Mid-April 2026, the court held that the principle of transparency overrides a bidder\u2019s interest in confidentiality under the German Act against Restraints of Competition (GWB). According to \u00a7 134 GWB, the pre-award notification must disclose the winner&#8217;s price when price is the sole award criterion. Where qualitative criteria also shape the decision, the authority must provide a comparative evaluation of the own and the winning bid. Trade secrets do not shield this information; only with full disclosure can rival bidders assess the legality of the award. An incomplete information status alone, the court argued, can constitute a looming injury that justifies a review proceeding.<\/p>\n<p>Parallel to this judicial clarity, the state of Hesse will implement significantly stricter rules for public contracts starting July 1, 2026. The new Hessische Vergabe- und Tariftreuegesetz (HVTG) demands comprehensive proof from companies that they adhere to collective-bargaining wage standards. At its core, \u00a7 4 HVTG mandates the payment of tariff wages. To streamline the verification process, the law introduces a special pre-qualification registry tagged &#8220;Tarif&#8221; under \u00a7 10 HVTG. Firms can get certified in advance, reducing administrative red tape while ensuring compliance. The legislation sticks to the &#8220;best bidder&#8221; principle \u2014 the contract goes not necessarily to the cheapest offer but to the one that best meets qualitative and social criteria. Rules governing subcontractor chains have also been tightened.<\/p>\n<p>To help businesses navigate the new landscape, an online seminar is scheduled for June 26, 2026.<\/p>\n<p>In a separate but coinciding change, members of the Hessian state parliament (Landtag) will see their compensation rise on the same date. Under an automatic mechanism tied to the nominal wage index, basic allowances climb by 4.3 percent to \u20ac10,362 monthly. The expense allowance, linked to general price trends, increases by 2.4 percent to \u20ac1,544.
