I've posted before regarding I'm being accused of theft and contract breach after I asked for payment from my gig work.
Which those claims are untrue.

I've sent a reply basically object the accusations and clearing the situations. I attached a proof and also the invoices.
But obviously, it's ignored.
And the deadline from the invoice has passed.

I sent the person a Mahnung today, and she replied quickly but now she titled the E-mail as : Betrug.
And here is the reply.
And the last sentence mentioned said :
"Send me the invoice, and I'll gladly transfer directly to you 50 Euro"

Note that, the Mahnung is for 2 invoices for October's work, while it seems she's focusing on January's work (where the accusations arise and her mentioning 90 Euro, bcs I worked shorter hours that day).

Idk if I should just reply something like :
I don't agree with the reduction, since we're unable to reach an agreement, I will pursue this matter legally.

Then wait until the deadline of the Mahnung to go further.
And honestly I don't have the mean to do lawyer out of my pocket.
From ChatGPT after Mahnung deadline has passed I can lodge a Mahnverfahren.

Idk if it's worth it, is it true going to be that expensive (not just initial admin pay around 40 Euro, that the other party will pay too if I win the case), and there's guarantee that I will get my money after I went through all those legal process.

Does anyone have any experience going through legal steps like Mahnverfahren and such and could get your salary back?

Please note whatever the accusations on the screenshot I attached are untrue. And I don't disclose the detail here to not make the post too long.

I just feel a bit insecure bcs they're an agency, presumably have more money and connections and probably fabricated things to sue me. While I'm just a regular person without backups.

And no, I don't want to use this as "learning experience and cut my losses", I've had enough of that. I need the money, every single cent, to pay for my dog's treatment.

    For 40 Euros? Like if i understood it correct, you want 90 Euro and she claims you stole a “big pizza” and sweets and that means you only get 50 Euro. If i were you i would just take the 50 Euro and move on. It doesn’t really make sense to pay a lot of money to some lawyer only to maybe win 40 Euro. Or is there more money involved in this? And i know you wrote you need every cent but as i said, it makes no sense to pay a lot of money to a lawyer for winning 40 Euros.

  2. At least the mail sounds reconciliatory and an attempt to find middle ground. You can seek a lawyer that has free or for a small fee is willing to initially consult you. If you are ensured you are in the right, in case you win the case, they will have to foot the bill for your lawyer, but you will have to pay in advance for the case to get going.
    If its 40€ as I understand, it would be not worth it, but I dont know your financial situation. In any case, good luck.
