{"id":134764,"date":"2025-10-20T21:48:10","date_gmt":"2025-10-20T21:48:10","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/134764\/"},"modified":"2025-10-20T21:48:10","modified_gmt":"2025-10-20T21:48:10","slug":"judge-orders-operator-of-unauthorised-carlow-quarry-to-restore-lands-to-prior-condition-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/134764\/","title":{"rendered":"Judge orders operator of unauthorised Carlow quarry to restore lands to prior condition \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall b-it-article-body__text--left\">The operators of an illegal quarry in <a href=\"https:\/\/www.irishtimes.com\/tags\/carlow\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/carlow\/\">Co Carlow<\/a> engaged in a \u201cmaterial, significant and gross breach\u201d of court orders in carrying out its unauthorised activities, a <a href=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\">High Court<\/a> judge has said.<\/p>\n<p class=\"c-paragraph paywall \">In a recent judgment, Mr Justice David Nolan ordered Hilltop Quarries Ltd and its director, David Condell, of Bilboa, Co Carlow, to remediate the damage done to the site by refilling craters created by the unauthorised activity.<\/p>\n<p class=\"c-paragraph paywall \">The orders follow proceedings brought against Hilltop and Mr Condell by Michael Bencik and Yvonne Nolan, a couple who live beside the site of the unauthorised quarry in Bilboa.<\/p>\n<p class=\"c-paragraph paywall \">In his judgment, Mr Justice Nolan noted it was admitted by Hilltop that there was unauthorised quarrying activity carried out on the lands since 2023.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\"><a href=\"https:\/\/www.irishtimes.com\/tags\/carlow-county-council\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/carlow-county-council\/\">Carlow County Council<\/a>, a notice party in the proceedings, wrote to Hilltop in August 2023 stating it was aware of the unauthorised quarry, and said in \u201cclear terms\u201d that such activity was against the law.<\/p>\n<p class=\"c-paragraph paywall \">Last July, the High Court ordered Hilltop and Mr Condell to stop carrying out unauthorised quarrying and related activities at the site.<\/p>\n<p class=\"c-paragraph paywall \">Despite this, Mr Justice Nolan noted, Hilltop intensified its activity at the site in a clear breach of the court\u2019s direction.<\/p>\n<p class=\"c-paragraph paywall \">The activity eventually stopped when Mr Bencik and Ms Nolan, represented by FP Logue Solicitors, brought a motion for the attachment and committal of the quarry operators. At this point, Mr Condell gave an undertaking to stop work at the site, the judge noted.<\/p>\n<p><img decoding=\"async\" alt=\"\" class=\"c-image audio_image\" src=\"https:\/\/www.europesays.com\/ie\/wp-content\/uploads\/2025\/08\/1754647931518-c07d65db-55b5-463e-ae51-976300c5837e.jpeg\"\/>Dublin Bus CEO on recruitment challenges, going electric, and stamping out anti-social behaviour <\/p>\n<p class=\"c-paragraph paywall \">Mr Bencik and Ms Nolan then dropped the attachment and committal motion, instead seeking orders for remediation of the lands to its prior condition.<\/p>\n<p class=\"c-paragraph paywall \">Prior to Mr Condell\u2019s operation, authorised quarrying had occurred at the site some years previously, but since then the land had become overgrown with trees and shrubs. \u201cNature had taken back the lands to its bosom,\u201d the judge noted.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Mr Justice Nolan said photographs from the site showed the Hilltop operation had \u201ccaused dramatic and detrimental damage to the lands\u201d.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">Counsel for Mr Condell made various submissions, including that he had the benefit of legal advice only from September last year, and that he was a man of limited education.<\/p>\n<p class=\"c-paragraph paywall \">On the latter submission, the judge said he did not accept the explanation: \u201cHe is a company director and has been able to operate what seems to be a very successful quarrying-type business for what seems to be a number of years.\u201d<\/p>\n<p class=\"c-paragraph paywall \">The judge said the \u201cextensive\u201d digging of a large quarry was a \u201cmaterial, significant and gross breach\u201d.<\/p>\n<p class=\"c-paragraph paywall \">\u201cBy destroying what nature had put in place, [Hilltop and Mr Condell] were carrying out a grave wrong,\u201d he said.<\/p>\n<p class=\"c-paragraph paywall \">The judge also noted that Mr Condell and his company showed an \u201cegregious attitude\u201d to planning control, and \u201cdoubled down\u201d on the operation in the face of a court order.<\/p>\n<p class=\"c-paragraph paywall \">These actions cannot be regarded as a mistake or indifference \u2013 they are \u201cculpable disregard,\u201d Mr Justice Nolan said.<\/p>\n<p class=\"c-paragraph paywall b-it-article-body__text--left\">The judge said his failing to order Hilltop to remediate the lands would equate to \u201crewarding them for their illegal behaviour\u201d.<\/p>\n<p class=\"c-paragraph paywall \">In the circumstances, he made the order directing Hilltop and Mr Condell to restore the lands to their prior condition before the commencement of the unauthorised quarrying.<\/p>\n","protected":false},"excerpt":{"rendered":"The operators of an illegal quarry in Co Carlow engaged in a \u201cmaterial, significant and gross breach\u201d of&hellip;\n","protected":false},"author":2,"featured_media":119895,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[73],"tags":[79,1845,80456,18,10476,19,17],"class_list":{"0":"post-134764","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-business","8":"tag-business","9":"tag-carlow","10":"tag-carlow-county-council","11":"tag-eire","12":"tag-high-court","13":"tag-ie","14":"tag-ireland"},"share_on_mastodon":{"url":"","error":""},"_links":{"self":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts\/134764","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/comments?post=134764"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts\/134764\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/media\/119895"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/media?parent=134764"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/categories?post=134764"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/tags?post=134764"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
