{"id":2209,"date":"2025-08-16T10:28:10","date_gmt":"2025-08-16T10:28:10","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/2209\/"},"modified":"2025-08-16T10:28:10","modified_gmt":"2025-08-16T10:28:10","slug":"sipo-decides-not-to-investigate-cork-td-over-comments-regarding-travellers","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/2209\/","title":{"rendered":"SIPO decides not to investigate Cork TD over comments regarding Travellers"},"content":{"rendered":"<p class=\"contextmenu internal_Body1st\">The Standards in Public Office (SIPO) commission has decided not to carry out an investigation into Cork Independent Ireland TD Ken O\u2019Flynn for comments he made while he was a councillor.<\/p>\n<p class=\"contextmenu Body Body\">A SIPO report published this week explains that in advance of commencing the investigation, the commission decided to hear a preliminary application by the respondent, which was conducted on May 19, 2025. After that, it made the decision not to proceed with the investigation.<\/p>\n<p class=\"contextmenu Body Body\">On April 14, 2022, the commission received a complaint from the Traveller Equality and Justice Project in respect of Mr O\u2019Flynn, and on May 6, 2022, it received a second complaint from the Traveller Visibility Group and the Cork Traveller Women\u2019s Network.<\/p>\n<p class=\"contextmenu Body Body\">The complainants alleged a \u201cconsistent pre-conceived negative attitude towards [Travellers]\u201d and that he was \u201cstereotyping\u2026[and] targeting\u2026the Traveller community in Cork\u201d in comments made in a radio interview and on social media.<\/p>\n<p class=\"contextmenu Body Body\">After a preliminary inquiry, the commission decided that there was sufficient evidence to establish a prima facie case.<\/p>\n<p class=\"contextmenu Body Body\">It explained that Mr O\u2019Flynn \u201cfailed to substantively respond\u201d to the inquiry or engage with initial correspondence, saying: \u201cThis was most unhelpful by the respondent and contributed to significant delay in the commission\u2019s process.\u201d<\/p>\n<p class=\"contextmenu caption\">ALLEGATIONS<\/p>\n<p class=\"contextmenu Body Body\">It explained that the first time the commission was informed of his personal response to the allegations was at the hearing of the preliminary application on May 19, 2025, saying that had he engaged when first contacted in March 2023, the commission may have reached a conclusion at a much earlier stage, but as he did not, \u201cthe commission incurred significant and avoidable costs\u201d.<\/p>\n<p class=\"contextmenu Body Body\">Mr O\u2019Flynn suggested that there was a discrepancy between the transcript and the audio recording of the radio interview, and that he was not carrying out his functions as a member of the local authority when the acts in question were done.\u00a0<\/p>\n<p class=\"contextmenu Body Body\">He also said that his social media posts and radio interview \u201cconstitute legitimate commentary\u201d and highlighted his \u201cconstitutional right to freedom of expression\u201d, and that some of the social media posts pre-date the updating of the Code of Conduct for Councillors to include social media in 2019.<\/p>\n<p class=\"contextmenu Body Body\">The commission listened to the radio interview in its entirety, and noted that the comments complained of were a small proportion of the entire interview.<\/p>\n<p class=\"contextmenu Body Body\">It said that it was not satisfied that one of the comments highlighted by complainants was \u201csufficiently clear to enable it to make a finding\u201d, and that the other comment that was complained about \u201cmust be viewed through the prism of freedom of expression\u201d, deciding not to open a case.<\/p>\n<p class=\"contextmenu Body Body\">In relation to the social media posts, the report states it had \u201cconsidered the respondent\u2019s undertaking to remove the relevant posts and \u2018likes\u2019 and it makes its decision on the understanding that he will do so\u201d.<\/p>\n<p class=\"contextmenu Body Body\">The commission also noted \u201cthe respondent\u2019s (belated) expression of remorse with regard to the hurt that may have been caused\u201d, saying that in light of this, it did not think the posts justify an investigation.<\/p>\n<p class=\"contextmenu Body Body\">It added that if Mr O\u2019Flynn wishes to make an application for costs, it will consider it, but will \u201ctake into account the respondent\u2019s failure to engage with the preliminary inquiry or with the commission at the early stages of this process, which resulted in unnecessary delays and costs to the commission\u201d.<\/p>\n<p class=\"contextmenu Body Body\">Mr O\u2019Flynn said he welcomed the decision not to proceed with an investigation, thanking his legal team, political colleagues, and family, \u201cfor whom this has been a prolonged and challenging time\u201d.<\/p>\n<p class=\"contextmenu Body Body\">He explained:\u00a0<\/p>\n<p class=\"contextmenu Body Body\">\n            \u201cI have not yet met with my legal team to consider the next steps, and I am reviewing all options available to me in respect of those who made and promoted these allegations.\u00a0\n        <\/p>\n<p class=\"contextmenu Body Body\">&#8220;I was elected to speak truthfully, to confront difficult issues directly, and, when necessary, to stand alone.
