{"id":212787,"date":"2025-12-03T07:33:07","date_gmt":"2025-12-03T07:33:07","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/212787\/"},"modified":"2025-12-03T07:33:07","modified_gmt":"2025-12-03T07:33:07","slug":"irish-mother-tells-of-upset-and-anger-after-son-denied-citizenship-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/212787\/","title":{"rendered":"Irish mother tells of upset and anger after son denied citizenship \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">A same-sex couple living abroad who applied for an Irish passport for their son say they are \u201cshocked\u201d and feel \u201cdiscriminated against\u201d after being told he is not entitled to Irish citizenship despite his mother being Irish.<\/p>\n<p class=\"c-paragraph paywall \">Robyn Ormond-Collins, originally from Butlerstown, Co <a href=\"https:\/\/www.irishtimes.com\/tags\/waterford\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/waterford\">Waterford<\/a>, and her Welsh wife, Evie Collins, who both work in the NHS in south <a href=\"https:\/\/www.irishtimes.com\/tags\/wales\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/wales\">Wales<\/a>, applied for an Irish passport for the boy when he was born in August.<\/p>\n<p class=\"c-paragraph paywall \">The couple, who are in their 30s, applied for the travel document for him on the basis Ms Ormond-Collins was Irish.<\/p>\n<p class=\"c-paragraph paywall \">They conceived their son through IVF using Ms Ormond-Collins\u2019s embryo. Her wife, Ms Collins, carried the baby and was the birth mother in what is termed \u201cshared motherhood\u201d.<\/p>\n<p class=\"c-paragraph paywall \">They began IVF treatment about three years ago and they said the birth of their son was \u201cthe best day of our lives\u201d.<\/p>\n<p class=\"c-paragraph paywall \">Despite Ms Ormond-Collins being the genetic parent, they were told by the <a href=\"https:\/\/www.irishtimes.com\/tags\/department-of-foreign-affairs\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/department-of-foreign-affairs\">Department of Foreign Affairs<\/a> on Friday, almost four months after applying, there was \u201cno apparent basis\u201d to conclude their son was entitled to citizenship by descent through Ms Ormond-Collins.<\/p>\n<p class=\"c-paragraph paywall \">Under the Irish Nationality and Citizenship Act 1956, the department said citizenship through descent to children born abroad was granted through the child\u2019s \u201cbirth mother\u201d, the child\u2019s genetic father or the child\u2019s adoptive parents.<\/p>\n<p class=\"c-paragraph paywall \">The department offered to leave their application open pending the outcome of a <a href=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2025\/08\/03\/state-secures-supreme-court-appeal-against-citizenship-ruling-for-children-of-same-sex-couples\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/crime-law\/courts\/2025\/08\/03\/state-secures-supreme-court-appeal-against-citizenship-ruling-for-children-of-same-sex-couples\/\">Supreme Court appeal on a similar case<\/a>, though warned a judgment may \u201cnot result in changes to how the law is applied\u201d.<\/p>\n<p class=\"c-paragraph paywall \">\u201cI was angry getting the email. I felt like they were saying I wasn\u2019t his parent just because I didn\u2019t give birth to him,\u201d Ms Ormond-Collins said.<\/p>\n<p class=\"c-paragraph paywall \">\u201cIt felt like he was being excluded. He\u2019s only four months old. Is this what he\u2019s going to be put up against for his life, having two mams?\u201d<\/p>\n<p class=\"c-paragraph paywall \">She wanted Irish citizenship for her son as she was \u201cproud to be Irish\u201d.<\/p>\n<p class=\"c-paragraph paywall \">\u201cIt felt archaic. There\u2019s an image of Ireland being a modern society, but it still relies on laws from the 1950s,\u201d she said.<\/p>\n<p class=\"c-paragraph paywall \">Saying she was \u201cshocked\u201d too, Ms Collins said: \u201cIt\u2019s Robyn\u2019s baby genetically. How can his citizenship be questioned? His mother is Irish.<\/p>\n<p class=\"c-paragraph paywall \">\u201cWe were both so upset. I think it\u2019s the first time I\u2019ve ever felt really discriminated against and the thought that he\u2019s going to have that throughout his life is just heartbreaking.\u201d.<\/p>\n<p class=\"c-paragraph paywall \">Their son has a British passport, but the couple are looking for an Irish one for him, too. <\/p>\n<p class=\"c-paragraph paywall \">In a statement, the Department of Foreign Affairs said it was \u201ca complex legal area\u201d subject of an appeal to the Supreme Court.<\/p>\n<p class=\"c-paragraph paywall \">It said it had written to those whose applications may be affected by the outcome of the appeal, offering to keep their application on hold until a ruling is made.<\/p>\n<p class=\"c-paragraph paywall \">Ms Ormond-Collins and Ms Collins, who met almost 15 years ago at university in Cardiff, said they would leave their son\u2019s passport application open until the Supreme Court judgment.<\/p>\n<p class=\"c-paragraph paywall \">Earlier this year, the State appealed a High Court ruling that found failings in how Irish citizenship laws treated children born abroad to same-sex parents.<\/p>\n<p class=\"c-paragraph paywall \">In one case, a passport was refused for a Spanish-born child, despite an Irish citizen being their genetic mother but not the gestational mother.<\/p>\n<p class=\"c-paragraph paywall \">The High Court had found the Minister for Foreign Affairs erred in interpreting the 1956 Act as excluding her as the child\u2019s parent.<\/p>\n<p class=\"c-paragraph paywall \">In an application to appeal the ruling, the Minister and other state parties said the appeal brought \u201cno prejudice\u201d to the affected families, but said there was a need for certainty about who qualified as a parent or mother.<\/p>\n","protected":false},"excerpt":{"rendered":"A same-sex couple living abroad who applied for an Irish passport for their son say they are \u201cshocked\u201d&hellip;\n","protected":false},"author":2,"featured_media":212788,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[73],"tags":[79,8104,18,19,17,2324,17331,5049],"class_list":{"0":"post-212787","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-business","8":"tag-business","9":"tag-department-of-foreign-affairs","10":"tag-eire","11":"tag-ie","12":"tag-ireland","13":"tag-supreme-court","14":"tag-wales","15":"tag-waterford"},"share_on_mastodon":{"url":"https:\/\/pubeurope.com\/@ie\/115654479385654160","error":""},"_links":{"self":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts\/212787","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/comments?post=212787"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/posts\/212787\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/media\/212788"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/media?parent=212787"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/categories?post=212787"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/ie\/wp-json\/wp\/v2\/tags?post=212787"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
