<a href=\"https:\/\/www.irishtimes.com\/tags\/luke-comer\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/luke-comer\/\">Luke Comer<\/a> has filed a court application aimed at serving legal papers on the billionaire businessman in <a href=\"https:\/\/www.irishtimes.com\/tags\/monaco\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/monaco\/\">Monaco<\/a>.<\/p>\n<p class=\"c-paragraph paywall \">The application by <a href=\"https:\/\/www.irishtimes.com\/tags\/jim-gorman\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/jim-gorman\/\">Jim Gorman<\/a>, himself a licensed horse trainer, is expected to come before the <a href=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\">High Court<\/a> ex parte (only one side would be represented) on Monday.<\/p>\n<p class=\"c-paragraph paywall \">Mr Gorman needs permission from the court to serve his application out of the jurisdiction on Mr Comer in Monaco, where he is resident for tax purposes.<\/p>\n<p class=\"c-paragraph paywall \">It is believed Mr Gorman\u2019s application, also taken against two Irish-based companies of Mr Comer\u2019s, relates to correspondence sent by lawyers for Mr Comer to Mr Gorman.<\/p>\n<p class=\"c-paragraph paywall \">On July 15th, 2024, <a href=\"https:\/\/www.irishtimes.com\/sport\/racing\/2024\/07\/01\/luke-comer-weighing-up-options-after-failed-appeal-against-three-year-suspension-of-trainers-licence\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/sport\/racing\/2024\/07\/01\/luke-comer-weighing-up-options-after-failed-appeal-against-three-year-suspension-of-trainers-licence\/\">Mr Comer began a three-year suspension<\/a> imposed by the <a href=\"https:\/\/www.irishtimes.com\/tags\/irish-horseracing-regulatory-board\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/irish-horseracing-regulatory-board\/\">Irish Horseracing Regulatory Board<\/a> (IHRB) following the largely unsuccessful outcome of his appeal against punishments relating to doping in horse racing.<\/p>\n<p class=\"c-paragraph paywall \">Twelve of his horses had tested positive for anabolic steroids following an inspection in November 2021. <\/p>\n<p class=\"c-paragraph paywall \">In its <a href=\"https:\/\/www.irishtimes.com\/sport\/racing\/2023\/09\/14\/billionaire-trainer-luke-comer-banned-for-doping-offences\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/sport\/racing\/2023\/09\/14\/billionaire-trainer-luke-comer-banned-for-doping-offences\/\">original ruling in 2023<\/a>, the referrals committee of the IHRB did not find direct evidence of deliberate doping, but found Mr Comer responsible for serious rule breaches in the absence of any other plausible explanation for the adverse findings.<\/p>\n<p class=\"c-paragraph paywall \">Mr Comer admitted that traces of prohibited substances were found to be present in the horses, but he strongly denied that either he or any of his staff were involved in doping the animals.<\/p>\n<p class=\"c-paragraph paywall \">He suggested \u201cenvironmental contamination\u201d could be to blame and pointed to the possibility of contaminated hay, but the committee found evidence on that issue \u201cdifficult\u201d to evaluate. <\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" href=\"https:\/\/www.irishtimes.com\/sport\/racing\/2024\/06\/27\/trainer-luke-comer-loses-appeal-against-three-year-licence-suspension-for-doping-offences\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/sport\/racing\/2024\/06\/27\/trainer-luke-comer-loses-appeal-against-three-year-licence-suspension-for-doping-offences\/\">subsequent appeal<\/a> to the appeals body of the IHRB was largely dismissed. <\/p>\n<p class=\"c-paragraph paywall \">It ruled the withdrawal of his trainer\u2019s licence would take effect from July 15th, 2024. Mr Comer also faced having to pay about \u20ac80,000 in fines and legal costs estimated at  \u20ac755,000. <\/p>\n<p class=\"c-paragraph paywall \">The appeals body withdrew a punishment in relation to maintaining the good reputation of horse racing but did not dismiss its finding.<\/p>\n<p class=\"c-paragraph paywall \">Mr Comer\u2019s appeal of a finding he had given misleading evidence to the referrals committee was upheld on grounds of procedural fairness, and the \u20ac5,000 fine imposed was set aside.
