{"id":110707,"date":"2025-10-09T08:22:10","date_gmt":"2025-10-09T08:22:10","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/110707\/"},"modified":"2025-10-09T08:22:10","modified_gmt":"2025-10-09T08:22:10","slug":"man-sacked-for-saying-top-of-the-morning-to-ya-in-mock-irish-accent-wins-e18k-payout","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/110707\/","title":{"rendered":"Man sacked for saying &#8216;top of the morning to ya&#8217; in mock Irish accent wins \u20ac18k payout"},"content":{"rendered":"<p>An engineering storeman who was sacked for saying &#8216;top of the morning to ya&#8217; in a mock Irish accent while a red-headed auditor was present has won \u20ac18,500 for unfair dismissal.<img decoding=\"async\" src=\"https:\/\/www.europesays.com\/ie\/wp-content\/uploads\/2025\/10\/1_GettyImages-2224159336.jpg\" alt=\"He won more than \u00a316,000 (\u20ac18,500) for unfair dismissal (file photo)\" loading=\"eager\"  \/>He won more than \u00a316,000 (\u20ac18,500) for unfair dismissal (file photo)<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"irishmirror\">An engineering storeman sacked after saying to a colleague \u201ctop of the morning to ya\u201d in a <a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.irishmirror.ie\/news\/irish-news\/\" target=\"_self\" aria-label=\"\" tabindex=\"0\" rel=\"nofollow noopener\">mock Irish accent <\/a>has won more than \u00a316,000 (\u20ac18,500) for unfair dismissal.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"irishmirror\">Karl Davies, then 57, was working at Wrexham\u2019s Oscar Mayer ready meal manufacturing site when, on August 13 2024, he greeted a manager, Scott Millward, in the accent while listening to<a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.irishmirror.ie\/all-about\/music\" target=\"_self\" aria-label=\"\" tabindex=\"0\" rel=\"nofollow noopener\"> Irish music<\/a>, an employment tribunal heard.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"irishmirror\">Mr Millward had been escorting a \u201cred-headed\u201d external auditor when the remark was made and he reported his colleague to the <a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.irishmirror.ie\/all-about\/employment\" target=\"_self\" aria-label=\"\" tabindex=\"0\" rel=\"nofollow noopener\">employer<\/a>, who launched a probe into whether the comments amounted to racial harassment, the tribunal in Mold was told.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"irishmirror\">The claimant repeated the phrase multiple times, with tribunal Judge Vincent Ryan accepting that he was \u201ceffectively channelling the musical vibe\u201d.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"irishmirror\">The judge said that Mr Davies adopted an accent in a \u201creprehensible\u201d and \u201cmocking\u201d way and goaded Mr Millward by repeating the phrase \u201cin a manner that Mr Millward was bound to find irritating and embarrassing\u201d.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"irishmirror\">He said that the claimant was trying to get on Mr Millward\u2019s nerves to get a reaction from him and to cause him embarrassment.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"irishmirror\">He added: \u201cI find that the purpose was not to racially harass Mr Millward, and there is no evidence before me that it had the effect, either, on anyone. It was nevertheless blameworthy as (Mr Davies) was subordinate to Mr Millward. It gave rise to the disciplinary proceedings and therefore contributed to the eventual sanction.\u201d<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"irishmirror\">The claimant did not know and had not seen the auditor, who is not known or believed to be Irish, the tribunal heard.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"irishmirror\">A manager, against whom Mr Davies had an unresolved grievance, conducted the investigation into Mr Davies\u2019s comments, the tribunal was told.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"irishmirror\">The judge wrote that Oscar Mayer\u2019s disciplinary case was based on its perception that Mr Davies may have perceived that the auditor looked \u201ctypically Irish\u201d.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"irishmirror\">Mr Davies\u2019s phrase was found by his employer to amount to harassment, but neither his clean disciplinary record or 27 years of employment for the firm were taken into account, the judge found.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"irishmirror\">The tribunal ruled that the chosen investigator was not \u201cappropriate\u201d, witness statements were inconsistent and the probe was \u201clargely based on assumptions\u201d.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"irishmirror\">The judge said: \u201cThe claimant was accused of using an employment ending, reputation damaging, loss-inducing, racially motivated slur, a slur which could have created an intimidating, hostile, degrading, humiliating or offensive working environment;
