{"id":150621,"date":"2025-10-29T01:57:09","date_gmt":"2025-10-29T01:57:09","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/150621\/"},"modified":"2025-10-29T01:57:09","modified_gmt":"2025-10-29T01:57:09","slug":"death-announced-of-mary-may-mcgee-who-won-historic-supreme-court-contraception-case-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/150621\/","title":{"rendered":"Death announced of Mary \u2018May\u2019 McGee who won historic Supreme Court contraception case \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">Mary \u2018May\u2019 McGee, whose 1973 <a href=\"https:\/\/www.irishtimes.com\/tags\/supreme-court\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/supreme-court\/\">Supreme Court<\/a> case taken alongside her husband Seamus \u2018Shay\u2019 and which effectively overturned a 1935 ban on the sale of contraceptives, has died. <\/p>\n<p class=\"c-paragraph paywall \">Ms McGee, known as May, passed away peacefully at <a href=\"https:\/\/www.irishtimes.com\/tags\/beaumont-hospital\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/beaumont-hospital\/\">Beaumont Hospital<\/a> in <a href=\"https:\/\/www.irishtimes.com\/tags\/dublin\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/dublin\/\">Dublin<\/a> on Tuesday, surrounded by her family. Shay died in January 2024. A celebration of her life is to be held in Dardistown Crematorium on Saturday. <\/p>\n<p class=\"c-paragraph paywall \">As well as overturning the 1935 Act which prohibited the importation of contraceptive devices, the ruling paved the way for vastly improved reproductive choice for women. The case has also been seen as a turning point in society\u2019s perception of the separation of the roles of church and State. <\/p>\n<p class=\"c-paragraph paywall \">In the early 1970s the couple were the parents of four children. Their second and third pregnancies had been complicated by severe cerebral thrombosis and Ms McGee had also suffered a stroke and temporary paralysis. The couple were advised by their GP that Ms McGee\u2019s life would be endangered by future pregnancies. She was then instructed to use a diaphragm and spermicidal jelly that were prescribed to her.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/life-style\/people\/2025\/08\/30\/we-were-condemned-from-the-altar-i-never-went-back-the-woman-who-fought-for-contraception-and-won\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">We were condemned from the alter Opens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">However, these had to be imported and were seized by customs. The couple were told that if they attempted to import contraceptive devices again, they could be prosecuted. <\/p>\n<p class=\"c-paragraph paywall \">Their legal challenge to the law was struck down by the High Court in 1972. Amid large-scale publicity, the couple appealed to the Supreme Court. <\/p>\n<p><img decoding=\"async\" data-chromatic=\"ignore\" alt=\"Mary 'May' and Seamus 'Shay' McGee, pictured on their wedding day \" class=\"c-image\" loading=\"lazy\" src=\"https:\/\/www.europesays.com\/ie\/wp-content\/uploads\/2025\/10\/PJYXUZVIVX2GIXTXX2N3JTIE4M.jpg\"   width=\"800\" height=\"450\"\/>Mary &#8216;May&#8217; and Seamus &#8216;Shay&#8217; McGee, pictured on their wedding day  <\/p>\n<p class=\"c-paragraph paywall \">On December 19th 1973, the Supreme Court ruled by a four-to-one majority in favour of the McGees, after determining that married couples have the constitutional right to make private decisions on family planning. <\/p>\n<p class=\"c-paragraph paywall \">This August, aged 81, a mosaic was unveiled in Ms McGee\u2019s honour in her hometown of Skerries, Co Dublin. In an interview with The Irish Times she recalled: \u201cWe were condemned from the altar. They said, \u2018Certain people in this parish have brought the church into disrepute\u2019. So we all got up and walked out. I never went back again.\u201d <\/p>\n<p class=\"c-paragraph paywall \">Since then, much has changed surrounding reproductive rights in Ireland. With the repeal of the Eighth Amendment during the referendum in May 2018, the near-total ban on abortion in the State ended.<\/p>\n<p class=\"c-paragraph paywall \">More recently, the Free Contraception Scheme allows women aged 17 to 35 access contraception with ease. \u201cThat\u2019s great.
