{"id":190554,"date":"2025-11-20T10:25:08","date_gmt":"2025-11-20T10:25:08","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/190554\/"},"modified":"2025-11-20T10:25:08","modified_gmt":"2025-11-20T10:25:08","slug":"pharma-giant-gave-irish-employee-three-months-to-come-up-with-e20800-to-cover-alleged-overpayment-wrc-hears-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/190554\/","title":{"rendered":"Pharma giant gave Irish employee three months to come up with \u20ac20,800 to cover alleged \u2018overpayment\u2019, WRC hears \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">An error at pharma giant <a href=\"https:\/\/www.irishtimes.com\/tags\/bristol-myers-squibb\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/bristol-myers-squibb\/\">Bristol Myers Squibb<\/a> left bosses attempting to dock tens of thousands of euro from nearly a dozen Irish staff the firm says weren\u2019t meant to be getting paid parental leave, a tribunal has heard.<\/p>\n<p class=\"c-paragraph paywall \">A barrister acting for the multinational told the <a href=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/workplace-relations-commission\/\">Workplace Relations Commission<\/a> (WRC) on Wednesday it \u201cobviously was ridiculous\u201d that the company gave one employee just three months to come up with \u20ac20,800 to cover an alleged \u201coverpayment\u201d by year-end. <\/p>\n<p class=\"c-paragraph paywall \">In a complaint under the Payment of Wages Act 1991, the employee, Adrienne Doyle, a mother of two from Ashbourne, Co Meath, is challenging the legality of the company\u2019s decision to  deduct her salary by \u20ac870 a month over two years. <\/p>\n<p class=\"c-paragraph paywall \"> Ms Doyle told the WRC she was absent from work on maternity leave in October 2023, when the company announced a programme called \u201cBristol Myers Squibb Ireland Reimagined\u201d. <\/p>\n<p class=\"c-paragraph paywall \"> She said she dialled in remotely to a \u201ctown hall\u201d meeting on the new programme, when one of a  range of staff benefits announced was an \u201cenhanced\u201d entitlement to paid parents\u2019 leave. <\/p>\n<p class=\"c-paragraph paywall \">A top-up to the statutory parental leave entitlement \u2013 worth between \u20ac260 and \u20ac270 at the time \u2013 would ensure staff at  the firm with children under two could remain on their full pay, Ms Doyle said. <\/p>\n<p class=\"c-paragraph paywall \">While the statutory leave was capped at seven weeks off at the time, Bristol Myers Squibb was offering 12 weeks off, she said. <\/p>\n<p class=\"c-paragraph paywall \">Ms Doyle said she logged into the  human resources portal on  January 9th, 2024, and applied for seven weeks off, with the leave being approved by her manager, Cornelius Pretorius, and by the company\u2019s people services department. <\/p>\n<p class=\"c-paragraph paywall \">She said she later extended the leave from seven weeks to 12. Her youngest child had been a year old at the time of the town hall meeting in October 2023, she said. <\/p>\n<p class=\"c-paragraph paywall \">\u201cThat criteria wasn\u2019t published at the time of my application nor the time of my leave approval,\u201d she said, adding that there had been no reference to it in material she had consulted on the company portal or at the meeting. <\/p>\n<p class=\"c-paragraph paywall \">\u201cI wouldn\u2019t have applied for it [the leave] if I didn\u2019t meet that criteria. That is a company error that an employee on leave didn\u2019t receive incredibly critical information,\u201d she said. <\/p>\n<p class=\"c-paragraph paywall \">Ms Doyle said the company  updated its documentation on parental leave only in March 2024, and that the change was not pointed out to her until  the question of docking her pay was raised in October 2024. <\/p>\n<p class=\"c-paragraph paywall \">Kiwana Ennis, BL, for the respondent, said: \u201cThe company has to acknowledge this situation, which is very unfortunate, and I can certainly understand Ms Doyle\u2019s position in respect of it; it did occur due to an administrative error on the part of the company.<\/p>\n<p class=\"c-paragraph paywall \">\u201cObviously there was a mistake, our mistake, but that doesn\u2019t give rise to a contractual entitlement.\u201d <\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/business\/work\/2025\/11\/18\/public-consultation-opened-on-right-to-request-remote-working\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Public consultation opened on right to request remote workingOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">She said the company was entitled to recoup the sum by way of wage deductions, according to the Act. <\/p>\n<p class=\"c-paragraph paywall \">Ms Ennis told the tribunal there were 10 other staff in the respondent company who were also put on notice of overpayment, ranging from \u20ac3,000 to \u20ac11,000. The other staff were \u201crequired to repay it, and they all have\u201d, she said. <\/p>\n<p class=\"c-paragraph paywall \">Ms Ennis said Ms Doyle had been given the option of using contractual annual leave days and bonus payments to offset the alleged liability. <\/p>\n<p class=\"c-paragraph paywall \">Adjudicator Michael MacEntee said: \u201cAsking someone to repay \u20ac20,000; that\u2019s a substantial sum of money in any man or lady\u2019s language.\u201d He asked whether a longer repayment schedule had been considered. <\/p>\n<p class=\"c-paragraph paywall \">Ms Ennis said: \u201cI know Ms Doyle referenced repayment in three months &#8230; obviously it was ridiculous, that was the entire wages for her for three months.
