{"id":198639,"date":"2025-11-25T02:53:11","date_gmt":"2025-11-25T02:53:11","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/198639\/"},"modified":"2025-11-25T02:53:11","modified_gmt":"2025-11-25T02:53:11","slug":"criminal-charges-against-former-fbi-director-james-comey-dismissed-by-federal-judge-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/198639\/","title":{"rendered":"Criminal charges against former FBI director James Comey dismissed by federal judge \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">A federal judge in the US has thrown out criminal charges against former FBI director <a href=\"https:\/\/www.irishtimes.com\/tags\/james-comey\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/james-comey\/\">James Comey<\/a> and <a href=\"https:\/\/www.irishtimes.com\/tags\/new-york\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/new-york\/\">New York<\/a> attorney general Letitia James, ruling that the prosecutor who brought the cases had been illegally appointed.<\/p>\n<p class=\"c-paragraph paywall \">The appointment of Lindsey Halligan as interim <a href=\"https:\/\/www.irishtimes.com\/tags\/united-states\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/united-states\/\">US<\/a> attorney for the Eastern District of Virginia was unlawful, US district judge Cameron McGowan Currie said in rulings on Monday. She dismissed the charges against Mr Comey and Ms James without prejudice, meaning that prosecutors may be able to refile the cases.<\/p>\n<p class=\"c-paragraph paywall \">\u201cI conclude that the attorney general\u2019s attempt to install Ms Halligan as interim US attorney for the Eastern District of Virginia was invalid and that Ms Halligan has been unlawfully serving in that role since September 22nd, 2025,\u201d judge Currie, a <a href=\"https:\/\/www.irishtimes.com\/tags\/bill-clinton\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/bill-clinton\/\">Bill Clinton<\/a> appointee, wrote in separate rulings in both cases.<\/p>\n<p class=\"c-paragraph paywall \">US president <a href=\"https:\/\/www.irishtimes.com\/tags\/donald-trump\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/donald-trump\/\">Donald Trump<\/a> abruptly installed Ms Halligan in September after her predecessor resigned under pressure to bring charges against Mr Comey and Ms James. Attorney general <a href=\"https:\/\/www.irishtimes.com\/tags\/pam-bondi\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/pam-bondi\/\">Pam Bondi<\/a> decided how to appoint her and Ms Halligan was the sole prosecutor who secured separate grand jury indictments against both of them.<\/p>\n<p class=\"c-paragraph paywall \">The rulings represent another astonishing rebuke of how Mr Trump and his justice department have handled cases within his administration, as other prosecutors have been dealt significant blows by federal judges who found their lawyering to be suspect or unlawful.<\/p>\n<p><img decoding=\"async\" data-chromatic=\"ignore\" alt=\"New York Attorney General Letitia James. Photograph: James Estrin\/The New York Times<\/p>\n<p class=\"c-paragraph paywall \">Ms James and Mr Comey filed separate legal challenges arguing the appointment of Ms Halligan violated the justice department\u2019s process for naming interim US attorneys.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThe implications of a contrary conclusion are extraordinary,\u201d judge Currie wrote. \u201cIt would mean the government could send any private citizen off the street \u2013 attorney or not \u2013 into the grand jury room to secure an indictment so long as the attorney general gives her approval after the fact. That cannot be the law.\u201d<\/p>\n<p class=\"c-paragraph paywall \">Mr Comey was indicted in September for allegedly lying to Congress and obstruction related to testimony he gave in 2020. Ms James was indicted in October for one count of alleged bank fraud and one count of making false statements to a financial institution related to a mortgage on a home she owns in Virginia.<\/p>\n<p class=\"c-paragraph paywall \">Both have denied any wrongdoing and are fighting their respective charges in court.<\/p>\n<p class=\"c-paragraph paywall \">\u201cI am heartened by today\u2019s victory and grateful for the prayers and support I have received from around the country,\u201d Ms James said in a statement. \u201cI remain fearless in the face of these baseless charges as I continue fighting for New Yorkers every single day.\u201d<\/p>\n<p class=\"c-paragraph paywall \">Judge Currie is normally based in South Carolina.
