It also said the prosecutors and the lower court had failed to provide sufficient grounds for his pretrial detention.<\/p>\n<p class=\"wp-block-paragraph\">G\u00fcle\u00e7y\u00fcz spent 57 days in pretrial detention before being released pending trial and was <a href=\"https:\/\/stockholmcf.org\/journalist-gets-suspended-sentence-for-conveying-condolences-for-late-cleric-gulen\/\" rel=\"nofollow noopener\" target=\"_blank\">handed down<\/a> a suspended 15-month sentence in March 2025 on conviction of disseminating \u201cterrorist propaganda\u201d in the post.<\/p>\n<p class=\"wp-block-paragraph\">The court awarded G\u00fcle\u00e7y\u00fcz 325,000 Turkish lira (about $6,900) in non-pecuniary damages for the rights violations and found no need for a retrial.<\/p>\n<p class=\"wp-block-paragraph\">He was <a href=\"https:\/\/stockholmcf.org\/editor-in-chief-of-turkish-daily-arrested-for-gulen-condolence-message\/\" rel=\"nofollow noopener\" target=\"_blank\">arrested<\/a> on October 24, 2024, for his condolence message for G\u00fclen, who died at a US hospital on October 20 at the age of 83.<\/p>\n<p class=\"wp-block-paragraph\">The Turkish government has targeted G\u00fclen and his followers since corruption investigations in December 2013 implicated then-prime minister Recep Tayyip Erdo\u011fan as well as some members of his family and inner circle. Erdo\u011fan dismissed the probes as a G\u00fclenist conspiracy, and his government designated the movement as a terrorist organization in May 2016, intensifying the crackdown after a coup attempt in July of the same year that he accused G\u00fclen of orchestrating. The movement denies involvement in the attempted coup or any terrorist activity.<\/p>\n<p class=\"wp-block-paragraph\">Former lawmaker Mustafa Yenero\u011flu said on X that the Constitutional Court had reached a legal conclusion that both the prosecutor who initiated the investigation and the court that ordered G\u00fcle\u00e7y\u00fcz\u2019s pretrial detention should have recognized from the outset.<\/p>\n<p lang=\"tr\" dir=\"ltr\">Anayasa Mahkemesi, Kaz\u0131m G\u00fcle\u00e7y\u00fcz&#8217;\u00fcn 21 Ekim 2024 tarihli payla\u015f\u0131m\u0131 nedeniyle tutuklanmas\u0131n\u0131n ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131n\u0131 ve ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc ihlal etti\u011fine oybirli\u011fiyle karar verdi.
