appeal against decision to throw out terror case against Kneecap rapper"},"content":{"rendered":"<p>Prosecutors in Britain will appeal against a court\u2019s decision to throw out the terrorism case against <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" href=\"https:\/\/www.irishexaminer.com\/maintopics\/kneecap_topic-5297704.html\">Kneecap<\/a> rapper Liam \u00d3g \u00d3 hAnnaidh.<\/p>\n<p>The 27-year-old was accused of displaying a flag in support of proscribed terrorist organisation Hezbollah at a gig in November last year until a technical error in the way he was charged led to the chief magistrate <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"\"\/>ruling he could not try the case<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"\"\/>.<\/p>\n<p class=\"\">Britain&#8217;s Crown Prosecution Service said in a short statement it would be appealing against the decision because \u201cwe believe there is an important point of law which needs to be clarified\u201d.<\/p>\n<p class=\"\">Following the hearing in which the case was dismissed, Mr \u00d3 hAnnaidh vowed the rap trio would \u201cnot be silenced\u201d.<\/p>\n<p class=\"\">Chief magistrate Paul Goldspring agreed with \u00d3 hAnnaidh\u2019s lawyers that prosecutors needed to seek the permission of the Attorney General to charge the rapper before informing him on May 21 that he would be charged with a terror offence.<\/p>\n<p class=\"\">It is understood the CPS\u2019s position is that permission only needed to be obtained before his first court hearing, which took place around a month later.<\/p>\n<p class=\"\">The decision to appeal the judgment comes as Attorney General Richard Hermer warned Robert Jenrick not to prejudice future proceedings against \u00d3 hAnnaidh, asking him to \u201ccarefully consider any further public comments\u201d.<\/p>\n<p class=\"\">Mr Jenrick had previously written to Mr Hermer calling for an urgent inquiry into the issue, claiming it \u201craised serious questions about the competence of all those involved\u201d.<\/p>\n<p class=\"\">The chief magistrate labelled the decision to charge \u00d3 hAnnaidh as \u201cunlawful\u201d as he dismissed the case while sitting at Woolwich Crown Court on September 26.<\/p>\n<p class=\"\">Prosecutors allege \u00d3 hAnnaidh can be seen in a recording of a gig at the O2 Forum in Kentish Town, north London, which shows him wearing and displaying the flag of Hezbollah while saying \u201cup Hamas, up Hezbollah\u201d.<\/p>\n<p class=\"\">After the hearing last month, he said: \u201cThis entire process was never about me.<\/p>\n<p class=\"\">\u201cIt was never about any threat to the public, it was never about terrorism \u2013 a word used by your government to discredit people you oppress.<\/p>\n<p class=\"\">\u201cIt was always about Gaza, about what happens if you dare to speak up.\u201d<\/p>\n<p class=\"\">In an interview with Virgin Media News, the rapper told the British prime minister \u201cbetter luck next time\u201d, adding: \u201cEven if it had went to court we would have won
