{"id":721727,"date":"2026-01-16T02:30:12","date_gmt":"2026-01-16T02:30:12","guid":{"rendered":"https:\/\/www.europesays.com\/de\/721727\/"},"modified":"2026-01-16T02:30:12","modified_gmt":"2026-01-16T02:30:12","slug":"whats-on-the-horizon-for-uk-restructuring-and-insolvency-in-2026","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/de\/721727\/","title":{"rendered":"What&#8217;s on the horizon for UK restructuring and insolvency in 2026?"},"content":{"rendered":"<p class=\"primary\">As a challenging environment persists for UK businesses, we look ahead to what is shaping up to be a dynamic year for UK restructuring and insolvency.<\/p>\n<p>Restructuring plans\u00a0<\/p>\n<p class=\"tertiary\">The restructuring plan (RP) landscape has seen some significant shifts following last year&#8217;s <a href=\"https:\/\/www.taylorwessing.com\/de\/insights-and-events\/insights\/2025\/05\/riu-english-court-of-appeal-upholds-thames-water-restructuring-plan\" target=\"_blank\" rel=\"noopener\">Thames Water<\/a>, <a href=\"https:\/\/www.taylorwessing.com\/de\/insights-and-events\/insights\/2025\/07\/riu\/uk-court-of-appeal-overturns-petrofacs-restructuring-plans\" target=\"_blank\" rel=\"noopener\">Petrofac<\/a> and <a href=\"https:\/\/www.taylorwessing.com\/de\/insights-and-events\/insights\/2025\/09\/riu\/english-court-refuses-to-sanction-waldorf-productions-restructuring-plan\" target=\"_blank\" rel=\"noopener\">Waldorf<\/a> cases. Courts are now taking a much harder look at fairness \u2013\u00a0particularly how out-of-the-money creditors are treated and whether restructuring benefits are being reasonably allocated. There&#8217;s also a new <a rel=\"noopener noreferrer\" href=\"https:\/\/www.judiciary.uk\/wp-content\/uploads\/2025\/09\/Revised-Pt-26-26A-FINAL-SEPTEMBER-2025.pdf\" target=\"_blank\">Practice Statement<\/a> requiring companies to demonstrate genuine efforts to engage with creditors before pursuing a plan. Whilst Waldorf&#8217;s Supreme Court appeal has been withdrawn, we&#8217;re likely to see more cases testing these boundaries.<\/p>\n<p class=\"tertiary\">Meanwhile, the <a href=\"https:\/\/www.taylorwessing.com\/de\/insights-and-events\/insights\/2025\/10\/riu\/german-regional-court-declines-recognition-of-aggregates-english-restructuring-plan\" target=\"_blank\" rel=\"noopener\">German Regional Court&#8217;s refusal to recognise Aggregate&#8217;s English restructuring plan<\/a>\u00a0has thrown up challenges for cross-border recognition as practitioners eagerly await the outcome of an appeal of this decision. That said, RPs might be more attractive to US entities wanting to sidestep Chapter 11&#8217;s absolute priority rule, as <a href=\"https:\/\/www.taylorwessing.com\/de\/insights-and-events\/insights\/2025\/12\/riu\/fossil-uses-english-restructuring-plan-to-avoid-chapter-11\" target=\"_blank\" rel=\"noopener\">Fossil&#8217;s<\/a>\u00a0recent successful restructuring demonstrated.<\/p>\n<p>LMEs\u00a0<\/p>\n<p class=\"tertiary\">Liability management exercises (LMEs) are making their way into Europe now, and with RPs\u00a0 becoming increasingly costly and uncertain \u2013 not to mention the growing challenge risk \u2013 we&#8217;re expecting these to gain real traction as a go-to tool for distressed borrowers in 2026.<\/p>\n<p>Digital assets<\/p>\n<p class=\"tertiary\">The Property (Digital Assets etc) Act 2025 is a game-changer. It&#8217;s given insolvency practitioners statutory confirmation that digital assets are property, which means they can preserve and recover value with greater confidence.
