{"id":122928,"date":"2025-10-15T05:09:08","date_gmt":"2025-10-15T05:09:08","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/122928\/"},"modified":"2025-10-15T05:09:08","modified_gmt":"2025-10-15T05:09:08","slug":"man-had-34-videos-of-highest-category-child-porn","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/122928\/","title":{"rendered":"Man had 34 videos of highest category child porn"},"content":{"rendered":"<p><strong>A Lithuanian man has avoided jail after he was found in possession of child sex abuse material.<\/strong><\/p>\n<p>Gedas Bertulia (34), who has an address in Mulhuddart, Dublin 15, appeared before the Circuit Criminal Court where Detective Garda Megan Fury gave details of the investigation that led to his detection and arrest.<\/p>\n<p>The court heard that in October 2022 the Garda Online Child Exploitation Unit became aware that child abuse images were being accessed from an address in Dublin 15.<\/p>\n<p>A search warrant was executed at 7:40am on the 28th of October at a home belonging to the accused\u2019s sister where 16 devices were examined before the offending material was discovered on one device.<\/p>\n<p>In all 34 videos of category 1 (the most extreme) child abuse material, and 5 videos of child exposure were discovered.<\/p>\n<p>The court heard that the shortest video of child sex abuse was 20 seconds in duration, while the longest was 1hr and 3 minutes.<\/p>\n<p>These videos depicted \u00a0\u201ca range\u201d of sexual abuse of children aged 5 to 13 years \u201cengaged in various sexual activities\u201d with adult males including penetrative and oral sex abuse.<\/p>\n<p>Bertulia was not at the address at the time, but returned when he became aware of the search where he \u201capologised\u201d for his behaviour.\u00a0<\/p>\n<p>He has 4 previous convictions for breaches of the Road Traffic Act including no insurance, driving over the alcohol limit, and no NCT. <\/p>\n<p>When being interviewed by Garda\u00ed, Bertulia admitted that he had downloaded \u201cunderage\u201d pornography and said that he was \u201cglad\u201d that he had been caught, saying he had an \u201caddiction\u201d and was \u201csick to my stomach\u201d of what he had done.<\/p>\n<p>\u201cI would like to apologise for my disgusting behaviour,\u201d he said.<\/p>\n<p>The court heard that Bertulia had wanted to become a policeman in his homeland, but had failed a health check before coming to Ireland and eventually working in construction.<\/p>\n<p>He has been here for 20 years, but during covid was \u201cdrinking a lot\u201d and was finishing in the region of 3 bottles of whisky over several days.<\/p>\n<p>Judge Martin Nolan asked counsel for the DPP if the case of Loving was still \u201cthe precedent\u201d, before receiving confirmation that it was.<\/p>\n<p>He said that the material was \u201cnot easily found\u201d and that the accused \u201cknew where to look\u201d. <\/p>\n<p>Taking into consideration the lack of aggravating factors such as relevant previous convictions, distribution, \u201cand other factors\u201d he explained that the court was bound to consider a suspended sentence.<\/p>\n<p>\u201cThis court doesn\u2019t work in a vacuum,\u201d he said, adding that the case before him was a \u201cnormal, unfortunately, child pornography case.\u201d<\/p>\n<p>He sentenced Bertulia to 2 and-a-half years which he suspended in full on condition of good behaviour, and that the accused enter into his own bond of \u20ac100.<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"A Lithuanian man has avoided jail after he was found in possession of child sex abuse material.
