{"id":152547,"date":"2025-10-30T02:37:08","date_gmt":"2025-10-30T02:37:08","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/152547\/"},"modified":"2025-10-30T02:37:08","modified_gmt":"2025-10-30T02:37:08","slug":"court-dismisses-garda-appeal-over-malicious-prosecution-of-two-brothers-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/152547\/","title":{"rendered":"Court dismisses garda appeal over malicious prosecution of two brothers \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">The <a href=\"https:\/\/www.irishtimes.com\/tags\/court-of-appeal\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/court-of-appeal\/\">Court of Appeal<\/a> (CoA) has dismissed an appeal against awards of \u20ac95,000 each to two Italian brothers who <a href=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2024\/05\/03\/italian-brothers-awarded-95000-after-they-were-mistakenly-arrested-for-grafton-street-handbag-theft\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2024\/05\/03\/italian-brothers-awarded-95000-after-they-were-mistakenly-arrested-for-grafton-street-handbag-theft\/\">a jury found were maliciously prosecuted by garda\u00ed<\/a> following their mistaken arrest over an alleged handbag theft in Dublin.<\/p>\n<p class=\"c-paragraph paywall \">Marco Gambucci, who runs a real estate business in Sardinia, and his brother Luca, a public servant in Perugia, sued Pearse Street, Dublin-based then Garda, now Sgt Daniel Barry, and Garda Jonathan Petrie as well as the Garda Commissioner and the State. <\/p>\n<p class=\"c-paragraph paywall \">The brothers were living in Dublin at the time of the incident on May 18th, 2008, but have since returned to Italy.<\/p>\n<p class=\"c-paragraph paywall \">The court heard they were arrested when garda\u00ed were investigating an attempted handbag theft from a woman in Grafton Street.<\/p>\n<p class=\"c-paragraph paywall \">The brothers claimed that after boarding the Luas at St Stephen\u2019s Green, garda\u00ed Barry and Petrie violently grabbed them and pulled them from the tram. They said they were then assaulted, violently pushed on to the pavement and handcuffed. <\/p>\n<p class=\"c-paragraph paywall \">They also claimed the garda\u00ed, who were in plainclothes, never identified themselves, but this was denied by the defendants.<\/p>\n<p class=\"c-paragraph paywall \">They were put in a Garda van and, during the journey to Pearse Street, they said they were punched, slapped and kicked. At the station, they claimed they were beaten and slapped again before being put in a cell. <\/p>\n<p class=\"c-paragraph paywall \">They also said they were refused legal and medical assistance. After three hours they were allowed a phone call and were released when two work colleagues came to the station and identified them.<\/p>\n<p class=\"c-paragraph paywall \">The next day the two garda\u00ed went to Luca\u2019s workplace and told him there had been a mistake and it was not their intention to harm him. It was claimed Luca was told not to make a complaint or he would also be charged with assault.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2024\/05\/03\/italian-brothers-awarded-95000-after-they-were-mistakenly-arrested-for-grafton-street-handbag-theft\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Brothers awarded \u20ac95,000 each over mistaken arrest for Grafton Street handbag theftOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">They had been charged with theft, and when the case first came before the District Court it was indicated an assault charge was to follow. However, when the case came back before the court, the garda\u00ed failed to attend and the case against the brothers was eventually struck out.<\/p>\n<p class=\"c-paragraph paywall \">They say the decision to charge them with theft, and the continuance of the case beyond a time when the garda\u00ed knew they were never involved in the alleged offence, was a malicious prosecution. <\/p>\n<p class=\"c-paragraph paywall \">Following a civil trial last year lasting seven days and running over two weeks, a jury of eight women and four men found the prosecution of the brothers was instituted and maintained for the improper purpose of dissuading them from seeking legal redress for their treatment by the garda\u00ed.<\/p>\n<p class=\"c-paragraph paywall \"><a href=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2024\/05\/03\/italian-brothers-awarded-95000-after-they-were-mistakenly-arrested-for-grafton-street-handbag-theft\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2024\/05\/03\/italian-brothers-awarded-95000-after-they-were-mistakenly-arrested-for-grafton-street-handbag-theft\/\">They awarded Marco \u20ac95,000 and Luca \u20ac95,317<\/a> (inclusive of agreed special damages) for malicious prosecution. <\/p>\n<p class=\"c-paragraph paywall \">The jury found the garda\u00ed did not forcibly remove them from the Luas and that the garda\u00ed did not honestly believe the case being made  in prosecuting them for attempting to steal the woman\u2019s handbag in Grafton Street.<\/p>\n<p class=\"c-paragraph paywall \">The jury answered \u2018No\u2019 to a question asking if the brothers had been assaulted. <\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2025\/10\/29\/kerry-man-with-locked-in-syndrome-sues-over-brain-scan\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Kerry man with locked-in syndrome sues over brain scanOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">The defendants appealed against a number of rulings and conduct of the trial by the judge, Mr Justice Alexander Owens, and also against the amount of damages awarded.
