stkou 4138\u00a0korun na m\u011bs\u00edc a\u00a0byt. Pl\u00e1tcem faktur je v\u00a0tomto p\u0159\u00edpad\u011b spole\u010denstv\u00ed vlastn\u00edk\u016f jednotek. LCC naz\u00fdv\u00e1 tyto platby \u201emana\u017eersk\u00fdmi poplatky\u201c. Firma si je \u00fa\u010dtuje nap\u0159\u00edklad za evidenci slu\u017eeb nebo komunikaci s\u00a0klienty.P\u0159i koupi byt\u016f v Rezidenci Vitality se kupuj\u00edc\u00ed museli smluvn\u011b zav\u00e1zat, \u017ee budou slu\u017eby od LCC dom\u00e1c\u00ed p\u00e9\u010de odeb\u00edrat. Ka\u017ed\u00fd majitel musel n\u00e1sledn\u011b uzav\u0159\u00edt s\u00a0LCC je\u0161t\u011b samostatnou smlouvu o\u00a0poskytov\u00e1n\u00ed slu\u017eeb, a\u00a0to na deset let.LCC m\u00e1 rovn\u011b\u017e uzav\u0159enou smlouvu se Spole\u010denstv\u00edm vlastn\u00edk\u016f jednotek. Z\u00a0t\u00e9to smlouvy vypl\u00fdv\u00e1 pro spole\u010denstv\u00ed povinnost odv\u00e1d\u011bt LCC je\u0161t\u011b dal\u0161\u00ed \u201emana\u017eersk\u00e9\u201c poplatky. Smlouvu s\u00a0LCC uzav\u0159el za spole\u010denstv\u00ed vlastn\u00edk\u016f developer Satpo v\u00a0dob\u011b, kdy m\u011bl p\u0159ed prodejem byt\u016f pod kontrolou v\u00fdbor spole\u010denstv\u00ed vlastn\u00edk\u016f.<\/p>\n<p class=\"e_bX\">Zm\u00edn\u011bn\u00fd rozsudek, s\u00a0n\u00edm\u017e se redakce m\u011bla mo\u017enost sezn\u00e1mit, se ale net\u00fdk\u00e1 podstaty sporu, tedy zda smlouvy mezi spole\u010denstv\u00edm vlastn\u00edk\u016f a\u00a0LCC jsou, \u010di nejsou platn\u00e9. Soud zam\u00edtl \u017ealobu podanou ze strany SVJ kv\u016fli takzvan\u00e9mu nedostatku nal\u00e9hav\u00e9ho pr\u00e1vn\u00edho z\u00e1jmu, smlouvami jako takov\u00fdmi se nezab\u00fdval.<\/p>\n<p class=\"e_bX\">\u201eNa\u0161i \u017ealobu na ur\u010den\u00ed nal\u00e9hav\u00e9ho pr\u00e1vn\u00edho z\u00e1jmu soud zam\u00edtl, ani\u017e by \u0159e\u0161il samotnou podstatu sporu. Pouze konstatoval, \u017ee v\u011bc lze \u0159e\u0161it p\u0159\u00edmo uplatn\u011bn\u00edm konkr\u00e9tn\u00edch n\u00e1rok\u016f ze sporn\u00fdch smluv. Tato cesta je podle na\u0161eho n\u00e1zoru povede k\u00a0zahajov\u00e1n\u00ed v\u011bt\u0161\u00edho po\u010dtu soudn\u00edch spor\u016f. Zva\u017eujeme proto odvol\u00e1n\u00ed,\u201c reagoval advok\u00e1t SVJ Novotn\u00fd.<\/p>\n<p class=\"e_bX\">LCC po\u017eaduje po spole\u010denstv\u00ed vlastn\u00edk\u016f kompenzaci za vypov\u011bzen\u00ed smlouvy ve v\u00fd\u0161i 8,7\u00a0milionu korun, doplacen\u00ed dlu\u017en\u00fdch poplatk\u016f ve statis\u00edcov\u00e9m \u0159\u00e1du a\u00a0\u00farok\u016f. Naopak SVJ tvrd\u00ed, \u017ee n\u00e1rok na \u00fahradu \u0161kody vznikl pr\u00e1v\u011b vlastn\u00edk\u016fm.
