He also maintained the proposed obligations fall squarely within accepted cultural policy rules.<\/p>\n<p>\u201cIt is agreed that no unjustified digital trade barriers will be erected. And we are adhering to that,\u201d the spokesperson said, adding that the investment obligations \u201cdo not constitute market access barriers\u201d and that the funds would flow directly into productions that streamers themselves can exploit commercially. \u201cThis is therefore not a levy or a tax.\u201d<\/p>\n<p>Kornelius also pointed to existing precedents, describing Germany\u2019s proposal as \u201cvery moderate by European standards.\u201d<\/p>\n<p>France <a href=\"https:\/\/www.arcom.fr\/en\/press\/regulator-integrates-main-international-smads-french-creative-financing-scheme\" target=\"_blank\" rel=\"nofollow noopener\">already requires<\/a> major streamers to invest at least 20 percent of local revenue into French and European productions, while Italy <a href=\"https:\/\/portolano.it\/en\/newsletter\/portolano-cavallo-inform-digital-ip\/italian-government-adopts-new-legislative-decree-amending-audiovisual-media-services-code\" target=\"_blank\" rel=\"nofollow noopener\">set its quota<\/a> at 16 percent  in 2024. Both operate under the <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/audiovisual-and-media-services\" target=\"_blank\" rel=\"nofollow noopener\">EU\u2019s Audiovisual Media Services Directive<\/a>, which allows member countries to require platforms to financially support European works, and mandates at least <a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/el\/qanda_20_1208\" target=\"_blank\" rel=\"nofollow noopener\">30 percent<\/a> of on-demand catalogs consist of European content.<\/p>\n<p>The dispute comes a week after Brussels <a href=\"https:\/\/www.politico.eu\/article\/eu-strikes-deal-implement-us-trump-trade-pact-negotiations-compromise\/\" rel=\"nofollow noopener\" target=\"_blank\">agreed to implement<\/a> the transatlantic trade pact struck at U.S. President Donald Trump\u2019s golf resort in Turnberry, Scotland last summer.<\/p>\n<p>Germany is not the only country facing Washington&#8217;s scrutiny over streaming quotas either.
