{"id":37508,"date":"2026-05-11T02:14:24","date_gmt":"2026-05-11T02:14:24","guid":{"rendered":"https:\/\/www.europesays.com\/europe\/37508\/"},"modified":"2026-05-11T02:14:24","modified_gmt":"2026-05-11T02:14:24","slug":"eu-commission-clarifies-flight-compensation-rights-amid-travel-disruption-156","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/europe\/37508\/","title":{"rendered":"EU Commission clarifies flight compensation rights amid travel disruption"},"content":{"rendered":"<p>\n                        The European Commission on Friday clarified rules on air passenger rights given possible fuel shortages and travel disruption amid conflict in the Middle East.\n                    <\/p>\n<p>In a guidance document to the EU transport and tourism sector, the Commission said that \u201cthe overall situation remains stable\u201d and at the moment \u201cthere is no concrete evidence of fuel shortages\u201d. <\/p>\n<p>However, jet fuel supply disruptions could occur causing \u201cdelays, cancellations, longer travel times and higher prices\u201d for travellers.<\/p>\n<p>The guidance, which aims to ensure that the same rules apply across EU Member States, says that travellers affected by cancellations \u201ccontinue to benefit from air passenger rights,\u201d including reimbursement, re-routing or return, assistance at the airport and compensation for last-minute cancellations.<\/p>\n<p>\u201cExtraordinary circumstances\u201d<\/p>\n<p>Under EU rules, for cancellations less than 14 days before the planned departure date, airlines have to pay compensation, unless they can prove that these were caused by \u201cextraordinary circumstances\u201d which could not have been avoided.<\/p>\n<p>The Commission said that a local fuel shortage preventing the operation of a flight may be considered an \u201cextraordinary circumstance\u201d. However, cancellations caused by high fuel prices cannot be considered so, because fuel prices are \u201centirely foreseeable\u201d, and airlines are free to pass the cost through to the consumer setting higher prices. <\/p>\n<p>\u201cManaging price volatility is a normal part of an airline\u2019s business,\u201d the Commission argued.<\/p>\n<p>\u201cAll the cancellations that have been announced for the time being are due to jet fuel prices, not due to shortages,\u201d said Commission spokesperson Anna-Kaisa Itkonen.<\/p>\n<p>Vouchers<\/p>\n<p>EU rules state that airlines can provide reimbursement or compensation in money or in the form of a voucher, \u201cif the passenger expressly agrees to it\u201d.<\/p>\n<p>In this regard, the Commission \u201cstrongly\u201d encouraged airlines and travel operators to follow the recommendation issued in 2020, during the Covid-19 pandemic, on how to make vouchers \u201cmore attractive\u201d to travellers, for example as regards validity, flexibility, transferability or reimbursability.<\/p>\n<p>Transparent pricing<\/p>\n<p>Air carriers also have to ensure \u201ctransparent pricing of air fares\u201d and clearly show the final ticket prices before the purchase to avoid unexpected costs for consumers.<\/p>\n<p>In this regard, the Commission said that charging additional fees retroactively, such as fuel surcharges, is not allowed.<\/p>\n<p>Holiday packages<\/p>\n<p>For holiday packages, EU legislation allows retroactive price increases if this is stated in the contract and if it is \u201ca direct consequence of changes in the price of the carriage of passengers\u201d.<\/p>\n<p>In such cases, the price can increase up to 8 percent without requiring the traveller\u2019s agreement.
