Newcastle to Liverpool in the event of a \u2018serious breach\u2019 of contract as a football lawyer reveals \u2018two arguments\u2019 the striker could use.<\/p>\n<p>Isak is currently training apart from his Newcastle teammates and refusing to play for the club as he looks to force through a move to Liverpool, with the striker citing \u2018broken promises\u2019 with regard to a new contract as the reason for his strike action in <strong><a href=\"https:\/\/www.football365.com\/news\/newcastle-refuse-to-be-bullied-into-liverpool-sale-by-alexander-isak-statement\" rel=\"nofollow noopener\" target=\"_blank\">a statement he released on social media on Tuesday<\/a><\/strong>.<\/p>\n<p><strong><a href=\"https:\/\/www.football365.com\/news\/liverpool-transfers-insiders-significant-date-one-last-bid-isak\" rel=\"nofollow noopener\" target=\"_blank\">\u2018Quick\u2019 movement is expected on the transfer after the two sides\u2019 clash at St James\u2019 Park on Monday night<\/a><\/strong> and football lawyer Richard Cramer, of Arch Law, has discussed the possible legal angle Isak could be using to force his exit from Newcastle in <strong><a href=\"https:\/\/www.teamtalk.com\/news\/alexander-isak-newcastle-liverpool-transfer-legal-issues-explained-sports-law-expert\" rel=\"nofollow noopener\" target=\"_blank\">an exclusive interview with our friends at TEAMtalk<\/a><\/strong>.<\/p>\n<p>Leeds-based Cramer, who has worked in sports law circles for over 30 years, said: \u201cYou do come across scenarios where a player will say they had a promise of a contract renegotiation or the club would release them if a certain valuation was met.<\/p>\n<p>\u201cBut the reality is \u2013 and this is where agents really need to do their job \u2013 is that such \u2018side agreements\u2019 do not stack up.<\/p>\n<p>\u201cThe standard player\u2019s contract contains an Entire Agreement Clause in it so what you can\u2019t do is manufacture a variation to the contract because there has been a discussion between the director of football and the player.<\/p>\n<p>\u201cBut unless this is actually contained with the standard contract that is registered with the Premier League then it really doesn\u2019t hold much weight in terms of legal standing.<\/p>\n<p>\u201cThat\u2019s argument number one, which I think will fail on Isak\u2019s part.<\/p>\n<p>\u201cArgument number two, which is a little bit legalistic, and imagine there had been a number of discussions between the player and club.<\/p>\n<p>\u201cAnd with it a very strong promise that, if you play well and score goals, we will either look to renew you with an improvement on your contract or we won\u2019t stand in your way providing we get the right transfer fees.<\/p>\n<p>\u201cBut what Isak is arguing is that there have been those discussions and Newcastle have failed to honour their promise.<\/p>\n<p>\u201cTherefore there is a breach of trust and confidence \u2013 and that\u2019s the critical issue here.<\/p>\n<p>\u201cIn any normal contractual agreement between employer and employee, both parties have to act in good faith and owe each other their duties.<\/p>\n<p>\u201cIf those duties are fractured, and the trust and confidence is shattered, then it\u2019s possible for the player to say: \u2018the rift is so bad that it\u2019s irreparable, therefore I want to be released from my contractual obligations because the club have committed a repudiatory breach\u2019.<\/p>\n<p><strong>MORE ON ALEXANDER ISAK FROM the football world, agents, players and directors of football know that anything in terms of a side issue such as a buyout clause and pay increase has to be in writing.<\/p>\n<p>\u201cIt\u2019s very hard for a player to argue a breach of trust, but it does happen.<\/p>\n<p>\u201cThere are players who have had fall-outs with clubs \u2013 Carlos Tevez refused to come off the bench and play for Manchester City in a Champions League match 2011.<\/p>\n<p>\u201cBut it\u2019s really got to be the most extreme behaviour from a club to justify a scenario where a player could walk out of his contract.<\/p>\n<p>\u201cBut it can happen and what we don\u2019t know is the details of the discussions behind the scenes between Isak and Newcastle.<\/p>\n<p>\u201cClearly the player feels highly aggrieved and is now agitating for this move.<\/p>\n<p>\u201cBut it\u2019s tricky.
