Elle avait pourtant \u00e9t\u00e9 vir\u00e9e pour avoir trait\u00e9 son employeur de \u00ab\u00a0connard\u00a0\u00bb, rapporte le <a href=\"https:\/\/www.dailymail.co.uk\/news\/article-15069143\/boss-d-head-not-sackable-offence-employment-tribunal.html\" target=\"_blank\" class=\"c-link c-link--is-underlined\" rel=\"nofollow noopener\">Daily Mail<\/a>.<\/p>\n<p>\u00ab\u00a0Faites vos bagages et foutez le camp\u00a0\u00bb<\/p>\n<p>En mai\u00a02022, Kerrie Herbert, qui occupait le poste de secr\u00e9taire de direction au sein d\u2019une <a href=\"https:\/\/www.20minutes.fr\/dossier\/entreprise\" class=\"c-link c-link--is-underlined\" rel=\"nofollow noopener\" target=\"_blank\">entreprise<\/a> d\u2019\u00e9chafaudages et de ma\u00e7onnerie de Northampton, est tomb\u00e9e sur des documents dans le bureau de son patron. Ceux-ci concernaient le co\u00fbt de son emploi. L\u2019employ\u00e9e a alors senti que son poste \u00e9tait menac\u00e9.<\/p>\n<p>Lors d\u2019un entretien, son <a href=\"https:\/\/www.20minutes.fr\/dossier\/patron\" class=\"c-link c-link--is-underlined\" rel=\"nofollow noopener\" target=\"_blank\">patron<\/a> a soulev\u00e9 des probl\u00e8mes concernant ses performances. Elle s\u2019est alors mise \u00e0 pleurer. Lors d\u2019une discussion tendue avec son sup\u00e9rieur, la secr\u00e9taire a d\u00e9cid\u00e9 de livrer ses quatre v\u00e9rit\u00e9s. Elle a l\u00e2ch\u00e9 que si elle est rest\u00e9e \u00e0 son poste, c\u2019est \u00e0 cause des \u00ab\u00a0deux enfoir\u00e9s\u00a0\u00bb qui dirigent la bo\u00eete, \u00e0 savoir son patron et sa femme. Selon ce qu\u2019a rapport\u00e9 Kerrie Herbert de cet entretien, l\u2019homme lui a lanc\u00e9\u00a0: \u00ab\u00a0Ne me traitez pas d\u2019enfoir\u00e9, ni ma femme. C\u2019est fini, vous \u00eates vir\u00e9e. Faites vos bagages et foutez le camp.\u00a0\u00bb<\/p>\n<p>Absence de proc\u00e9dure<\/p>\n<p>Kerrie Herbert ne s\u2019est pas laiss\u00e9e faire et a demand\u00e9 des d\u00e9dommagements en justice. Le tribunal de l\u2019emploi de Cambridge a statu\u00e9 en sa faveur. De son c\u00f4t\u00e9, l\u2019entreprise a tent\u00e9 de justifier le licenciement par des probl\u00e8mes de performance. Mais le <a href=\"https:\/\/www.20minutes.fr\/dossier\/tribunal\" class=\"c-link c-link--is-underlined\" rel=\"nofollow noopener\" target=\"_blank\">tribunal<\/a> a consid\u00e9r\u00e9 que l\u2019entreprise n\u2019avait pas suivi les proc\u00e9dures disciplinaires appropri\u00e9es. Bien que l\u2019insulte puisse \u00eatre un motif valable de licenciement, il aurait fallu un avertissement pr\u00e9alable.<\/p>\n<\/p>\n<p>M\u00eame si l\u2019<a href=\"https:\/\/www.20minutes.fr\/dossier\/insulte\" class=\"c-link c-link--is-underlined\" rel=\"nofollow noopener\" target=\"_blank\">insulte<\/a> \u00e9tait \u00ab\u00a0inappropri\u00e9e et regrettable\u00a0\u00bb, elle ne constituait ni une faute grave ni une rupture de contrat, d\u2019autant plus qu\u2019il s\u2019agissait d\u2019un incident isol\u00e9 sans ant\u00e9c\u00e9dents\u00a0de comportement offensant, a estim\u00e9 la juge.
