{"id":247240,"date":"2025-12-23T07:55:12","date_gmt":"2025-12-23T07:55:12","guid":{"rendered":"https:\/\/www.europesays.com\/ie\/247240\/"},"modified":"2025-12-23T07:55:12","modified_gmt":"2025-12-23T07:55:12","slug":"gardai-rejecting-most-cases-of-alleged-sex-assault-in-defence-forces-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/ie\/247240\/","title":{"rendered":"Garda\u00ed rejecting most cases of alleged sex assault in Defence Forces \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">The vast majority of military sex-assault cases referred to <a href=\"https:\/\/www.irishtimes.com\/tags\/an-garda-siochana\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/an-garda-siochana\/\">garda\u00ed<\/a> under rules introduced following the Women of Honour controversy are being sent back because they do not meet the criminal standard for prosecution.<\/p>\n<p class=\"c-paragraph paywall \">Under regulations introduced in April 2023, the <a href=\"https:\/\/www.irishtimes.com\/tags\/defence-forces\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/defence-forces\/\">Defence Forces<\/a> is obliged to refer all cases against serving members to the Garda for investigation and possible prosecution in the civilian courts.<\/p>\n<p class=\"c-paragraph paywall \">Previously these cases were dealt with under military law through the court martial system.<\/p>\n<p class=\"c-paragraph paywall \">The new measures were introduced following allegations of widespread abuse and misconduct in the Defence Forces made by a group of female veterans known as the Women of Honour, as well as allegations that complaints were covered up and that victims were penalised.<\/p>\n<p class=\"c-paragraph paywall \">About 17 cases have now been referred by the military to An Garda S\u00edoch\u00e1na for investigation, it is understood. <\/p>\n<p class=\"c-paragraph paywall \">However, all but a handful of these cases have been sent back to the Defence Forces due to a lack of evidence of a criminal offence.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/politics\/2025\/11\/24\/minister-for-defence-told-to-hand-over-details-of-people-who-may-have-ignored-abuse-complaints\/\" rel=\"noreferrer nofollow noopener\" target=\"_blank\">Minister for Defence told to provide details of people who may have ignored abuse complaintsOpens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">When a case is referred back, the military police must reinvestigate and assess if the case meets the standard of criminality under military law.<\/p>\n<p class=\"c-paragraph paywall \">Military law operates differently to civilian law regarding criminal matters. Incidents that may not amount to an offence in the civilian world are often treated as a criminal offence by military authorities.<\/p>\n<p class=\"c-paragraph paywall \">\u201cIf a civilian touches someone on the back without their consent, they probably wouldn\u2019t face charges. In the military, that person could be brought in on a number of charges,\u201d a source said.<\/p>\n<p class=\"c-paragraph paywall \">This includes \u201cconduct prejudicial to good order and discipline\u201d, a broad ranging, vaguely defined charge under military law that  has no equivalent in civilian law.<\/p>\n<p class=\"c-paragraph paywall \">It often takes the civilian authorities months to assess if a case meets the standard for prosecution in the ordinary courts before referring it back to the Defence Forces.<\/p>\n<p class=\"c-paragraph paywall \">This delay is a source of frustration for military investigators as the passage of time often makes it more difficult to gather evidence for their inquiries.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThe personnel of \u00d3glaigh na h\u00c9ireann are held to a higher standard of accountability than civilians, reflecting the unique responsibilities of military service,\u201d a Defence Forces spokesman said when asked about the issue.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThe main purpose of military law is to regulate the behaviour of military personnel, having regard to the unique requirements and demands of military life, in order to ensure that the required standard of discipline is maintained at all times. Members of the Permanent Defence Forces are subject to military law at all times.\u201d<\/p>\n<p class=\"c-paragraph paywall \">He said that since 2023, the military refers all cases \u201cof a sexual nature\u201d to garda\u00ed for investigation.<\/p>\n<p class=\"c-paragraph paywall \">\u201cIn some instances, the threshold is not met to warrant an An Garda S\u00edoch\u00e1na investigation.
