{"id":126210,"date":"2025-10-16T16:52:11","date_gmt":"2025-10-16T16:52:11","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/126210\/"},"modified":"2025-10-16T16:52:11","modified_gmt":"2025-10-16T16:52:11","slug":"farmer-tom-niland-can-now-rest-in-peace-after-three-men-jailed-over-killing-family-say-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/126210\/","title":{"rendered":"Farmer Tom Niland \u2018can now rest in peace\u2019 after three men jailed over killing, family say \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall b-it-article-body__text--left\">Farmer Tom Niland \u201ccan now rest in peace\u201d, his family said after three men were jailed on Thursday for between 14 and 15 years for his unlawful killing.<\/p>\n<p class=\"c-paragraph paywall \">The sentences imposed by Mr Justice Paul McDermott were \u201cas fair as they could be\u201d, said Mr Niland\u2019s cousin, Michael Walsh, who described the deceased farmer as \u201ca gentle giant\u201d. <\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Mr Niland (75) died on September 30th 2023, 20 months after being attacked by the three in his west Sligo home on January 18th 2022.<\/p>\n<p class=\"c-paragraph paywall \">Mr Paul McDermott, imposing sentence, said this was a \u201ccowardly\u201d and unlawful killing \u201cof a savage kind\u201d, following a planned robbery of a defenceless elderly man in his own home \u201cwhere he was entitled to feel secure\u201d. <\/p>\n<p class=\"c-paragraph paywall \">The evidence was that John Irving, John Clarke and Francis Harman came together and planned and executed the robbery of Mr Niland, he said. They \u201cclearly understood he was alone\u201d, that was why he was targeted, and that he was \u201can elderly man who could be overcome\u201d.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThey wanted whatever money he had, were determined to extract it from him and he was beaten so badly he was unrecognisable by his neighbours and family.\u201d<\/p>\n<p class=\"c-paragraph paywall \">Mr Niland had not just suffered an awful attack, he had to endure \u201cvery real suffering\u201d for some 20 months afterwards and his family and friends were traumatised by witnessing that. <\/p>\n<p><img decoding=\"async\" data-chromatic=\"ignore\" alt=\"Tom Niland's cousin Michael Walsh outside the farmer's home, where he was attacked. Photo: Bryan O\u2019Brien \/ The Irish Times<\/p>\n<p class=\"c-paragraph paywall \">That was part of this crime and the level of responsibility for what the attackers did. <\/p>\n<p class=\"c-paragraph paywall \">Everyone, the judge said, is entitle to presume their home is safe and secure, the elderly are especially vulnerable to serious effects from attacks, \u201ceven if they survive\u201d. <\/p>\n<p class=\"c-paragraph paywall \">This \u201ccowardly attack\u201d must have been \u201cterrifying\u201d for Mr Niland who was brave enough, before he deteriorated, to give his account of what happened. That had \u201ca starkness and simplicity to it\u201d: he described hearing a knock at his door, opening it, seeing three men with their faces covered who pushed him back into the house, shouting \u2018where\u2019s the money\u2019. He said he told them there\u2019s no money, to get out and grabbed one by his right hand, but they hit him and \u201ckept punching and kicking me while I lay on the ground\u201d.<\/p>\n<p class=\"c-paragraph paywall \">Mr Niland had \u201cput it pithily\u201d, the judge said: \u201cThey gave me an awful doing.\u201d<\/p>\n<p class=\"c-paragraph paywall \">\u201cAnd they did,\u201d the judge said. <\/p>\n<p class=\"c-paragraph paywall \">Mr Niland, he said, was \u201cthe most central and important person\u201d in this case and he and his life \u201cshould not be defined by how he died but how he lived\u201d. He was warmly regarded by those who knew and loved him as was clear from victim impact statements.<\/p>\n<p class=\"c-paragraph paywall \">Having set the appropriate headline sentence towards 20 years, the judge jailed Irving (31), of Shanwar, Foxford, Co Mayo, who six days into his trial at the Central Criminal Court last July pleaded guilty to the manslaughter of Mr Niland, for 16 years, with the final year suspended on conditions.<\/p>\n<p class=\"c-paragraph paywall \">The judge took into account Irving\u2019s late admission of guilt and said this offence had \u201cmany attributes\u201d of a previous incident in 2013, involving two people, one of whom was then 19-year-old Irving, during which there was an attack on an elderly man in his home. Irving, who was convicted of burglary and criminal damage, had said he was outside the house in question.<\/p>\n<p class=\"c-paragraph paywall \">The judge also considered psychological reports on Irving, who has a long history of ADHD, drug and alcohol abuse, episodes of self-harm, and was diagnosed some years ago with schizo-affective disorder. Irving, who apologised for the attack on Mr Niland, has completed some programmes in prison to address his problems, he added.<\/p>\n<p class=\"c-paragraph paywall \">Francis Harman (58) of Nephin Court, Killala Road, Ballina, Co Mayo, and John Clarke (37) of Carrowkelly, Ballina, had pleaded guilty to manslaughter before the trial opened.<\/p>\n<p class=\"c-paragraph paywall \">Both were jailed for 15 years, with the final year suspended in each cases on conditions. <\/p>\n<p class=\"c-paragraph paywall \">The judge took into account their early pleas, expressions of remorse and their apologies to the family. All three will get credit for time already served in custody. <\/p>\n<p class=\"c-paragraph paywall \">In a statement afterwards on behalf of Mr Niland\u2019s family, Michael Walsh expressed their \u201cdeepest gratitude\u201d to An Garda S\u00edoch\u00e1na who \u201cpursued the criminals with unwavering relentless determination\u201d.
