A 22-year old Tralee man, who has been charged in connection to the stabbing of a teenager on the Greenway, has been refused bail.<\/p>\n
Leon Gallagher (22) of Rock Park Avenue, Tralee was charged with assault causing harm and producing an article capable of inflicting serious injury at 9.20pm on Monday, October 20. <\/p>\n
He was arrested at the scene, the court was told. <\/p>\n
Garda\u00ed told the court that when cautioned Mr Gallagher replied:<\/p>\n
\u201cIt\u2019s not me but it\u2019s going to court anyway. I live in that area, it\u2019s a coincidence. I have a little brother, if someone touched him, I\u2019d freak. I knew something was going on, that\u2019s why I was around the area.\u201d<\/p>\n
The State objected to bail citing the \u201cdegree of violence displayed in this incident\u201d. <\/p>\n
They also argued that the accused had a \u201cpropensity to carry knives on his person\u201d.<\/p>\n
His solicitor, Padraig O\u2019Connell, noted his client had made no admissions.<\/p>\n
\u201cYou do accept the presumption of innocence?\u201d he asked the garda. <\/p>\n
He told the court he will apply for a mental health examination for Mr Gallagher.<\/p>\n
Judge David Waters refused bail for Mr Gallagher and remanded him in custody until October 28 when the accused will appear at Tralee District Court via video link.<\/p>\n
