A Warsaw man was arrested after allegedly assaulting a woman.
Juan Antonio Magno-Campos, 35, of 2058 E. Old U.S. 30, Warsaw, is charged with sexual battery, a level 6 felony; and criminal confinement, a level 6 felony.
He was booked into the Kosciusko County Jail at 9:09 p.m. Aug. 22 on a $10 preliminary bond.
According to the probable cause affidavit, on Aug. 22 a Warsaw Police Department officer responded to a restaurant regarding an alleged assault.
Upon arrival to the scene, the officer spoke to a woman who said a female employee had been assaulted by a cook, identified as Magno-Campos.
The officer talked to Magno-Campos, with the use of a translator, and Magno-Campos said he put his hands around the woman and tried to kiss her. Magno-Campos said at first the woman went along with it but eventually said no. Magno-Campos said he stopped.
Magno-Campos appeared intoxicated, according to court documents and he admitted to drinking. He agreed to take a portable breath test, with a result of 0.259.
The officer talked to the woman, who was in the bathroom after the alleged incident and refused to come out. According to court documents, the woman was visibly shaking, crying and hyperventilating at times while talking to the officer.
The woman said she entered the freezer to retrieve cucumbers for her work area. When she turned around Magno-Campos was standing in the doorway. Magno-Campos grabbed the woman and pulled her towards him. The woman stated she raised her hands and repeatedly told him to stop. Magno-Campos stated, “Come on, come on.”
The woman said the freezer floor was slippery, which prevented her from gaining traction as she attempted to get away. The woman used the items she was using to push Magno-Campos away. She used shelving to help her try to escape. She tried to maneuver around Magno-Campos but he was blocking the freezer doorway. The woman screamed and yelled for help. The woman was able to escape and left the freezer.
The officer saw markings on the woman’s torso.
