Cette l\u00e9gislation, adopt\u00e9e en 2023, oblige toutes les entreprises de plus de 100 salari\u00e9s \u00e0 publier leurs \u00e9carts de salaire entre femmes et hommes, \u00e0 informer les candidats des fourchettes de r\u00e9mun\u00e9ration, et \u00e0 justifier tout \u00e9cart d\u00e9passant 5 %. Mais derri\u00e8re un texte unique, trois approches se dessinent : la France, l\u2019Allemagne et la Su\u00e8de appliquent la m\u00eame directive selon leurs traditions sociales, juridiques et technologiques.<\/p>\n<p data-start=\"567\" data-end=\"1048\">La <strong data-start=\"570\" data-end=\"632\">directive europ\u00e9enne sur la transparence des r\u00e9mun\u00e9rations<\/strong>, adopt\u00e9e en 2023, doit \u00eatre transpos\u00e9e dans chaque \u00c9tat membre d\u2019ici <strong data-start=\"702\" data-end=\"715\">juin 2026<\/strong>.<\/p>\n<p data-start=\"567\" data-end=\"1048\">Objectif : r\u00e9duire les \u00e9carts de r\u00e9mun\u00e9ration entre femmes et hommes, renforcer le droit \u00e0 l\u2019information, et instaurer une <strong data-start=\"842\" data-end=\"882\">culture de la transparence salariale<\/strong> au sein des entreprises europ\u00e9ennes.<\/p>\n<p data-start=\"567\" data-end=\"1048\">Derri\u00e8re un texte commun, trois logiques se distinguent : la France automatise, l\u2019Allemagne n\u00e9gocie, la Su\u00e8de applique d\u00e9j\u00e0.<\/p>\n<p><strong data-start=\"1064\" data-end=\"1106\">France : la transparence par la donn\u00e9e<\/strong><\/p>\n<p data-start=\"1108\" data-end=\"1607\">Avec son <strong data-start=\"1155\" data-end=\"1193\">Index de l\u2019\u00e9galit\u00e9 professionnelle<\/strong>, obligatoire pour les entreprises de plus de 50 salari\u00e9s, la France part avec une longueur d\u2019avance pour int\u00e9grer les exigences de la directive. Les donn\u00e9es issues de la <strong data-start=\"1336\" data-end=\"1376\">D\u00e9claration Sociale Nominative (DSN)<\/strong> serviront \u00e0 alimenter automatiquement les nouveaux indicateurs d\u2019\u00e9cart salarial, d\u2019\u00e9volution de carri\u00e8re et de r\u00e9mun\u00e9ration variable. Pour son lancement le seuil d\u2019application restera \u00e0 <strong data-start=\"1546\" data-end=\"1561\">50 salari\u00e9s<\/strong>, plus strict que le plancher europ\u00e9en de 100.<\/p>\n<p data-start=\"1609\" data-end=\"1725\">\ud83d\udc49 En 2024, plus de <strong data-start=\"1629\" data-end=\"1687\">78 % des entreprises fran\u00e7aises de plus de 50 salari\u00e9s<\/strong> publiaient d\u00e9j\u00e0 leur index \u00e9galit\u00e9.<\/p>\n<p data-start=\"1727\" data-end=\"1770\"><strong data-start=\"1727\" data-end=\"1768\">Solutions technologiques dominantes :<\/strong><\/p>\n<ul>\n<li data-start=\"1773\" data-end=\"1867\"><strong data-start=\"1773\" data-end=\"1782\">Beqom<\/strong> et <a href=\"https:\/\/www.frenchweb.fr\/seed-benchmark-salarial-figures-leve-68-millions-deuros-aupres-de-point-nine\/435313\" target=\"_blank\" rel=\"noopener\"><strong data-start=\"1786\" data-end=\"1800\">Figures HR<\/strong><\/a> : modules d\u2019audit d\u2019\u00e9quit\u00e9 salariale et sc\u00e9narios de correction.<\/li>\n<li data-start=\"1870\" data-end=\"1953\"><strong data-start=\"1870\" data-end=\"1884\"><a href=\"https:\/\/www.frenchweb.fr\/20-ans-apres-son-lancement-lucca-veut-faire-face-a-personio-et-factorial\/435751\" target=\"_blank\" rel=\"noopener\">Lucca<\/a> <\/strong>\u00a0et <strong data-start=\"1888\" data-end=\"1905\">ADP DataCloud<\/strong> : automatisation DSN et reporting conformit\u00e9.<\/li>\n<li data-start=\"1956\" data-end=\"2032\"><strong data-start=\"1956\" data-end=\"1977\">Portails salari\u00e9s<\/strong> : consultation anonymis\u00e9e des comparaisons internes.<\/li>\n<\/ul>\n<p data-start=\"2034\" data-end=\"2139\">Logique fran\u00e7aise : industrialiser la conformit\u00e9 par la donn\u00e9e, sans renoncer \u00e0 la granularit\u00e9 sociale.<\/p>\n<p><strong data-start=\"2155\" data-end=\"2195\">Allemagne : la transparence n\u00e9goci\u00e9e<\/strong><\/p>\n<p data-start=\"2197\" data-end=\"2701\">L\u2019Allemagne privil\u00e9gie la concertation. Le futur cadre juridique \u00e9tendra \u00e0 50 salari\u00e9s les obligations d\u00e9j\u00e0 en vigueur pour les entreprises de 150 employ\u00e9s et plus. Au-del\u00e0 de la publication des \u00e9carts, les employeurs devront conduire un <strong data-start=\"2437\" data-end=\"2455\">audit conjoint<\/strong> avec les repr\u00e9sentants du personnel lorsqu\u2019un \u00e9cart sup\u00e9rieur \u00e0 5 % ne peut \u00eatre justifi\u00e9. Le <strong data-start=\"2552\" data-end=\"2584\">minist\u00e8re f\u00e9d\u00e9ral du Travail<\/strong> estime que 30 % des entreprises ne respectent pas encore les obligations existantes, un d\u00e9fi \u00e0 corriger avant 2026.<\/p>\n<p data-start=\"2703\" data-end=\"2748\"><strong data-start=\"2703\" data-end=\"2746\">Solutions technologiques privil\u00e9gi\u00e9es :<\/strong><\/p>\n<ul>\n<li data-start=\"2751\" data-end=\"2853\"><strong data-start=\"2751\" data-end=\"2761\">Syndio<\/strong> et <strong data-start=\"2765\" data-end=\"2781\">PayAnalytics<\/strong> : plateformes de co-audit RH-syndicats, tra\u00e7abilit\u00e9 et justification.<\/li>\n<li data-start=\"2856\" data-end=\"2951\"><strong data-start=\"2856\" data-end=\"2878\">SAP SuccessFactors<\/strong> et <a href=\"https:\/\/www.frenchweb.fr\/workday-rachete-sana-pour-11-milliard-de-dollars-nouvelle-etape-de-la-consolidation-dans-la-hr-tech\/457129\" target=\"_blank\" rel=\"noopener\"><strong data-start=\"2882\" data-end=\"2893\">Workday<\/strong> <\/a>: reporting multi-filiales et consolidation europ\u00e9enne.<\/li>\n<li data-start=\"2954\" data-end=\"3036\"><strong data-start=\"2954\" data-end=\"2993\">Simulateurs de correction salariale<\/strong> : mod\u00e9lisation budg\u00e9taire sur 3 \u00e0 5 ans.<\/li>\n<\/ul>\n<p data-start=\"3038\" data-end=\"3144\">Logique allemande : encadrer la transparence par la pr\u00e9cision statistique et le dialogue institutionnel.<\/p>\n<p><strong data-start=\"3160\" data-end=\"3210\">Su\u00e8de : la transparence comme norme culturelle<\/strong><\/p>\n<p data-start=\"3212\" data-end=\"3683\">La Su\u00e8de est le pays le plus pr\u00e9par\u00e9. Depuis plus de dix ans, les entreprises y r\u00e9alisent un <strong data-start=\"3305\" data-end=\"3325\">l\u00f6nekartl\u00e4ggning, <\/strong>audit annuel obligatoire des salaires.
