{"id":174430,"date":"2025-11-11T05:48:13","date_gmt":"2025-11-11T05:48:13","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/174430\/"},"modified":"2025-11-11T05:48:13","modified_gmt":"2025-11-11T05:48:13","slug":"taxi-driver-convicted-of-assault-fails-in-appeal-claiming-jury-lunches-meant-they-dined-with-the-state-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/174430\/","title":{"rendered":"Taxi driver convicted of assault fails in appeal claiming jury lunches meant they \u2018dined with the State\u2019 \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">A taxi driver, who assaulted a security guard after his car was clamped, has failed to persuade the <a href=\"https:\/\/www.irishtimes.com\/tags\/court-of-appeal\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/court-of-appeal\/\">Court of Appeal<\/a> that his trial was unfair because the jury\u2019s subsidised lunches meant they \u201cdined with the State\u201d.<\/p>\n<p class=\"c-paragraph paywall \">Rejecting Feliks Andrianov\u2019s appeal against his conviction on Monday, Mr Justice Peter Charleton said that the submissions made \u201cdefy sense\u201d.<\/p>\n<p class=\"c-paragraph paywall \">The incident in question involved an \u201cenraged attack\u201d on a person \u201cfulfilling a difficult duty\u201d, the judge said.<\/p>\n<p class=\"c-paragraph paywall \">He said Andrianov had demonstrated \u201cno insight\u201d into his behaviour and \u201cno empathy\u201d for the victim he had attacked and harmed.<\/p>\n<p class=\"c-paragraph paywall \">The judge said on \u201cno rational analysis\u201d could the fact that jurors were provided with tea and coffee and a \u201cmodest voucher\u201d to keep their energies up at lunchtime be perceived as creating bias.<\/p>\n<p class=\"c-paragraph paywall \">Andrianov (55), who represented himself, had argued that his actions were a \u201cproportionate response to an unjust clamping enforcement\u201d and that the trial judge displayed a bias towards him by making him view bodycam footage of the assault. <\/p>\n<p class=\"c-paragraph paywall \">Following his trial at the Dublin Circuit Criminal Court in July last year, Andrianov, of Corduff Green, Blanchardstown, Dublin, was unanimously found guilty of assault causing harm at McDonald\u2019s restaurant, Dublin Airport on July 5th, 2019. He denied the charge and has no previous convictions. <\/p>\n<p class=\"c-paragraph paywall \">He was sentenced by Ms Justice Elma Sheahan in November 2024 to 18 months in prison, suspended for 18 months. <\/p>\n<p class=\"c-paragraph paywall \">At the sentencing hearing, Gda Paul Murphy gave evidence that the injured party Michael Norris, who was working at the McDonald\u2019s restaurant located across from Dublin Airport, saw a taxi driver park his car and leave the area to go to Circle K. <\/p>\n<p class=\"c-paragraph paywall \">Signs stating that cars parked in the location would be clamped were posted throughout the area. <\/p>\n<p class=\"c-paragraph paywall \">Mr Norris proceeded to clamp the vehicle, before Andrianov returned to his car and was informed that the car park was for McDonald\u2019s customers only. Mr Norris then turned on his body cam. The court heard that Andrianov looked down at the body cam, put his hand over it and instigated an altercation by grabbing Mr Norris. <\/p>\n<p class=\"c-paragraph paywall \">The security worker noticed that his left shoulder was injured, and he was unable to move it. He was treated at Beaumont Hospital, with an X-ray showing he had a dislocated left shoulder. <\/p>\n<p class=\"c-paragraph paywall \">During questioning, Andrianov told garda\u00ed that he had been struck first by the security guard.
