Photo: Rey Yen<\/p>\n<p>Indonesia\u2019s way of calculating corruption losses \u2013 meaning how much money the state has lost due to corruption \u2013 is falling behind countries like Denmark and Finland, and it could have serious consequences in court.<\/p>\n<p>That is the warning from Indonesian legal scholar Fransiscus Nanga Roka in a new <a href=\"https:\/\/www.opinionnigeria.com\/engineering-state-loss-why-indonesia-lags-behind-denmark-finland-and-singapore-in-corruption-quantification-by-fransiscus-nanga-roka\/\" target=\"_blank\" rel=\"noopener nofollow\">opinion piece published by Opinion Nigeria<\/a>.<\/p>\n<p>\u201cNumbers are supposed to be the truth when it comes to corruption trials. In Indonesia, they too frequently tell a story that has been decided.\u201d<\/p>\n<p>Figures may be shaped to fit the case<\/p>\n<p>He says the amount of money the state is said to have lost is often unclear and not properly checked.<\/p>\n<p>In some cases, he argues, the figures may even be shaped to fit the prosecution\u2019s case.<\/p>\n<p>\u201cRather than evidence forming the case, the case forms the evidence,\u201d he says.<\/p>\n<p>Roka warns that wrong numbers can lead to harsher sentences, and defendants often can\u2019t check the data.<\/p>\n<p>Nordic difference<\/p>\n<p>Countries like Denmark and Finland are highlighted as examples of stricter legal standards<\/p>\n<p>In Denmark and Finland, courts don\u2019t just accept a number. Prosecutors must show exactly how much money was lost, and prove it with real documents and data.<\/p>\n<p>\u201cTheir methods get tested and challenged,\u201d Roka says.<\/p>\n<p>Experts must explain their calculations in detail, and the defence can then challenge them.<\/p>\n","protected":false},"excerpt":{"rendered":"Indonesia\u2019s Constitutional Court in Jakarta.
