{"id":162248,"date":"2025-11-04T12:12:08","date_gmt":"2025-11-04T12:12:08","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/162248\/"},"modified":"2025-11-04T12:12:08","modified_gmt":"2025-11-04T12:12:08","slug":"dj-carey-sentence-underlines-courts-increasing-will-to-jail-fraudsters-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/162248\/","title":{"rendered":"DJ Carey sentence underlines courts\u2019 increasing will to jail fraudsters \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \"><a href=\"https:\/\/www.irishtimes.com\/tags\/dj-carey\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/dj-carey\">DJ Carey<\/a>\u2019s <a href=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2025\/11\/03\/former-kilkenny-hurler-dj-carey-jailed-for-five-and-a-half-years-for-reprehensible-fraud\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2025\/11\/03\/former-kilkenny-hurler-dj-carey-jailed-for-five-and-a-half-years-for-reprehensible-fraud\/\">five-and-a-half-year prison sentence<\/a> over a \u201creprehensible\u201d cancer fraud underlines the increasing willingness of the courts to impose custodial sentences for fraud and forgery offences.<\/p>\n<p class=\"c-paragraph paywall \">When jailing the former Kilkenny hurler at <a href=\"https:\/\/www.irishtimes.com\/tags\/circuit-criminal-court\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/circuit-criminal-court\/\">Dublin Circuit Criminal Court<\/a> on Monday, Judge <a href=\"https:\/\/www.irishtimes.com\/tags\/martin-nolan\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/martin-nolan\">Martin Nolan<\/a> slammed the nature of Carey\u2019s offending. <\/p>\n<p class=\"c-paragraph paywall \">Most fraud cases seek to exploit people\u2019s greed but, in extorting almost \u20ac400,000 from 22 people to fund treatment for a cancer he did not have, Carey was exploiting their good nature, the judge said. <\/p>\n<p class=\"c-paragraph paywall \">Before the landmark case of businessman Paul Begley in 2012, white collar crimes did not traditionally attract prison sentences. <\/p>\n<p class=\"c-paragraph paywall \">Begley was jailed by Judge Nolan for six years after avoiding paying customs duty on more than 1,000 tonnes of Chinese garlic by having it labelled as apples. Begley, the judge said, engaged in a \u201cgrave\u201d and \u201chuge\u201d tax evasion scheme.<\/p>\n<p class=\"c-paragraph paywall \">The sentence was <a href=\"https:\/\/www.irishtimes.com\/news\/crime-and-law\/garlic-smuggler-released-early-from-prison-1.1339440\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/news\/crime-and-law\/garlic-smuggler-released-early-from-prison-1.1339440\">reduced to two years on appeal,<\/a> for reasons including Begley\u2019s co-operation with the investigation, repayment of the \u20ac1.6 million tax owed and admission of tax evasion. <\/p>\n<p class=\"c-paragraph paywall \">In 2014, businessman Breifne O\u2019Brien was <a href=\"https:\/\/www.irishtimes.com\/business\/financial-services\/breifne-o-brien-sentenced-to-seven-years-in-jail-1.1955959\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/business\/financial-services\/breifne-o-brien-sentenced-to-seven-years-in-jail-1.1955959\">jailed for seven years<\/a> by Judge Patricia Ryan at Dublin Circuit Criminal Court for dishonestly inducing five people to advance millions of euro to him for investment in bogus property deals and a bogus linen shipping insurance scheme.<\/p>\n<p class=\"c-paragraph paywall \">O\u2019Brien, with an address at Monkstown Grove, Monkstown, Co Dublin, admitted 14 sample counts of making a gain or causing a loss by deception or theft of about \u20ac8.5 million between 2003 and 2008.<\/p>\n<p class=\"c-paragraph paywall \">In what was described in court as \u201ca classic pyramid scheme\u201d, he used money from friends and acquaintances for investment in property and businesses in Ireland and abroad for himself. <\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/sport\/gaelic-games\/2025\/11\/04\/his-good-name-will-probably-never-recover-dj-carey-faces-five-and-a-half-years-in-prison\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">\u2018His good name will probably never recover\u2019: DJ Carey begins 5\u00bd years in prisonOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">O\u2019Brien\u2019s appeal over the severity of his sentence was dismissed. When <a href=\"https:\/\/www.irishtimes.com\/business\/commercial-property\/fraudster-breifne-o-brien-bankrupt-high-court-rules-1.2733793\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/business\/commercial-property\/fraudster-breifne-o-brien-bankrupt-high-court-rules-1.2733793\">adjudicated bankrupt in 2016<\/a> on his own petition, it was estimated he owed  \u20ac40 million.<\/p>\n<p class=\"c-paragraph paywall \">Guidance published in 2022 by the <a href=\"https:\/\/www.irishtimes.com\/tags\/judicial-council\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/judicial-council\/\">Judicial Council<\/a> concerning tax and welfare fraud cases is regarded as being a significant influence on  sentencing.<\/p>\n<p class=\"c-paragraph paywall \">That guidance says judges should have regard to sentencing guidelines in a  Court of Appeal judgment in a 2018 case, DPP v Maguire, related to fraud and forgery offences over 14 years involving a loss of \u20ac1.18 million.<\/p>\n<p class=\"c-paragraph paywall \">In that decision, the court said a non-custodial sentence was not to be the starting point in any case. <\/p>\n<p class=\"c-paragraph paywall \">A \u201crigorous analysis\u201d of the circumstances of the wrongdoer is necessary to devise a just and proportionate sentence, it said. Judicial discretion had a specific role in determining the gravity of the offence, extent of mitigation, and how the pursuit of the recognised objectives of sentencing \u2013 including deterrence and rehabilitation \u2013 should be balanced in individual cases.<\/p>\n<p class=\"c-paragraph paywall \">The guidance set  specific parameters for appropriate custodial sentences in tax and fraud offences. Offences regarded as in the low range of seriousness may attract a headline sentence of zero to 40 months, it suggested, increasing to 81-120 months for offences in the high range of seriousness. Aggravating factors for the most serious offences could include if the motive was \u201cclearly criminal\u201d or the offence was \u201ccarefully planned\u201d. <\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/sport\/gaelic-games\/2025\/11\/03\/the-downfall-of-dj-carey-rumours-riches-and-a-staggering-mesh-of-fact-and-fiction\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">The downfall of DJ Carey: Rumours, riches and a staggering mesh of fact and fictionOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">In 2023, Judge Martin Nolan imposed a two-year sentence <a href=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2023\/01\/24\/credit-union-manager-who-stole-875405-to-help-save-her-husbands-failing-business-is-jailed\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2023\/01\/24\/credit-union-manager-who-stole-875405-to-help-save-her-husbands-failing-business-is-jailed\/\">on Anne Butterly<\/a> (66), a former manager of Rush Credit Union, who pleaded guilty to a sample set of charges arising from her theft of approximately \u20ac875,405 from the credit union over a seven-year period. <\/p>\n<p class=\"c-paragraph paywall \">Butterly, who said she took the money to help save her husband\u2019s failing business, had no previous convictions, had since sold the family farm lands and repaid the credit union in full.<\/p>\n<p class=\"c-paragraph paywall \">Judge Nolan said there was \u201cclear mitigation\u201d, but  from the perspective of punishment and deterrence, the nature of the offences required a custodial sentence.<\/p>\n<p class=\"c-paragraph paywall \">An effective prison term of one year was imposed by Judge Dara Hayes in a separate case in 2023 on <a href=\"https:\/\/www.irishtimes.com\/tags\/david-stamper\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/david-stamper\/\">David Stamper<\/a> (68), who pleaded guilty to 82 counts of forgery, theft and money laundering involving Citybus Employees Credit Union over a six-year period. <\/p>\n<p class=\"c-paragraph paywall \">Stamper, the former chair of its board of directors, misappropriated more than  \u20ac100,000 from the credit union resulting in its closure in 2019. He submitted in mitigation his efforts to pay back the money and having no previous convictions. <\/p>\n<p class=\"c-paragraph paywall \">Judge Hayes said a custodial sentence was necessary due to the significant breach of trust and long period of offending. He imposed a sentence of two-and-a-half years, with the last 18 months suspended. <\/p>\n<p class=\"c-paragraph paywall \">Last June, Mary Higgins (63) of Hawthorn Lane, Castleknock, a bursar of a private secondary school, Mount Sackville Secondary School in Chapelizod, Dublin, was <a href=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2025\/06\/19\/she-was-living-a-double-life-bursar-of-private-secondary-school-jailed-for-stealing-500000\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2025\/06\/19\/she-was-living-a-double-life-bursar-of-private-secondary-school-jailed-for-stealing-500000\/\">jailed for one year for stealing \u20ac500,000 <\/a>from the school between 2012 and 2017 to fund a gambling addiction.<\/p>\n<p class=\"c-paragraph paywall \">Judge Orla Crowe said, despite mitigation, including Higgins repaying more than \u20ac470,000 from selling her home and signing over her pension, the \u201cegregious breach of trust\u201d had to be marked with a custodial sentence.
