{"id":114637,"date":"2025-10-11T02:06:07","date_gmt":"2025-10-11T02:06:07","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/114637\/"},"modified":"2025-10-11T02:06:07","modified_gmt":"2025-10-11T02:06:07","slug":"tibetan-monk-challenges-refusal-of-asylum-application-in-ireland-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/114637\/","title":{"rendered":"Tibetan monk challenges refusal of asylum application in Ireland \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall b-it-article-body__text--left\">A Tibetan monk seeking asylum in Ireland is challenging the State\u2019s refusal to allow him remain in the country, claiming he fears he will be \u201cpersecuted and tortured\u201d in China.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The man, who cannot be named, appeared in the High Court on Friday morning and claims, through legal papers, that he left China for \u201cpolitical reasons\u201d.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">As a Tibetan monk, he said he is a symbol of \u201cthe Tibetan root of religion and culture\u201d. The man claims he was delayed in filing an appeal against the State\u2019s refusal to grant asylum due to extraordinary circumstances when the home of one of his legal team in Sudan was bombed.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">In papers submitted to the court by his legal team, Anthony Hanrahan SC and barrister Eoin Heffernan, the monk claims he left Tibet in April, 2016 and went to Nepal until September, 2024, before arriving in Ireland in October, 2024, when he applied for international protection.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">In January of this year, his application for asylum was rejected and he intended to appeal that decision to an appeals tribunal, he claims.<\/p>\n<p class=\"c-paragraph paywall \">The man is taking a legal challenge against the International Protection Appeals Tribunal (Ipat) and the Minister for Justice.<\/p>\n<p class=\"c-paragraph paywall \">In April, he was granted leave by the High Court to challenge Ipat\u2019s rejection of his application, which was refused under time-limit constraints.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The man had 15 days to submit his appeal in January  but claims there were extraordinary circumstances causing a delay in his application.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The man submits that a Sudanese legal secretary of his legal team was preparing a notice of appeal. He adds that she received notification that her family home in Sudan had been destroyed by an air strike and a close family friend had been killed in the attack.<\/p>\n<p class=\"c-paragraph paywall \">He submits that the woman was left in a state of shock and distress by the news and mistakenly believed she had submitted the notice of appeal in time.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The woman received further bad news in February when she was informed that her father was in intensive care and she left Ireland, returning in March.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">In March, Ipat refused an extension of time to file a challenge to deny him asylum. Ipat was asked to reconsider the application for the extension of time to submit a notice of appeal in light of new information supplied to them regarding the woman\u2019s circumstances.<\/p>\n<p class=\"c-paragraph paywall \">Later that month, Ipat notified the applicant\u2019s solicitors that the application could not be reconsidered and that \u201cthe tribunal does not have the jurisdiction to accept an appeal which it has already rejected\u201d.<\/p>\n<p class=\"c-paragraph paywall \">In papers submitted to the High Court, the man claims there were \u201csignificant\u201d extenuating circumstances warranting a reconsideration of Ipat\u2019s decision where discretion could have been exercised in granting an extension of time.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThe respondents have a wide discretion in managing the immigration and protection policies of the State,\u201d his legal team submitted.<\/p>\n<p class=\"c-paragraph paywall \">The application contends that there is nothing in law preventing Ipat from reconsidering an appeal that was already rejected.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">\u201cThere were significant extenuating circumstances which led to the applicant not submitting an appeal on time; and not providing adequate reasons at the first instance as to why an extension of time should be granted,\u201d it was submitted.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The case appeared before Ms Justice Siobh\u00e1n Phelan on Friday at the High Court, where she adjourned the matter to next week for an update.<\/p>\n","protected":false},"excerpt":{"rendered":"A Tibetan monk seeking asylum in Ireland is challenging the State\u2019s refusal to allow him remain in the&hellip;\n","protected":false},"author":2,"featured_media":114638,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[41],"tags":[9,10,13,14,6,10476,11,12,15,16,5,21767,7,8,65,66,67],"class_list":{"0":"post-114637","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-world","8":"tag-breaking-news","9":"tag-breakingnews","10":"tag-featured-news","11":"tag-featurednews","12":"tag-headlines","13":"tag-high-court","14":"tag-latest-news","15":"tag-latestnews","16":"tag-main-news","17":"tag-mainnews","18":"tag-news","19":"tag-tibet","20":"tag-top-stories","21":"tag-topstories","22":"tag-world","23":"tag-world-news","24":"tag-worldnews"},"share_on_mastodon":{"url":"","error":""},"_links":{"self":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts\/114637","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/comments?post=114637"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts\/114637\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/media\/114638"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/media?parent=114637"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/categories?post=114637"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/tags?post=114637"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
