{"id":22130,"date":"2026-02-23T17:08:09","date_gmt":"2026-02-23T17:08:09","guid":{"rendered":"https:\/\/www.europesays.com\/dk\/22130\/"},"modified":"2026-02-23T17:08:09","modified_gmt":"2026-02-23T17:08:09","slug":"brussels-privacy-reforms-stumble-out-the-gate-politico","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/dk\/22130\/","title":{"rendered":"Brussels\u2019 privacy reforms stumble out the gate \u2013 POLITICO"},"content":{"rendered":"<p>The Commission in November presented its <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/news\/simpler-eu-digital-rules-and-new-digital-wallets-save-billions-businesses-and-boost-innovation\" target=\"_blank\" rel=\"nofollow noopener\">&#8220;digital omnibus&#8221;<\/a> plan as part of a bigger overhaul of data and AI laws that seeks to boost AI technology in Europe. It is one of (so far) <a href=\"https:\/\/commission.europa.eu\/law\/law-making-process\/better-regulation\/simplification-and-implementation\/simplification_en\" target=\"_blank\" rel=\"nofollow noopener\">10 so-called omnibuses<\/a> that aim to slash red tape and boost European competitiveness proposed by Ursula von der Leyen&#8217;s Commission. <\/p>\n<p>The new document, dated Feb. 20, was prepared by the rotating presidency of the Council of the EU, currently held by Cyprus, and serves as a basis for national governments to negotiate a joint position on the privacy reforms.<\/p>\n<p>The Cypriots took aim at a core change to the data protection rulebook: how the law defines personal data. If approved, the change would move troves of data out of the scope of privacy protections.<\/p>\n<p>The revision sought to adapt the GDPR to\u00a0<a href=\"https:\/\/pro.politico.eu\/news\/204073\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">a recent ruling<\/a>\u00a0by the EU\u2019s top court (<a href=\"https:\/\/pro.politico.eu\/cases\/330911\/overview\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">SRB v EDPS<\/a>), which found that sometimes &#8220;pseudonymized&#8221; data, where a person\u2019s details are obscured so they can\u2019t be easily identified, could move it outside the strict privacy guardrails of the GDPR.<\/p>\n<p>That would particularly benefit companies, including AI developers, which would be able to use pseudonymized data more freely as long as they can&#8217;t reasonably re-identify data subjects.<\/p>\n<p>The changes have already triggered a backlash from European privacy regulators, which this month\u00a0<a href=\"https:\/\/pro.politico.eu\/news\/212914\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">warned against<\/a>\u00a0amending the definition, and have split EU countries, which <a href=\"https:\/\/pro.politico.eu\/news\/212279\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">pushed back against the reform in early position papers<\/a>.<\/p>\n<p>But European tech and business lobby groups <a href=\"https:\/\/www.businesseurope.eu\/publications\/making-gdpr-more-effective-a-businesseurope-position-paper\/\" target=\"_blank\" rel=\"nofollow noopener\">welcomed<\/a> the Commission&#8217;s proposed reforms, applauding the EU executive for its efforts to unlock more data to fuel AI innovation.<\/p>\n<p>EU countries will consider the text on Feb. 27 at a meeting of diplomats focused on the EU\u2019s simplification efforts.
