{"id":213236,"date":"2025-12-03T13:37:11","date_gmt":"2025-12-03T13:37:11","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/213236\/"},"modified":"2025-12-03T13:37:11","modified_gmt":"2025-12-03T13:37:11","slug":"teachers-conviction-for-raping-a-family-member-affects-his-fitness-to-teach-panel-hears-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/213236\/","title":{"rendered":"Teacher\u2019s conviction for raping a family member affects his fitness to teach, panel hears \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">A teacher\u2019s conviction for raping and sexually assaulting a family member affects his fitness to teach, a panel has heard. <\/p>\n<p class=\"c-paragraph paywall \">The teacher was convicted and sentenced a number of years ago on three counts of rape and four counts of sexual assault before a jury at the Central Criminal Court.<\/p>\n<p class=\"c-paragraph paywall \">The teacher subsequently received an 8\u00bd-year jail sentence in the Central Criminal Court.<\/p>\n<p class=\"c-paragraph paywall \">Tuesday\u2019s inquiry heard the offences occurred primarily in the family home, over 20 years ago when both the teacher and his victim were children. The offences occurred over a number of years. <\/p>\n<p class=\"c-paragraph paywall \">At the time of the offences, the teacher was in his mid-to-late teenage years while the family member was in their preteen and early teenage years. <\/p>\n<p class=\"c-paragraph paywall \">Chair Fergal McCarthy noted that the teacher continues to maintain his innocence. <\/p>\n<p class=\"c-paragraph paywall \">In his submission the teacher said he denied the criminal charges against him \u201c100 per cent\u201d, that they were \u201cfalse and fabricated\u201d and that he \u201cdid not assault anybody\u201d. <\/p>\n<p class=\"c-paragraph paywall \">The inquiry heard that the teacher, when interviewed by garda\u00ed, claimed that the allegations against him were motivated by malice in that he had informed other family members of the sexual orientation of his victim. <\/p>\n<p class=\"c-paragraph paywall \">The teacher appealed the severity of the sentence to the Court of Appeal.<\/p>\n<p class=\"c-paragraph paywall \">Eoghan O\u2019Sullivan, barrister for the director of the <a href=\"https:\/\/www.irishtimes.com\/tags\/teaching-council\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/teaching-council\/\">Teaching Council<\/a>, outlined the detail of the offences by the teacher to the inquiry. <\/p>\n<p class=\"c-paragraph paywall \">The sexual misconduct consisted of incidents of sexual touching, oral rape and an anal rape. <\/p>\n<p class=\"c-paragraph paywall \">The teacher, who is serving a prison sentence, attended the hearing remotely and represented himself. <\/p>\n<p class=\"c-paragraph paywall \">He was previously represented by the Teachers\u2019 Union of Ireland (TUI), who, subsequent to his conviction and sentencing, informed the Teaching Council that they were no longer representing him. <\/p>\n<p class=\"c-paragraph paywall \">The inquiry also heard that while the teacher was appealing his conviction and sentence he asked the Teaching Council via handwritten letters to pause its investigation regarding him. <\/p>\n<p class=\"c-paragraph paywall \">In his submission Mr O\u2019Sullivan said that \u201con any analysis\u201d the convictions against the teacher affects his fitness to teach. <\/p>\n<p class=\"c-paragraph paywall \">He said that the teaching profession requires appropriate Garda vetting to safeguard against persons who may cause harm to a child and that these are not people who should be entrusted with access to children. <\/p>\n<p class=\"c-paragraph paywall \">Mr O\u2019Sullivan submitted that the offence of rape, because of its nature, renders a person who has committed such an offence unfit to be a member of the teaching profession and that the same applied to the offence of sexual assault. <\/p>\n<p class=\"c-paragraph paywall \">He added that the teacher abused the familial relationship he had with his victim and that his behaviour involved an abuse of power.<\/p>\n<p class=\"c-paragraph paywall \">Following the decision of the panel at a preliminary hearing, the committee ordered extensive reporting restrictions. <\/p>\n<p class=\"c-paragraph paywall \">These restrictions included that all parties and geographical locations should be anonymised.
