{"id":122442,"date":"2025-10-14T23:44:07","date_gmt":"2025-10-14T23:44:07","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/122442\/"},"modified":"2025-10-14T23:44:07","modified_gmt":"2025-10-14T23:44:07","slug":"owner-management-companies-could-cost-state-e10bn-oireachtas-told-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/122442\/","title":{"rendered":"Owner management companies could cost State \u20ac10bn, Oireachtas told \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall b-it-article-body__text--left\">The cost of the <a href=\"https:\/\/www.irishtimes.com\/politics\/2023\/11\/02\/race-against-time-for-25bn-apartment-remediation-scheme-as-timeline-pushed-back\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/politics\/2023\/11\/02\/race-against-time-for-25bn-apartment-remediation-scheme-as-timeline-pushed-back\/\">State\u2019s remediation scheme for defective buildings<\/a>, estimated at \u20ac2.4 billion, will be dwarfed by a further \u20ac10 billion for multiple-unit developments where owners are not paying management fees and management companies are not providing a fund for issues such as replacing the roofs, lifts or windows. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">A campaign group has claimed legislation around multiple-unit developments \u2013 mostly apartment blocks but increasingly private housing estates \u2013 is the \u201cWild West of regulation\u201d. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">It is calling for reform of the 2011 Multiple Unit Developments (MUD) Act, arguing many management companies are facing insolvency. <\/p>\n<p class=\"c-paragraph paywall \">Calling itself the MUD Act Reform Group, the campaign also claims many owner management companies (OMCs) feature unqualified directors who are paying themselves large amounts of money in fees. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">On Tuesday, the group\u2019s co-ordinator, Pat Montague, told the <a href=\"https:\/\/www.irishtimes.com\/tags\/housing-committee\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/housing-committee\/\">Oireachtas Committee on Housing<\/a> that the ultimate cost of poor governance would be about \u20ac10 billion. This, he said, would make the estimated \u20ac2.5 billion cost of the defective building scheme \u201clook like a teddy bears\u2019 picnic\u201d. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">\u201cAt a very basic level, there is no proper register of owner management companies,\u201d he said. Mr Montague said he knew of one multiple-unit development where two directors of the management company paid themselves \u201c\u20ac80,000 and \u20ac90,000 a year respectively\u201d. <\/p>\n<p class=\"c-paragraph paywall \">He told TDs and Senators at Tuesday\u2019s hearing that management companies did not have \u201ceffective means for collecting annual service charges. The only way they can collect these monies is by taking costly and time-consuming court cases with no guarantee of success at the end of that process.\u201d<\/p>\n<p class=\"c-paragraph paywall \">In addition to not securing management fees from property owners, Mr Montague said \u201ctoo often\u201d shortfalls were made up by management companies raiding \u201csinking funds\u201d. <\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/politics\/2025\/10\/14\/owner-management-companies-could-cost-state-10bn-oireachtas-told\/Just 7% of applicants have had defective concrete homes fixed\" rel=\"nofollow noopener\" target=\"_blank\">Just 7% of applicants have had defective concrete homes fixed<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Sinking funds comprise a portion of management charges normally set aside for large maintenance schemes such as replacing lifts, roofs and windows, he said. \u201cBased on two reports in recent years by the <a href=\"https:\/\/www.irishtimes.com\/tags\/society-of-chartered-surveyors-ireland\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/society-of-chartered-surveyors-ireland\/\">Society of Chartered Surveyors Ireland<\/a>, sinking funds are hugely underfunded, which means that many developments simply can\u2019t undertake these necessary maintenance works,\u201d he said.<\/p>\n<p class=\"c-paragraph paywall \">He said new regulations around multiple-unit dwellings were formulated three years ago but responsibility for them needed to be transferred from the Department of Justice to the Department of Housing, and this had not happened. \u201cThe importance of the transfer is that, frankly, nothing can be done.
