{"id":139409,"date":"2025-10-23T00:49:45","date_gmt":"2025-10-23T00:49:45","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/139409\/"},"modified":"2025-10-23T00:49:45","modified_gmt":"2025-10-23T00:49:45","slug":"judge-orders-immediate-return-of-books-removed-from-5-dod-schools","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/139409\/","title":{"rendered":"Judge orders \u2018immediate\u2019 return of books removed from 5 DOD schools"},"content":{"rendered":"<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">Six military families at five Defense Department schools notched a victory this week in getting library books returned to their schools\u2019 shelves.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\"> A federal judge ordered Monday that the five schools for military children must return library books that had been <a href=\"https:\/\/www.militarytimes.com\/education-transition\/2025\/04\/16\/students-sue-defense-department-over-book-bans-in-military-schools\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.militarytimes.com\/education-transition\/2025\/04\/16\/students-sue-defense-department-over-book-bans-in-military-schools\/\">removed for review<\/a> to comply with President Donald Trump\u2019s efforts to scrub diversity, equity and inclusion efforts from federal agencies.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">U.S. District Court Judge Patricia Tolliver Giles granted a preliminary injunction, requiring officials with the <a href=\"https:\/\/www.militarytimes.com\/pay-benefits\/military-benefits\/2025\/02\/04\/military-school-students-test-scores-lead-the-nation\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.militarytimes.com\/pay-benefits\/military-benefits\/2025\/02\/04\/military-school-students-test-scores-lead-the-nation\/\">Department of Defense Education Activity<\/a> to \u201cimmediately restore the library books and curricular materials that have been removed since January 19, 2025 \u2026 to their preexisting shelves, classrooms, and units\u201d at the five schools.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">The preliminary injunction also prevents officials at those schools from taking any further actions to remove educational books and curricular content in implementing Trump\u2019s executive orders while the court case continues.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">The schools are: Crossroads Elementary School at Quantico Marine Corps Base, Virginia; Barsanti Elementary School at Fort Campbell, Kentucky; Aviano Middle-High School, Italy; Sollars Elementary at Misawa Air Base, Japan; and Egdren Middle High School at Misawa Air Base.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">The American Civil Liberties Union, along with 12 students and six parents, filed a lawsuit in April against the DODEA, the director of DODEA and Secretary of Defense Pete Hegseth in federal court in the Eastern District of Virginia. <\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">The military families and the American Civil Liberties Union have asked for a permanent injunction to stop the activities.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">The families have shown \u201ca likelihood of success\u201d in proving that DODEA\u2019s actions violated the students\u2019 rights under the First Amendment, Judge Giles stated in her memorandum opinion, issued with the temporary injunction. <\/p>\n<p>RELATED<img decoding=\"async\" data-chromatic=\"ignore\" alt=\"\" class=\"c-image\" loading=\"lazy\" src=\"https:\/\/www.europesays.com\/ie\/wp-content\/uploads\/2025\/10\/AEJ34RNVVZHT5DQINPGR6UXCBI.jpg\"  width=\"5966\" height=\"3971\"\/><\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">The ruling does not apply to all DODEA schools. The DOD runs 161 military schools in 11 foreign countries, seven states, Guam and Puerto Rico. <\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">The judge denied the plaintiffs\u2019 request to apply it to DODEA schools worldwide, citing in part a Supreme Court decision this year that determined \u201cuniversal injunctions likely exceed the power Congress has granted to federal courts.\u201d<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">But while the injunction is limited to those five schools named in the lawsuit, the message is clear, according to an announcement by the ACLU: \u201cDoDEA\u2019s censorship of books and curriculum materials is unconstitutional.\u201d<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">Information was not available as of Wednesday about when DODEA will restore the books and the curricula at the five schools.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">\u201cAs this matter is still currently the subject of active litigation, we are unable to comment,\u201d DODEA spokeswoman Jessica Tackaberry said. <\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">The ACLU is considering options for expanding the scope of the injunction, said Emerson J. Sykes, senior staff attorney at ACLU\u2019s Speech, Privacy and Technology Project. The organization is also waiting for confirmation from DODEA that they are in compliance with the order, he said. Additional hearings in the case haven\u2019t yet been scheduled. <\/p>\n<p>596 titles censored<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">Among the censored items were materials about slavery, Native American history, women\u2019s history, LGBTQ identities and history and preventing sexual harassment and abuse, as well as parts of the Advanced Placement Psychology curriculum, such as the \u201cgender and sex\u201d module. Actions regarding the AP curriculum could affect students\u2019 performance on the AP exams, the students alleged, according to court documents.<\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">One of the students involved in the lawsuit alleged she wasn\u2019t allowed to present her research project on Maya Angelou after her school canceled Black History Month in compliance with DODEA\u2019s guidance for implementing Trump\u2019s executive orders. <\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">In their complaint, the families alleged their students are \u201cirreparably harmed\u201d by the removal of race, gender and some health curricula because of Trump\u2019s executive orders. <\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">The evidence in the case \u201coverwhelmingly suggests that the implementation of the book removal process has been inconsistent and opaque,\u201d Judge Giles stated. <\/p>\n<p class=\"Paragraph-sc-1tqpf5s-0 bFwqVI body-paragraph body-paragraph\">The judge ordered the full list of 596 titles being reviewed to be filed publicly.
