Samsung Electronics America has filed a formal complaint with the U.S. Federal Maritime Commission (FMC), seeking at least $186 million in damages from CMA CGM over alleged unlawful demurrage and detention charges.<\/p>\n
The dispute centers on carrier-arranged inland transportation, including store-door deliveries, for cargo moving into the United States. According to Samsung\u2019s filing, CMA CGM repeatedly failed to meet its inland delivery obligations beginning in mid-2020, allegedly leaving containers at marine terminals or failing to deliver them to designated inland destinations within the required timeframes.<\/p>\n
Samsung claims the resulting delays were beyond its control but nevertheless triggered a substantial volume of storage and equipment-use charges from CMA CGM.<\/p>\n
According to the complaint, the electronics manufacturer was assessed more than 121,000 separate demurrage, detention and related accessorial charges that Samsung alleges stemmed directly from the carrier\u2019s inland transportation failures.<\/p>\n
CMA CGM allegedly attributed the delays to broader supply chain disruptions, including terminal congestion, chassis shortages and a lack of drayage drivers. Samsung, however, says the carrier rejected repeated requests to cancel, reduce or waive the charges.<\/p>\n
The manufacturer argues that the mounting fees placed significant pressure on its U.S. supply chain and threatened the efficiency of its distribution and retail operations.<\/p>\n
The case comes amid a broader wave of disputes between major beneficial cargo owners (BCOs) and ocean carriers over detention and demurrage billing practices following the implementation of the Ocean Shipping Reform Act (OSRA).<\/p>\n
Samsung\u2019s complaint was filed just days after the FMC approved a confidential settlement between Samsung and Wan Hai Lines involving similar disputes over container-related charges.<\/p>\n
CMA CGM has not publicly commented on the complaint.<\/p>\n
