{"id":208757,"date":"2025-11-30T23:32:10","date_gmt":"2025-11-30T23:32:10","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/208757\/"},"modified":"2025-11-30T23:32:10","modified_gmt":"2025-11-30T23:32:10","slug":"student-awarded-e7000-over-incessant-landlord-demands-and-charge-for-using-dining-table-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/208757\/","title":{"rendered":"Student awarded \u20ac7,000 over \u2018incessant\u2019 landlord demands and charge for using dining table \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">A French student who received \u201cabusive and incessant\u201d demands from his landlord to pay a 17-page-long invoice for \u201cadditional charges\u201d, including use of the dining table for studying, has been awarded \u20ac7,000 in damages.<\/p>\n<p class=\"c-paragraph paywall \">Laurent Stacchetti, who came to Ireland to study at <a href=\"https:\/\/www.irishtimes.com\/tags\/maynooth-university\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/maynooth-university\/\">Maynooth University<\/a>, agreed to <a href=\"https:\/\/www.irishtimes.com\/tags\/renting\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/renting\/\">rent<\/a> a room from Gabriela Hennigan and Michael Hennigan for \u20ac850 per month in 2023.<\/p>\n<p class=\"c-paragraph paywall \">He believed the house in Clonsilla, <a href=\"https:\/\/www.irishtimes.com\/tags\/dublin-15\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/dublin-15\/\">Dublin 15<\/a>, would be shared with other students, though the couple, who were primarily based in Poland, opted to rent out the other rooms on Airbnb after a lack of interest from other students.<\/p>\n<p class=\"c-paragraph paywall \">It was agreed Mr Stacchetti, who lived at the property with the couple\u2019s daughter, would not have to pay for certain utilities in exchange for carrying out some <a href=\"https:\/\/www.irishtimes.com\/tags\/airbnb\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/airbnb\/\">Airbnb<\/a>-related tasks.<\/p>\n<p class=\"c-paragraph paywall \">However, messages and calls from Ms Hennigan requesting him to carry out said tasks for guests became \u201cconstant\u201d, he said, referring to phone records showing more than 20 calls in quick succession on some occasions.<\/p>\n<p class=\"c-paragraph paywall \">One night, he said, he was asked to get a label printed so she could return a purchased item. While he refused to do this as it was late at night, he often carried out the tasks \u201cfor fear of reprisal\u201d, he said.<\/p>\n<p class=\"c-paragraph paywall \">During a busy St Patrick\u2019s weekend last year, when about 10 guests were staying at the property, Ms Hennigan believed Mr Stacchetti was \u201cdisrespectful\u201d and \u201cunhelpful\u201d.<\/p>\n<p class=\"c-paragraph paywall \">She added there had been a loss of income on Airbnb because of his \u201clack of help\u201d which she claimed had caused bad reviews. She subsequently decided to \u201ccharge him for every single service he used\u201d, she told a <a href=\"https:\/\/www.irishtimes.com\/tags\/residential-tenancies-board\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/residential-tenancies-board\/\">Residential Tenancies Board<\/a> tribunal.<\/p>\n<p class=\"c-paragraph paywall \">While Mr Stacchetti was in France during the Easter break, she emailed him a 17-page-long \u201cbill\u201d demanding \u20ac5,255.50, warning he would be denied access to his room unless it was paid in full.<\/p>\n<p class=\"c-paragraph paywall \">The bill, described by the tribunal as \u201cquite extraordinary\u201d, charged the student for studying at the dining table rather than in his bedroom.<\/p>\n<p class=\"c-paragraph paywall \">Ms Hennigan also charged him for each time she believed his girlfriend came to visit, saying she was told by neighbours and cleaners of said visits.<\/p>\n<p class=\"c-paragraph paywall \">She also charged for his girlfriend\u2019s use of the dining table for eating, and for his use of the fridge, telling the tribunal that \u201cjust like a hotel\u201d, there are charges for \u201cadditional amenities\u201d. <\/p>\n<p class=\"c-paragraph paywall \">Mr Stacchetti was also charged for professional cleaning done in preparation for Airbnb guests, the tribunal noted.<\/p>\n<p class=\"c-paragraph paywall \">Ms Hennigan claimed she was entitled to charge him for \u201cbreaches\u201d of his obligations and he was liable for additional charges \u201cthe same as any other guest staying at the house\u201d.<\/p>\n<p class=\"c-paragraph paywall \">She maintained he \u201cowed a debt\u201d and had since \u201ccalculated\u201d that he owed \u20ac14,565.50.<\/p>\n<p class=\"c-paragraph paywall \">The tribunal believed the landlords sought to impose a different type of arrangement on the tenancy agreed, \u201cand blame him when things did not run smoothly with the Airbnb business\u201d.<\/p>\n<p class=\"c-paragraph paywall \">\u201cMost egregious of all\u201d, however, was Ms Hennigan\u2019s \u201crelentless barrage of increasingly aggressive emails\u201d to Mr Stacchetti after he failed to respond to demands for payment while he was in France, it said.<\/p>\n<p class=\"c-paragraph paywall \">It described the correspondence as \u201cabusive and incessant\u201d.<\/p>\n<p class=\"c-paragraph paywall \">In one email sent on March 31st, Ms Hennigan said: \u201cWe are going to do whatever it takes to pull every single pence out of you, even if it involves our physical presence in your apartment in France as you will not be manipulating and arrogantly ignoring our demands to pay.\u201d<\/p>\n<p class=\"c-paragraph paywall \">She went on to inform him that the locks had been changed, saying it was \u201cin your arrogant arse best interest \u2013 trust us as we live longer in this world than you\u201d.<\/p>\n<p class=\"c-paragraph paywall \">Ms Hennigan advertised his room on Airbnb, and subsequently contacted Maynooth University, alleging that he owed her and her husband money, which must have caused \u201cextreme embarrassment, stress and upset\u201d for the student, the tribunal said.<\/p>\n<p class=\"c-paragraph paywall \">It said the overall conduct amounted to a \u201cvery severe\u201d breach of his peaceful occupation of the house, and ordered the couple to pay \u20ac3,500 in damages.<\/p>\n<p class=\"c-paragraph paywall \">It ordered them to pay a further \u20ac3,500 for unlawfully terminating the tenancy, alongside the return of his unlawfully retained deposit of \u20ac850.<\/p>\n","protected":false},"excerpt":{"rendered":"A French student who received
